A ~SOLUTI6N OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE COMPROMISE OF
CERTAIN EMINENT DOMAIN LITIGATION.
WHE~A~C, heretofore~ by its ResOlution No. 63R-808 the
City of Anaheim authorized and directed the initiation of con-
demnation proceedings which resulted in tl~e commencement of
Orange County Superior Court Case No. 117511, being entitled
:.~t~ of A.nahezm~ etc.~ vs. Southern California Edison Company,
etc., et ai.'~', and.
WHEREAS, the parties to said litigation have entered.
:into a Stipulation of Facts 'and As To Value, agreeing upon the
amount of consideration to be paid and the costs incurred in
connection therewith; and -
W~IEziEAS, the parties to said. litigation intend to submit
s~ch matter to the Court for'its j udgraent, and Plaintiff City will
require certain funds to complete said litigation and .acquire the
,2roperty therein involved' and.
WHEREAS, the City Council of the City of Anaheim finds
thac the sum of $410,823.02 is a fair and reasonable amount to be
~azd for the property condenmed and. that the sum of $19 00
represents the cost~ incurred by defendants.
NOW, THE~FO~, BE IT RESOLVED by the City Council of the
City of Anaheim that the Finance Director be, and he is hereby
authorized, and directed to deliver to the City Attorney's Office
the sum of $410,823.02 payable to Southern California Edison
Company, Harris Trust and Savings Bank, as Trustee for Southern
California Edison Company, and Security First National Bank, as
Tzustee for Southern California Edison Company, and. the sum of
$19.00 payable to Southern California Edison Company to be
de!ivere~ to said defendants 'by 'the City Attorney when the City
.2ttorney has filed a Stipulat£on of Facts and. As To Value and. a
Judgment in Condemnation in said. Superior Court action.
