Works ~SOLUTION NO. 64R-331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AN AMEND~NT TO THAT CERTAIN AGREEMENT ENTERED INTO MAY 1, 1962 BY THE CITY OF ANAHEIM AND STEWART COMMISSARIES. WHEREAS, The W. P. Stewart Co., a corporation, is the successor to Stewart Commissaries, a corporation; and WHEREAS, the City of Anaheim and Stewart Commissaries did enter into a contract on the 1st day of May, 1962, for a period of two years from the date thereof; and WHEREAS, said parties do desire to continue said contract for an additional term of two years but with an amendment to Section "Sixth" thereof to provide for a more equitable method of assessing the costs of utilities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that an agreement be made and entered into by and between the City of Anaheim and The W. P. Stewart Co., successor to Stewart Commissaries, amending that certain agree- ment entered into on May 1, 1962 by City of Anaheim and Stewart Commissaries as follows: That said contract dated May 1, 1962 be extended for an additional period of 2 years, to expire on April 30th, 1966, on the same terms and conditions as set forth in said contract, except that Section "Sixth" thereof shall be amended, to read as follows: "SIXTH: City shall furnish all water and other utilities used by the Concessionaire in connection with concession privileges hereunder, except telephone which shall be furnished by Concessionaire, and Concessionaire shall pay for the utilities furnzshed' by City. based. .~, on gross sales as defined in Section Ninth as follows- GROSS SALES PER MONTH PAYMENT PER MONTH $0 - $2,000 $70 $2,000 - $3,000 $75 Sa,ooo - 4,ooo $4,000 - $5,000 $95 and $5.00 per $1,000 or fraction thereof of additional gross sales over $5,000."
