64-431RESOLUTION NO. 64R-431 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 63R-777 IN ~CLASSIFICATION PROCEEDINGS NO. 62-63-112. WHEREAS, the City Council did on October 1, 1963 adopt Resolution No. 63R-777 in Reclassification Proceedings No. 62-63-112, finding and determining that the property and area therein described should be changed from R-A, RESIDENTIAL- AGRICULTURAL ZONE to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, subject to certain conditions set forth in said resolution; and ~EREAS, Condition No. 2 of said resolution provides: "That the completion of these reclassification proceedings is contingent upon the granting of a Conditional Use Permit ; and WHEREAS, Conditional Use Permit No. 422 permitting the construction of a 2-story~ multiple-family planned resi- dential development, with carports, a waiver of the one-story height limitation and a waiver of the 6-foot masonry wall re- quirement along the easterly property line, was granted on October 1, 1963, on the property described in said reclassifi- cation, subject to certain conditions; and ~HEREAS, Tentative Tract Map No. 5623 (Revision No. 1), covering a portion of the area described in said Conditional Use Permit and in subject reclassification has been approved by the City Council, and Conditional Use Permit No. 422 is not required for the type of development now proposed for subject property; and WHEREAS, the City Council finds that inasmuch as Conditional Use Permit No. 422 is no longer required as a con- dition of said reclassification, Resolution No. 63R-777 should ~e amended by adding thereto additional conditions with refer- ence to the development of said property, as more particularly hereinafter set forth; and WHEREAS, the City Council does further find that an ordinance has never been adopted directing said change of zone and completing said reclassification proceedings. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 63R-777 in Reclassi- fication Proceedings No. 62-63-112 be, and the same is hereby, amended by adding thereto the following conditions: That the owner of subject~property shall pay to the City of Anaheim the sum of $25.00 per dwell- ing unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. e That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. -i- 62-63-112 BE IT FURTHER RESOLVED that in all other respects said Resolution No. 63R-777 be and remain in full force and effect.
