64-410PJ.~.]SOLUTION NO. 64R-410 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 479. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from ALBERT TIKKER, 2914 West Lincoln Avenue, Anaheim, California, to establish a one and two-story, multiple-family planned resi- dential development, and permitting a waiver of the one-story height limitation within 150 feet of R-A Zone property and a waiver of the minimum rear yard. requirement, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the Northwest quarter of Section 13, To~nship 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map recorded in book 51, page 11 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the North line of said Section 13, distant thereon North 89© 41' 15" East 1162.30 feet from the Northwest corner of said Section 13; thence South 0© I0' 55" East 1338.22 feet to the South line of the North half of' the Northwest quarter of said Section 13 distant thereon North 89© 37'-30" East 1162.58 feet from the intersection of said South line with the West line of said. Section 13; thence South 89© 37' 30" West along 'the said. South line 184.50 feet; thence North 0© 10' 15" %Yest parallel with the West line of said Section 13, 1338.43 feet to the North line of said Section 13; thence North 89© 41' 15" East 184.30 feet to the point of beginning. Excepting therefrom the Northerly 396.00 feet. Also excepting therefrom that portion lying Southerly of a line that is parallel and concentric with and distant 33.00 feet Northwesterly of a line described as follows: Commencing at the :intersection of the center line of Stanton Avenue and Orange .Avenue, as said intersection is sho~n in County Surveyor's Transit Book 107, page 11 on file in the office of the County Surveyor of said county, on October 23, 1957; thence North 0© 26' 40" West along said Stanton Avenue center line 983.26 feet to the true point of beginning of the line to be described (said true ooint of ben, inning being also distant thereon South 0© 26% 40" East %686.3~ feet-from the center line intersection of said Stanton Avenue and Lincoln Avenue, as said intersection is shovm in said Transit Book 107, page 11 on October 23, 1957); 'thence from said true point of be!~inning, North 57© 33' 20" East 1331.87 feet to the beginning of a curve tangent concave Southerly and having a radius of 1400.00 feet; thence Easterly along said curve through a central angle of 31© 50' 20" an arc distance of 777.97 feet to a line tangent; thence North 89© 23' 40" East 789.50 feet to a point in the center line of Dale Street as said center line is shown in County Surveyor's Transit Book 114, page 33 on file in the office -I- of the County Surveyor of said county, on October 23, 1957, distant thereon South 0© 28' 20~ East 771.90 feet from the center line of Lincoln Avenue, as shown in said. Transit Book ].14, page 33 on October 23, 1957 and also being distant thereon North 0© 28' 20" West 1895.29 feet from the center line of Orange Avenue, as shown in said Transit Book 114, page 33 on October 23, 1957. AND WHEP~AS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on April 27, 1964, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 15.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hear- ing did adopt its Resolution No. 1144 Series 1963-64, granting Conditional Use Permit No. 479, subject to the conditions set forth in said resolution; and WHEP~AS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 3rd day of June, 1964, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: The proposed use is properly one for which a Condi- tional Use Permit is authorized by the Anaheim Municipal Code. The proposed use will not adversely affect the adjoining land. uses and the growth and develop- ment of the area in which it is proposed to be located. The size and shape of nhe site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under -2- the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and thm same is hereby sustained, and that Conditional Use Permit No. 479~.be, and the same is hereby, granted permitting the establishment of a one and two-story, multiple-family planned residential development, a waiver of the one-story structural height limitation within 150 feet of R-A, Residential-Agricultural Zone property and a waiver of the minimum rear yard requirement, on the property hereinbefore described, subject to the following conditions: That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to~final building inspection. That fire hydrants shall be installed as required and determined to be necessary by .the Chief of the Fire Department, said fire hydrants to be in- stalled prior to final building inspection. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued° That subject property shall be developed sub- stantially in accordance with plans and speci- fications on file with the City of Anaheim, marked Exhibits Nos. 1 through 7, Revision No. 3. That a 6-foot masonry wall shall be constructed along the east and south property lines, prior to final building inspection. That this Conditional Use Permit is granted subject to the completion of Reclassification Proceedings No. 63-64-36. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
