64-101RESOLUTION NO. 64R-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAT- ING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Council did on November 19, 1963, adopt Resolution No. 63R-916 in Reclassification Proceedings No. 63-64-44, finding and determining that the property and area hereinafter described should remain in R-A, RESIDENTIAL- AGRICULTURAL ZONE, in which it was incorporated, and that the reclassification to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, as recommended by the City Planning Commission in its Resolution No. 941--Series 1963-64, should be denied; and WHEREAS, upon request of the applicant, through his agent, Mr. John Ausilio, and upon receipt of information and evidence to the effect that the denial of said reclassification of subject property will impose undue hardship in the use of said property, the City Council did direct the City Clerk to schedule a public hearing on February 11, 1964, in the Council Chamber in the City Hall, in the City of Anaheim, to reconsider said change of zone; and WHEREAS, notice of said public hearing to reconsider said proposed change of zone having been duly given, the City Council did at the time and place fixed therefor, duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and. WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: The north 211.41 feet of the east 271.2 feet, measured from the center line of Palm Street, of Lot 6 of the Orchard Park Tract, in the City of Anaheim, as shown on a map thereof recorded in Book 6, Page 48 of Miscellaneous Maps, Records of Orange County, California. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: t That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Harbor Boulevard for street widening purposes. -1- 63-64-44 · That the owners of subject property shall dedicate to the City of Anaheim all vehicular access rights to Harbor Boulevard. · That the completion of these reclassification pro- ceedings is contingent upon the granting of Variance No. 1605. · That Conditions Nos. 1 and 2 above-mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper. BE IT FURTHER RESOLVED that Resolution No. 63R-916 be, and it is hereby rescinded.
