A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE ACTING DIRECTOR OF
COMMUNITY AND ECONOMIC DEVELOPMENT OR THEIR
DESIGNEE TO SUBMIT AN APPLICATION TO THE UNITED
STATES ECONOMIC DEVELOPMENT ADMINISTRATION
FOR ECONOMIC ADJUSTMENT ASSISTANCE GRANT
FUNDS AND, IF AWARDED, AUTHORIZING THE
ACCEPTANCE OF SUCH FUNDING ON BEHALF OF THE
CITY AND AMENDING THE BUDGET ACCORDINGLY.
WHEREAS, the United States Department of Commerce, Economic Development
Administration (EDA) ("Grantor") has been delegated the responsibility to lead the Federal
economic development agenda including, but not limited to, assisting communities in their efforts
to accelerate the economic recovery from the coronavirus pandemic. The EDA is responsible for
administering the American Rescue Plan Economic Adjustment Assistance Program (the
"Grant"), and establishing necessary procedures governing the Grant application process; and
WHEREAS, said procedures established by the EDA recommend that applicants certify
the approval of the application before submission to the EDA; and
WHEREAS, successful applications will be conditioned upon enter into a contract with the
EDA setting forth the standard terms and conditions ofthe Grant; and
WHEREAS, the City Council of the City of Anaheim approves the filing of a Grant
application to enhance business retention and expansion programs. Specifically, for the
development of a Store One, a community business incubator and workforce development space,
located at 722 N. Anaheim Blvd. (the "Project").
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. The Acting Director of Community and Economic Development, or their designee
(hereinafter collectively referred to as the "Director"), is hereby authorized and directed to apply for
and submit to the EDA an application for the American Rescue Plan Economic Adjustment
Assistance grant on behalf of the City of Anaheim, a public entity established under the laws of
the State of California. The City of Anaheim hereby agrees to comply with each and all terms,
conditions, and limitations imposed by the EDA upon said Grant, and if approved, the Director is
hereby authorized and directed to enter into, execute, and deliver all documents required or deemed
necessary or appropriate to secure the Grant, and all amendments thereto. The City of Anaheim
delegates authority to the Acting Director of Community and Economic Development, or their
designee, to conduct all negotiations, sign and submit all documents, including, but not limited to
applications, agreements, amendments, and payment requests, which may be necessary for the
completion of the Project.
2. The City of Anaheim certifies that it has or will have available, prior to
commencement of any work on the Project included in this application, the sufficient funds to
complete the Project.
3. The City of Anaheim agrees to comply with all applicable federal, state, and local
laws, ordinances, rules, regulations, and guidelines.
4. The City Council of the City of Anaheim hereby agrees to, and by resolution, does
accept any such Grant so awarded to the City of Anaheim without further action of the City Council
being required.
5. Contingent upon award of said Grant, the annual budget of the City of Anaheim is
hereby amended by increasing revenue and expenditures in an amount equal to the amount of the
Grant Funds awarded.
