64-069RESOLUTION NO. 64R-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 512. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from ALBERT J. JANZEN, FLORENCE JANZEN, F. N. DOYLE, LARRY P. SHIELDS and WILMA L. MILLER for a Conditional Use Permit to establish a twenty-two story hotel, including specialty shops and associated services: on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1: Beginning at the Northwest corner of Lot 29 of Anaheim Extension, as shown on a map thereof, made by William Hamel and filed in the office of the County Recorder of Los Angeles County, California~, in Book 3~ page 163~ Miscellaneous Records of Los Angeles County; thence Easterly along the Northerly line of said Lot 29, a distance of 613.57 feet to the Westerly right of way line of the Southern Pacific Railroad; thence South- easterly along said right of way to the Northeasterly corner of the 9.38 acre tract conveyed to Samuel J. Luhring by deed recorded in Book 212, page 242, Deeds.~ Records of said Orange County; thence Westerly along the Northerly line of said 9.38 acre tract, 827.7 feet to the Northwesterly corner thereof; thence Northerly along the Westerly line of said Lot 29 to the point of beginning; EXCEPTING and reserving the Northerly and Westerly 33 feet of said ].and for road purposes. EXCEPT the interest of the public in the Westerly 33 feet for road purposes, as contained in a resolution of the Board of Supervisors of said county~ dated June 5, 1918, and filed in Minute Book. 13~ page 292. ALSO EXCEPT that portion thereof lying Easterly of the Westerly line of the land described in deed to the State of California, recorded April 8~ 1955 in Book 3024~ page 146~ Official Records~ AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on December 9, 1963, notices of which said public hearing wer~ duly given as required by law and the provisions of Title 18, Chapter 18~76 of the Anaheim Municipal Code; and ~EREAS~ said Commission~ after due inspection~ investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 987, Series 1963-64~ granting Conditional Use Permit No. 512, subject to the conditions therein set forth; and WHEREAS~ thereafter, within twenty-two (22) days from the date of the adoption of said resolution~ a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Conditional Use Permit and said appeal was set for public hearing on January 21, 1964, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required 'by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -3- WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS~ the City Council finds, after careful consideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health~ safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use l~ermit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW~ THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting said Conditional Use Permit be~ and the same is hereby sustained, and that Conditional Use Permit No. 512 be, and the same is hereby~ granted permitting the construction of a hotel~ including specialty shops and associated services, on the proper~y hereinbefore described~ the total height of the structure not to exceed 160 feet from the present natural grade level, subject to the following conditions: 1. That the owners of subjec't property shall deed to the City of Anaheim a strip of land 57 feet in width from the center line of the street, along West Street, as required by Resolution No. 6111 of the City Council, or the latest revision thereof= for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road, for street widening purposes. -4- 3. (a) That all engineering requirements of the City of Anaheim along the Freeway Off-ramp, Ball Road, West Street and Vermont Street, including preparation of improvement plans and installation of all improvements= such as curbs and gutters~ sidewalks, street grading and paving~ drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installa- tion of said engineering requirements. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along the Freeway Off-ramp, Ball Road, West Street and Vermont Street, for street lighting purposes. 5. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets prior to final building inspection. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department~ said fire hydrants to be installed prior to final building inspection. 7. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked '~Exhibits Nos. 1~ 2~ 3~ 4:~ 5 and 6~'~' provided, however, that the garage parking facilities and abutting parking area shall be developed in accordance with Exhibit No. 7. 8. That tree wells shall be provided at approximately 40-foot intervals in the West Street, Ball Road and off-ramp parkways abutting subject property; that plans for said tree wells and the plantings therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted with trees prior to final building inspection. 9. That a strip of land of a minimum width of ten feet shall be landscaped and said landscaping maintained along West Street, Ball Road and the off-ramp frontages~ as indicated on Exhibit No. 2 on file with the City; that plans for said land- scaping shall be submitted to and approved by the Superintendent of Parkway maintenance; and that said landscaping shall be installed prior to final building inspection. -5- 10. That all air-conditioning facilities shall be properly shielded from view. 11. That the total height of the structure shall not exceed 160 feet from the present natural grade level of subject property. 12. That Conditions Nos. !~ 2, 3(b) and 4 above- mentioned shall be complied with within a period of 180 days from date hereof or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners~ their heirs, successors or assigns~ to comply with the Anaheim b~unicipal Code and regulations and the conditions herein.
