Hal! in the City of Anaheim upon s~id petition on ~June 8 1964 ~ notice of which said public hea~i~n~w-~s duly 9iven ~-requt~ed by law ~d th~ pro= vlstona of Title 1~, Ch~P~er 18o76 of the Anaheim ~nt~ipal Code~ and WHEREAS~ said City Plannini] Commission, after du~ ln~pectlon~ inYe~tipatton and studies made by itself and in, its b~half~ and after due consideration of all evidence and reports off,red ~t said hearing, did adopt Resolution Noo 1190 , Series 1963-64 ~ reco~endin9 that Variance Noo ~,64~ant~d, ~t~ coercions therein set forth ~.__~ and '- WHEREAS~ thereafte~ wi th in twenty=two (22) day~ from the date of the, adoption of said resolutton~ the City Council did elect; upon it) own moti~n~ to review the action taken by the City Plannin9 Commission in ~ntin? said variance and did ~et a public hearin9 thereon o ~ ~ on the 14th day of ___July _ ~ 1934 , at 7~00 o~clock PoMo in the~ ~11 n e , y o -~ah~ and notice of ~uch ~blic hea~in9 duly given a~ required ~ law and the provtston~ of Title 1~ Chapter 18076 of the ~eim ~nicipal Code~ and WHEREAS, after due investigation and ~tudies made by itself and in its behalf~, and after due consideration of all the evidence and reports offered at ~atd hearing, the City Council does find and determine that~ There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone~ That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property i~ question. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. That the granting of such variance will not adversely affect the comprehensive general zoning pla~. NOW~ THEREFORE~ BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the minimum side yard requirement and a waiver of the minimum off-street parking requireme~t, as provided in the Anaheim Municipal Code, on the property hereinbefore described, subject to the following condi- tions: That the damaged and/or hazardous sidewalks shall be repaired along Philadelphia Street, as required by the City Engineer and in accordance with standard plans and specificauions on file in the Office of the City Engineer, prior to final building inspection. That trash storage areas shall be provided in accord- a~ce with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. That the owner of subject property shall pay to the City of Anaheim the sum of $25 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibits Nos. 1, 2 and 3~; PROVIDED, H~VER, that the trash storage area shall be reai'~z~n,~-~,~ to provide an additional off- street parking space. The Cit~ Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, her heirs, successors or assigns, ~o comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
