64-039RESOLUTION NO. 64R- 39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings Noo 63-64-54 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zo~e or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 21st day of January , 19 64 , as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof im the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine t~at~h~ amendment to T~tle 18 of the Anaheim Municipal Code snou£a oe aaopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Co.uncil of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit' -1- 63-64-54 That pornion of Lot 16 of P.A. Stanton Tract, in the City of Anaheim, as per map recorded in Book 5, Pages 23 and 24 of Miscellaneous Maps, in the office of the County Recorder of said Orange County; said land lying south of the South line of the North 1 acre of said Lot. EXCEPTING THEREFROM the West 345 feet. TOGETHER WITH the West 20.00 feet of that certain roadway adjoining said land on the East vacated and abandoned by resolution of the City Council of the City of Anaheim, No. 63R-560, a certified copy of which was recorded July 9, 1963 in Book 6623, Page 821 of Official Records. NOTE: According to the record map of said Sub- division, the areas and distances of said property are measured from adjoining street centers. be excluded from ~-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the follow- ing conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 40 feet in width, from the center line of the street, along Winston Road for street widening purposes, and shall also deed to the City of Anaheim the necessary land to insure a 50-foot property line radius on the cul-de-sac. 2. (a) That all engineering requirements of the City of Anaheim along Winston Road, including prepara- tion of improvement plans and installation of all improvements~ such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the in- stallation of said engineering requirements. 3. That the owners of subject prope~rty shall pay to the City of Anaheim the sum of ~2.00 per front foot, along Winston Road, for street lighting purposes. 4. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked "~xhibits Nos. 1 and 2"; PROVIDED, HOWEVER, that the westerly 21-foot drive shall be reduced to 9 feet, which 9 feet shall be developed in con- junction with an existing 21-foot drive on the abutting property to the west, and that the remaining 12 feet shall be utilized so as to establish a 6-foot landscaped setback of the proposed structures from the easterly and westerly drives. -2- , That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 496. · That Conditions Nos. 1, 2(b) and 3 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
