64-019 RESOLUTION NO. 64R- A RE~O. LUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINALLY ACCEPTING THE COMPLETION OF THAT ~qDRTION OF WORK ORDER NO. DESCRIBED AS FOLLOWS: ITEM ~5, READING TABLES AND C~ I RS-- SECTION ~f3 OF SPEC IFI CATIONS - FU~4ITURE, A~ ITE~4 ~6, BALANCE OF FURNITURE ~A~ MISCELLANEOUS ITEMS--SECTION f3 OF SPECI- FICATIONS - FURNITURE, FOR THE ANAHEIM CENT~L LIB~RY AT BROADWAY AND ~RBOR BOULEVARD, IN THE CITY OF AN'AHE IN. W%{EREAS, the City Council of the City of Anaheim did ca'use to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on November 6th and 13th, 1962, a notice invitinu sealed proposals for furnishing the following: All work, labor and materials for the construction and installation of wood and metal sh¢lvin~ and for the construction and installation of cabinet work, and the furnishi'ng and installation of all furniture and fixt'urcs for the Anaheim Central Library located at the southwest corner of Broadway and Harbor. Boulevard in the City of Anaheim, in accordance with the plans and specifications prepared by Joe Jordan and Associates, Architects, and on file in the office of the City Clerk and City Engineer, Work Order No. [4502. in accordance with the specifications pre~pa, red by Joe Jordan and Associates, Architects, and the notice invitin~ sealed proposals, which said notice specified that sealed proposa.ls as specified ~n said notice would be received Up until 2:00 o~ctock P.M. of the 29th day of November, 1962, and which said notice did state and declare that, pursuant to the provisions of Section" 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prcvail~n§ rate of wages for each type of labor needed to execute sa:id contract and did set forth the prevailin~ hourly wage scale so ascertained; and ' ~7{EREAS, on November 29, 1962, at the hour of 2-00 o~.clock P.M., the Ci'ty. Clerk and City Engineer did open said sealed .proposals received up to that time for the furnishing of all work, labor and materials for thc construction and instal- lation of wood and metal she lying and for the construction and installation of cabinet work, and the furnishing and installation of all furniture and fixtures for the Anaheim Central L~brary, located at the southwest corner of Broadway and Harbor Boulevard in the City of Anaheim, in accordance with the plans and specifi- cations prepared by Joe Jordan and Associates, Architects, ard on file in the Office of the City Clerk or City Engin¢¢r~ in public, in the City Council Chamber in the City Hall, Anaheim, California, and the City Engineer did tabulate the result of said scaled proposals and did make a report to the City Council at its next regular meeting; and WHEREAS, the City Co~uncil of the City of Anaheim did, at its regular meeting, held on the llth day of December, 1962, at the hour of 3:00 o~clock P.M., cons/der the sealed .proposals -1- submitted for furnishing the materials and performing the work hereinabov¢ more particularly described and set forth, and did thereupon find the deter.mine that the sealed proposal submitted by CARROLL SAGAR AND ASSOCIATES, a Corporation, 8833 Beverly Boulevard,. Los Angeles ~8, California, for the furnishing, in- stal lation and completion of that .portion of sa~d library shelvin§, cabinets, furniture and fixtures described as follows- Item Rea. ding Tables and Chairs -- Section ~3 of Specifications - Furniture, Item -Y6, Batance of Furniture g Miscellaneous Items -- Section.. #3 of Specifications - Furniture. was the lowest responsible proposal s'ubmitted therefor, and thereupon accepted said bid and did award a contract to sa ~d:" CARROLL SA~AR g ASSOCIATES for furnishin9 said reading tables and chairs, and balance of furniture and miscellaneous items, and all lab°r, services, materials and equipment necessary to ~nstall the same ~n a §ood and workmanlike manner, in strict accordance with the specifications therefor, and did authorize the Mayor and the City Clerk of the City of Anaheim to execute a contract for and on be- half of the City of Anaheim with CARROLL' &AGAR & ASSOCIATES, Which s.aid contract was duly made and entered into on th'e l lth day of February, 1963; and WHEREAS, the said CARROLL SAGAR & ASSOCIATES has furni- shed all labor, se~tces, materials and equipment necessary' for the delivery, installation and completion of said l~brary readtn~ tables and chairs and furniture and miscellaneous items in a ~ood and workmanlike manner, in strict accordance with the specifications therefor and as specified in the notice invttin~ sea'led proposals, and the contract made and entered into with ~t by the City of Anaheim; and WHEREAS, the Director of Public Works has duly certified to the furnishing, installation and completion of that Portion of sa~d public improvement hereinabove mentioned and described, in accordance with the specifications and the contract documents d'uly raade and entered ~nto with said CARROLL SAGAR & ASSOCIATES; and t~tEREAS, the City Council finds that sa id contractor has completed said .portion of said public improvement hereinabov¢ more .particula. rly described in accordance wit h the provisions of the contract and the contract documents, and that notice of com- pletion of said portion should be filed and payment of the balance due said contractor authorized in a. cdordance with the contract- documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of said library reading tables and chairs and furniture and miscellaneous items described as Item //~, Readin~ Tables and Chairs -- Section Y3 of Specifications - Furniture, Item ~6, Balance of Furniture & Miscellaneous Items -- Section ~f3 of Specifications - Furnitur¢~ Work Order No. and all labor, services, m. aterial$ and equipment and the perfor- mance of all work necessary to furnish, deliver, install and complete, in a §ood and workmanlike manner, in strict accordance wi th the spec ifications therefor on file in the Office of the -2- City Clerk or City Engineer, said port,ion of said ,public improve- ment by said contractor, be, and the same ar;e.he, reby....,...a..ccepted, subOect, ncve?theless, to all the tCrm.,s, conditions .and provisions of the contract'documents, and that the balance due said contPac- tot for said library reading tables, chairs, £urnitur¢ and miscellaneous items and work be paid to it thirty-five (3~) days from and after final, acceptance of said library rcadin~ tables, chairs, £urnitur"e ~nd'mts'cellaneo%s items and work :a's'evidenced by the adoption of"thts resolution, but not sooner than thirty (30) days from and after the date of the filing of notice of completion, excepting only such sum or sums as may lawfully be withheld in accordance with the provisions o£ said contract and contract docu- ments. That acceptance by %he contractor of said payments made in accordance with said final estimate shall operate and shall be a release to the City of Anaheim, its officers, agents and em- ployees from all claims and liabilities due thc contractor for anything done or furnished or withheld or for anything relating to the work or any .act or neglect of the City, its officers, agents and employees, excepting only claims against the City for any amounts withheld by the C. ity at the time of such payment. AND BE IT FURTHER RESOLVED that the ,Mayor and the City Clerk of the City of Ansh¢im be, and they ~re hereby authorized to execute and file a notice of completion of ssid work as re- quired by law.
