RESOLUTION NO. 64R-400 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING THE HIGHEST t~SPECTIVE BIDS ON PROPERTY OFFERED FOR S~E BY THE CITY OF ANAHEIM, AND AUTHORIZING THE CONVEYANCE THEREOF. WHEREAS, the City of Anaheim is the owner of the following described parcels of real property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL ONE: Lot 37 of Tract No. 2210, as shown on a Map recorded in Book 60, page 45 of Miscellaneous Maps, records of Orange County, California. Reserving therefrom an easement over, under, along and across the Northerly 22.50 feet of the Easterly 45.00 feet of said Lot 37 for an existing water well, pumping plant, water storage tank and pipe lines for the purpose of operating, maintaining and repairing same, together with an easement for ingress and egress purposes over, along and across the Easterly 10.00 feet of Lot 37 of said Tract No. 2210. Also reservin~ therefrom all right, title and interest in and to the existing water well, water storage tank, pumping plant motor, and pipe lines and equipment includ- ing · the fence which now encompasses the site of this existing water well, with the right to enter onto the property to remove the foregoing in the event said well is abandoned. PARCEL TWO: Lot 20 of Tract No. 2176, as shown on a Map recorded in Book 59, pages 34 and 35 of Miscellaneous Maps, records of Orange County, California. Reserving therefrom an easement over, under, along and across the Southerly 42.00 feet of the Northerly 70.00 feet of the Easterly 20.00 feet of Lot 20 of said Tract No. 2176, for the purpose of operating, maintaining, and repairing of the existing water well, pumping plant, water storage tank and pipe lines together with an easement for ingress and egress over, along and across the Easterly 10.00 feet of the Northerly 30.00 feet of said Lot 20. Also reserving therefrom all right, title and interest in and to the existing water well, water storage tank, pumping plant motor, all pipe lines and equipment including the fence -1- which now encompasses the site of this exist- ing water well, together with the right to enter onto the property to remove the fore- going in the event said well is abandoned. PARCEL THREE: Lot 22 of Tract No. 2111, as shown on a Map recorded in Book 61, pages 46, 47, and 48 of Miscellaneous Maps, records of Orange County, California. Reserving therefrom an easement over, under and across the Northerly 20.00 feet of Lot 22 of said Tract No. 2111, for the purpose of operating, maintaining and repairing of the existing water well, pumping plant, water storage tank, and pipe lines, together with an easement for the purpose of ingress and egress over, along, and across the Westerly 10.00 feet of Lot 22 of said Tract No. 2111. Also reserving therefrom all right, title and interest in and to the existing water well, water storage tank, pumping plant motor, all pipe lines and equipment, including the fence which now encompasses the site of this exist- ing water well, together with the right to enter onto the property to remove the fore- going in the event said well is abandoned. PARCEL FOUR: Lot 15 of Tract No. 2563, as shown on a Map recorded in Book 78, pages 18 and 19 of miscellaneous Maps, records of Orange County, California. Subject to easements and reservations of record. PARCEL FIVE: That portion of the Southeast quarter of the Southwest quarter of Section 11, Township 4 South, Range 11 West, S.B.B. & M., described as follows: The West 50 feet of the North 76.1375 feet of the following described land: Beginning at a point in the East line of the said Southwest quarter, distant thereon North 0° 14' 50'~ West 360.28 feet from the Southeast corner of said Southwest quarter; thence North 0° 14' 50" West, along said East line, 304.55 feet to the Northeast corner of the land conveyed to Dan J. Healy by deed re- corded May 31, 1933 in Book 616, page 312 of Official Records; thence South 89© 42' 09" West 596.55 feet to the Northwest corner of said land conveyed to Dan J. Healy; thence -2- South 0° 15' 50'~ East, along the West line of said land conveyed to Dan Jo Heal~, 304.59 feet; thence North 89© 41' 55 East 596.46 feet to the point of beginning. Together with an easement for the con- struction, maintenance and operation of water mains, together with the right of ingress and egress over the North 10.50 feet of the following described land: Beginning at a point in the East line of the said Southwest quarter, distant thereon North 0© 14' 50" West 360.28 feet from the Southeast corner of said Southwest quarter; thence North 0© 14' 50" West, along said East line, 304.55 feet to the Northeast corner of the land conveyed to Dan J. Healy by deed recorded May 31, 1933 in Book 616, pa~e 312 of Official Records; thence South 89¥ 42' 09'~ West 596.55 feet to the North- west corner of said l~nd conveyed to Dan J. Healy; thence South 0 15' 50" East, along the West line of said land conveyed, to Dan J. Healy, 304.59 feet; thence North 89© 41' 55'9 East 596.46 feet to the point of beginning. Excepting therefrom the Easterly 45.00 feet, as measured at right angles from the center line of Western Avenue. PARCEL SIX: The West 40 feet of the North 40 feet of Lot 5 of Tract No. 1129, as shown on a Map recorded in Book 38, page 6 of Miscellaneous Maps, records of Orange County, California. Together with an easement over the North 10 feet of Lot 5 of said Tract No. 1129, for ingress and. egress to and from the North 40 feet of the West 40 feet of Lot 5 of said Tract No. 1129. AND WHEREAS, said property is not presently needed for any immediate public use nor municipal purposes; and WHEREAS, the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on May 14 and 21, 1964, a notice stating that sealed proposals would be received by the City of Anaheim at the Office of the City Clerk up to the hour of 2:00 o'clock P.M. on May 29, 1964, and would be opened in public on said date, at 2:00 P.M., in the City Council chambers in the City Hall by the City Manager and City Engineer for the sale by the City of Anaheim of the real property described in said notice and hereinabove described; and W~EREAS, thirty-three proposals were received on or before 2:00 o'clock P.M. on said date on Parcels One, Two, Three, -3- Four and Six above described, none being received, however, on Parcel Five; and WHEREAS, the City Council does find that the following are the highest proposals received on the respective parcels of said property and that said proposals should be accepted, upon the terms and conditions hereinafter set forth: BIDDER PARCEL NO. McCabe Six 301.00 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the proposal of Bob F. Castle, 1634 Catalpa Drive, #3, Anaheim, California, to purchase Parcel Number One, hereinabove described, for the sum of $12,761.00 cash, lawful money of the United States, upon the terms and con- ditions hereinafter set forth, be, and the same is hereby accepted; that the proposal of Charles Stan§el, 5892 South Marshall Avenue, Buena Park, California, to purchase Parcel Number Two, hereinabove described, for the sum of $14,000.00 cash, lawful money of the United States, upon the terms and conditions hereinafter set forth, be, and the same is hereby accepted; that the proposal of L. B. Roquet, 127 West Broadway Street, Anaheim, California, to purchase Parcel Number Three, hereinabove described, for the sum of $13,050.00 cash, lawful money of the United States, upon the terms and conditions here- inafter set forth, be, and the same is hereby accepted; that the proposal of Clyde A. Randolph, 1740 West Ball Road, Anaheim, California, to purchase Parcel Number Four, hereinabove described, for the sum of $14,367.55 cash, lawful money of the United States, upon the terms and conditions hereinafter set forth, be, and the same is hereby accepted; and that the proposal of William H. McCabe, 9381 Hillview Road, Anaheim, California, to purchase Parcel Number Six, hereinabove described, for the sum of $301.00 cash, lawful money of the United States, upon the terms and conditions hereinafter set forth, be, and the same is hereby accepted. That said proposals are accepted upon the following terms and conditions: 1o That the above-mentioned amounts shall be paid to the City of Anaheim on or before July 1, 1964. That said property is sold subject to covenants, conditions, restrictions, reservations, rights, rights of way and easements of record. BE IT FURTHER P~SOLVED that the Mayor and City Clerk be and they are hereby, authorized to execute good and sufficient -4- deeds conveying said parcels of property to the highest respective bidders above-named, and to deliver said deeds to said bidders upon payment to the City of Anaheim of the full purchase price for the respective parcels of property. THE FOREGOING RESOLUTION is approved and signed by me this 3rd day of June, 1964.
