64-386RESOLUTION NO. 64R-386 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CONSENTING TO THE COMMENCE- MENT OF PROCEEDINGS FOR THE ANNEXATION OF INHABITED TERRITORY TO THE CITY OF ANAHEIM. WHEREAS, the following named proponents: John Olson, Jr. Mrs. Joyce A. Olson Richard R. Oehmcke Bernice Oehmcke Harry J. Forshey Kathleen Forshey Catherine Ramos Manuel Ramos Harold Torborg Lorraine Torborg Hubert Allen Shirley Allen Etta Marie Krueger Robert Kruse Betty C. Kruse Danny F. Collins Georgetta Collins Charles B. Cunningham Imogene F. Cunningham Theresa M. Fogarty Robert L. Lampshire Beverly J. Lampshire Keith D. White Clara White Lawrence E. Woodard Marilyn Woodard Harris N. Done, DDS Margaret J. Done have filed with the City Council a written request, requesting the consent of the City Council of the City of Anaheim to the commencement of proceedings for the annexation of the herein- after described territory to the City of Anaheim, and stating that said territory is inhabited territory and is contiguous to the City of Anaheim; and WHEREAS, the City Council does find and determine that it would be to the advantage and benefit of the City of Anaheim and to the qualified electors residing within said territory to permit the above named proponents to commence proceedings for the annexation of said territory to the City of Anaheim, upon the conditions hereinafter set forth; and WHEREAS, said request has been referred to the City Planning Commission and its report and recommendations re- ceived recommending the granting of consent to commence proceedings for annexation of said territory to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the consent of the City Council be, and it is hereby given to said proponents to commence proceedings for the annexation of the hereinafter described territory to the City of Anaheim upon the following conditions: First: That the proposal for annexation of said territory to the City of Anaheim shall be submitted to the Local Agency Formation Commission by filing a notice of intention to annex with the Commission, containing the specific boundaries of the territory proposed to be annexed. -1- Second: That the proposal for annexation of said territory to the City of Anaheim shall be submitted to and reported upon to ~he proponents by the Boundary Commission of the County of Orange, with respect to the definiteness and certainty of proposed boundaries. Third: That no petition be circulated for the annexa- tion of saz-~rritory until after notice of intention to circulate such petition has been published as required by law, and a copy of such notice and an affidavit of publication has been filed with the City Clerk of the City of Anaheim within ten (10) days after the date of publication of said notice, and a resolution has been adopted by the City Council of the City of Anaheim acknowledging receipt of said notice and approving the circu- lation of said petition. Fourth: That the circulation of any petition for the annexation 'of said territory to the City of Anaheim shall not be commenced until twenty-one (21) days afterthe publication of said notice of intention to circulate the same. The boundaries of the territory for which proceedings are proposed to be commenced for the annexation thereof to the City of Anaheim are described as follows: -2- WAGNER-RIO VISTA ANNEXATION Revised April lO, 1964 That parcel of !and, located in the County of Orange, State of California, described as Follows: Beginning at a point in the existing City Limit line of the City of Anaheim as established by the Wagner-Sunkist Annexation passed by Ordinance No. 1616, September 5, 1961 and filed with the Secretary of State October 5, 1961 and recorded in the office of the County Recorder of Orange County, California, October 9, 1961, said point of beginnin9 being the most Southeasterly corner of the aforementioned WagneriSunkist Annexation, said Southeasterly corner being the intersection of the Southerly prolongation of the East line of the West half of the Southeast quarter of Section 13, Township 4 South, Range 10 West, S.B~B~ & M~, with a tine parallel with and 30.00 feet Southerly as measured at right angles from the North line of the Northeast quarter of Section 24, Township 4 South, Range 10 West, S~B~B~ & M., said parallel line also being the Southerly right of way line of Ball Road, 60°00 feet in width; thence Following along a portion of the existing City of Anaheim City Limit line as established by said Wagner-Sunkist Annexation the following courses and distances: North O0© 13' East 2,650 feet, more or less, along the said Southerly prolongation and along the said East line of the West half of the Southeast quarter of Section 13, to an intersection with a line parallel with and 20~00 feet Southerly as measured at right angles from the North line of the Southeast quarter of said Section 13; thence South 89© 54' East 1,350 feet, more or less, along the last mentioned parallel line and the Easterly prolongation thereof to an intersection with a line parallel with and 30.00 feet easterly as measured at right angles from the West line of the Southwest quarter of Section 18, Township 4 South, Range 9 West, S.B.B~ & M., in the Rancho San Juan Ca jori de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California; thence -3- 2. Leavin9 the said existing City of Anaheim City L. imit line South 0° 10' 44I' West 322 feet, more or less? along the last mentioned parallel line to an intersection with the Northeasterly prolongation of the Southeasterly line of the Rancho San Juan Cajon de Santa Aha I~ancho line, as said Rancho line is shown on the Map of Tract No. 4716 recorded in Book 171, pages 36 through 40 of Miscellaneous Maps, records of Orange County, California~ thence 3. South 25° 50' 34L' West L~02 feet, more or less, along the said Northeasterly prolongation and a portion of the Southeasterly line of the said Rancho San Juan Cajon de Santa Ana Rancho line to an intersection with the Easterly line of Tract No0 4716, as said interI section is shown on the Map of said Tract Noo 4716; thence 4. Following along a portion of the Easterly line of said Tract No. 4716, also being a portion of the Southeasterly line of the Rancho San Juan Cajon de Santa Ana Rancho line as shown on the Map of said Tract Noo 4716, the followin9 courses and distances: South 25° 50' 3bt'' West 1002v32 feet, South 40° 37' 08" West 437o41 feet to the most Northerly corner of Lot 42 of said Tract No. ]+716; thence 5. South 0° 04' 34" West 733°79 feet, leaving the said Southeasterly line of the Rancho San Juan Cajon de SaNta Aha Rapcho line and continuing along a portion of the Easterly line of said Tract No. 4716, and the Southerly prolongation thereof to an intersection with a line parallel with and 20.00 feet Southerly as measured at right angles from the center line of Ball Road; thence 6. South 89° 34~ 20" West 130 feet, more or less~, along the last mentioned parallel line, being the Southerly right of way line of Ball Road, 40°00 feet in width, to an inter- section with the Easter!y right of way line of Eaton Way, 40~00 feet in width; thence 7. South 0° 02' 50" East !O.O0 feet along the Easterly right of way line of said Eaton Way to an intersection with a line parallel with and 30°00 feet Southerly as measured at right angles from the center line of Ball Road; said point of intersection being the Easterly prolongation of the Southerly right of way line of Ball Road, now 60.00 feet in widthi thence 8.
