RESOLUTION NO. 64R- 66
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREEMENT WITH THE CITY
OF FULLERTON WITH REFERENCE TO DIS~IBUTION
OF COSTS ON COMMON BOUNDARY STREETS.
WHEREAS, the cities of Anaheim and Fullerton have
various common boundary lines lying within or adjacent to
public streets; and
WHEREAS, such common boundary lines lying within
public street rights of way generally are not located at the
street center line, but are located at or near the edge of the
street right of way; and
WHEREAS, from the standpoint of maintenance and con-
struction, both cities feel that the equitable distribution of
such costs on boundary streets should be divided equally be-
tween the cities as if the city limit line were located at the
street center line; and
WHEREAS, it is the desire of the cities of Anaheim
and Fullerton to apportion the maintenance and construction
costs equally on those streets where the common city boundary
falls within the existing or proposed future street right of
way; and said cities desire to enter into an agreement to
accomplish the equitable distribution of said maintenance and
construction costs; and
WHEREAS, the City of Fullerton has submitted to the
City of Anaheim a form of agreement to be made and entered into
as of January 7, 1964, providing for the apportionment of said
maintenance and construction costs, which agreement the City
Council finds would be for the benefit and best interest of
the City and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this day submitted to
the City Council by the City of Fullerton to be made and entered
into as of January 7, 1964, by and between the cities of
Anaheim and Fullerton, with reference to the apportionment of
maintenance and construction costs on common boundary streets,
be and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
