5919ORDINANCE NO. 5919 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING, REPEALING AND AMENDING VARIOUS CHAPTERS, SECTIONS AND SUBSECTIONS OF TITLES 13,14 AND 15 OF THE ANAHEIM MUNICIPAL CODE RELATING TO PARKS AND BOULEVARDS, TRAFFIC, AND BUILDING AND HOUSING, RESPECTIVELY WHEREAS, the City Council of the City of Anaheim desires to conform Titles 13, 14 and 1.5 of the Anaheim Municipal Code to changes in state law and previous amendments to the City Charter; and WHEREAS, the City Council desires to correct errors, delete unnecessary provisions, and otherwise update various provisions of the Anaheim Municipal Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That new Section 13.04.005 be, and the same is hereby, added to Chapter 13.04.005 of Title 13 of the Anaheim Municipal Code, to read as follows: "13.04.005 DEFINITIONS. The following words and terms as used in this chapter shall have the meanings respectively set forth in this section unless a different meaning is expressly stated: .010 `Department' or `Parks, Recreation and Community Services Department' or `Parks, Recreation and the Arts Department' or `Parks and Recreation Department' shall all mean and refer to the Community Services Department of the City of Anaheim. .020 `Director' or `Department Head' shall mean the Director of the Community Services Department of the City of Anaheim." SECTION 2. That Section 13.04.020 of Chapter 13.04 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "13.04.020 COMMISSION PROCEDURES; MEETINGS; QUORUM. The Commission shall adopt rules and regulations to govern the conduct of its meetings, subject to the approval thereof by the City Council, and shall, by vote, set a- time for regular meetings, which shall be held at least once each month. A majority of members shall constitute a quorum.' SECTION 3. That Section 13.04.030 of Chapter 13.04 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety, to read as follows: "13.04.030 DUTIES OF COMMISSION. The duties of the Parks and Recreation Commission shall be as follows: .010 Act in an advisory capacity to the City Council and the Director in all matters pertaining to parks and recreation, and to cooperate with other governmental agencies and civic groups in the advancement of sound park and recreation planning and programming. .020 Recommend policies on recreation service for approval of the City Council. .030 Advise the Director on problems of development of recreation areas, facilities, programs and improved recreation services. .040 Recommend the adoption of standards on areas, facilities, programs and financial support. 0.50 Have periodic inventories made of recreation services that exist or may be needed, and make recommendations concerning such services and needs to the City Council and to the Director. .060 Aid in coordinating the recreation service with the programs of other governmental agencies and voluntary organizations. .070 Review the effectiveness of the park and recreation programs with the Director and the City Manager. .080 Interpret the policies and functions of the Community Services Department to the public. .090 Review the annual budget of the Community Services Department before presentation to the City Manager and City Council, and advise the Director on the development of the Recreation Element of the General Plan, strategic planning efforts and any other long-range planning efforts designed to address the service needs of the public." SECTION 4. That Section 13.04.040 of Chapter 13.04 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety, to read as follows: "13.04.040 COMMUNITY SERVICES DEPARTMENT; MISSION. .010 There hereby exists in the City of Anaheim the Community Services Department as created and established pursuant to Section 1.04.110 of the Anaheim Municipal Code. .020 The mission of the Department is to enrich individuals, families and the community through the provision of services, facilities and programs which improve the quality of life in Anaheim. - SECTION 5. That Section 13.04.050 of Chapter 13.04 of Title 13 be, and the same is hereby, amended in its entirety, to read as follows: "13.04.050 DIRECTOR; APPOINTMENT; DUTIES. .010 The City Manager shall appoint, subject to such prior review and approval of the City Council as required pursuant to the City Charter, a Director to administer the park and recreation program. Said Director shall also administer such other programs and services as may from time to time be under the jurisdiction of the Director. 020 The Director shall attend meetings of the Commission and shall serve as Secretary to the Commission without vote and shall make such reports to the Commission or to the City Council as shall be required. 030 The Director shall: .0301 Be responsible for the administration and operation of the Community Services Department, in accordance with the policies recommended by the Commission as approved by the City Manager and the City Council, and shall perform the following specific functions within the budgetary limits as approved annually by the City Council, and provided that all expenditures shall be approved by the City Manager and/or the City Council. .0302 Recommend for employment required personnel according to the standard procedures as set forth by the City of Anaheim and, upon employment, shall supervise them in the performance of their various duties. .0303 Administer, operate, and maintain existing park and recreation areas and facilities and plan for the acquisition, development and operation of proposed facilities in accordance with the policies recommended by the Park and Recreation Commission and as approved by the City Manager and the City Council. .0304 Inform the general public of services and facilities being provided by the Community Services Department. .0305 Solicit suggestions from the general public to improve or increase the effectiveness of the services. .0306 Cooperate with governmental and voluntary organizations and agencies in the furtherance of recreation opportunities. .0307 Prepare manuals, bulletins and reviews on parks and recreation problems. .0308 Provide upon request assistance of technical nature to community agencies and organizations having problems relating to park and recreation areas, facilities and programs. .0309 Counsel with officials of public and private organizations and other interested groups concerning community recreation and leisure activities and assist them in promotion of recreation services. .0310 Conduct studies of local conditions and needs for park and recreational services and assist with recruitment and training of recreational personnel. .0311 Prepare a budget request for the review of the Park and Recreation Commission and present this request to the City Manager and the City Council. Said budget shall provide for recreation services and operating costs for the ensuing fiscal year." SECTION 6. That Section 13.04.060 of Chapter 13.04 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 7. That Section 13.08.020 of Chapter 13.08 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety, to read as follows: " 13.08.020 PROHIBITED CONDUCT GENERALLY. Within the limits of any of said parks, it shall be unlawful for any person or persons to do any of the acts hereinafter specified, to wit: 4 .010 To hitch, fasten, lead, drive or let loose any animal or fowl of any kind, provided that this shall not apply to dogs held on a leash or other restraint, not more than six feet long, nor to any horse when hitched, fastened or led within any City of Anaheim park that links with the County of Orange EMA Harbors, Beaches and Parks Master Plan of Trail Systems ("Special Use Parks"); .020 To ride or drive any horse or other animal, or to propel any vehicle, cycle or automobile, except that such prohibition shall not apply to equestrians and bicyclists (non -motorized) in Special Use Parks. .030 To carry or discharge any firearms, firecrackers, rockets, torpedoes or any other fireworks, or airgun or slingshot; .040 To cut, break, injure, deface, harm or disturb any tree, shrub, plant, rock, building, cage, pen, monument, fence, bench or other structure, apparatus or property; or to pluck, pull up, cut, take or remove any shrub, bush, plant or flower; or to mark or write upon, paint or deface in any manner, anv building, monument, fence, bench or other structure; 0.50 To cut or remove any wood, turf, grass, soil, rock, sand, gravel or fertilizer; .060 To swim, fish in, to bathe, wade in or pollute the water of any fountain, pond, lake or stream: .070 To make or kindle a fire except in picnic stoves, braziers or fire pits provided for that purpose. .080 To camp or lodge therein; .090 To cook, prepare, serve or eat any lunch, barbecue or picnic except at the places provided therefor; .100 To wash dishes or to empty salt water or other waste liquids elsewhere than in the sinks provided for such purposes; provided, however, that nothing contained herein shall be deemed to authorize the dumping or disposal of any waste which is otherwise prohibited by any other law; .110 To leave garbage, cans, bottles, papers or other refuse elsewhere than in the receptacles provided therefor; .120 To play, or engage in any game, excepting at such place as shall be especially set apart for that purpose; .130 To play or bet at or against any game which is played, conducted, dealt or carried on with cards, dice or other device, for money, chips, shells, credit or any other representative of value, or to maintain or exhibit any gambling table or other instrument of gambling or gaming; 5 M .1 40 To indulge in riotous, boisterous, threatening or indecent conduct, or abusive, threatening, profane or indecent language; 150 To disturb in any manner any picnic, meeting, service, concert, exercise or exhibition; .160 To post or erect any bill, notice, paper, circular or advertising or display device of any kind except as approved in conjunction with an event for which a permit has been approved pursuant to this chapter; .170 To sell or offer for sale any merchandise, article or thing, whatsoever, without first obtaining permission from the City Council or a permit from the Community Services Department so to do; .180 To practice, carry on or conduct any trade, occupation, business or profession; provided this subsection shall not apply to any activity occurring as an integral part of an event for which a permit has been approved pursuant to this chapter; .190 To remain, stay or loiter in any public park between the hours of 10:30 p.m. and 5:00 a.m. of the following day; .200 To possess or consume any alcoholic beverage in any public park without first obtaining the permission of the City Council or a permit from the Community Services Department. "Alcoholic beverage" is defined as any beverage defined as an "alcoholic beverage" by the Alcoholic Beverage Control Act of the State of California; 210 To play or engage in the game of golf, or to hit any golf ball with a golf club. 220 Any person violating any of the provisions of this section shall be deemed guilty of an infraction and, upon conviction thereof, shall be punishable by a fine as set forth in Section 36900 of the Government Code, or any successor provision thereto;. Q,FCTION R That Section 13.08.030 of Chapter 13.08 of Title 13 of the Anaheim Municipal Code be. and the same is hereby, amended in its entirety, to read as follows: 13.08.030 PROHIBITED CONDUCT IN OR ADJACENT TO AUDITORIUMS OR OPEN-AIR THEATERS. In and adjacent to any auditorium or open-air theater within any public park, it shall be unlawful for any person or persons to do any of the acts hereinafter specified, to -wit: .010 To hold any meeting, service, concert, exercise or exhibition without first obtaining permission from the City Council or obtaining a permit from the Director of the Community Services Department so to do; 6 .020 To charge any admission fee or to take up any collection at any such meeting, service, concert, exercise or exhibition without first obtaining permission from the City Council or a permit from the Director of the Community Services Department so to do; .030 To loiter in the approaches or walks adjacent to any such auditorium or open-air theater during the progress of any meeting, service, concert, exercise or exhibition, or to disturb in any manner whatsoever any such program while the same is in progress." SECTION 9. That Section 13.08.040 of Chapter 13.08 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety, to read as follows: "13.08.040 GATHERINGS OF MORE THAN TWENTY-FIVE PERSONS. No company, society or organization of more than twenty-five persons shall hold or conduct any picnic, celebration, parade, service or exercise in any public park, without first obtaining permission from the City Council or a permit from the Director of Community Services, and it shall be unlawful for any person to take part in any picnic, celebration, parade, service or exercise held or conducted contrary to the provisions hereof." SFCTION 10 - That 0_ That Section 13.08.050 of Chapter 13.08 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety, to read as follows: "13.08.050 USE OF GENDER SPECIFIC RESTROOMS BY PERSONS OF OPPOSITE GENDER. No person over eight years of age shall enter or use any toilet, restroom, dressing room or other facility in any public park designated by signs or other distinctive means for the exclusive use by persons of the opposite gender." SECTION 1 1 _ That Section 13.08.090 of Chapter 13.08 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety, to read as follows: "13.08.090 USE OF PUBLIC SWIMMING POOLS. It shall be unlawful for any person to enter any swimming pool maintained or operated by the Citv of Anaheim without first having a shower bath and otherwise complying with all health and safety rules and regulations prescribed by the State of California and the County of Orange; it shall t be unlawful for any person after being in such swimming pool to leave the same and re-enter without first taking a shower bath; it shall be unlawful for any person having a communicable or infectious disease of any kind, or suffering from cough, cold, fever, sores or wearing bandages to enter any such swimming pool." SECTION 12. That paragraph .0109 of subsection .010 of Section 13.08.120 of Chapter 13.08 of Title 13 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.0109 Operation of bicycles is prohibited on unpaved roads and areas during wet or muddy conditions." SECTION 13. That new Chapter 14.01 be, and the same is hereby, added to Title 14 of the Anaheim Municipal Code to read as follows: "Chapter- 14.01 GENERAL "14.01.010 DEFINITIONS. For purposes of any provision of this Title 14, the following words, terms and phrases shall have the meanings hereinafter respectively set forth: .010 The terms `City Traffic Engineer', `City Engineer' and `City Manager' as used in this title shall mean the Traffic and Transportation Manager of the City of Anaheim, unless otherwise expressly stated to the contrary." SECTION 14. That Section 14.20.040 of Chapter 14.20 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 15. That Section 14.20.050 of Chapter 14.20 of Title 14 of the Anaheim Municipal Code be.. and the same is hereby, amended to read as follows: N "14.20.050 TEMPORARY SIGNS. Either the Chief of Police and his or her authorized officers, or the City Traffic and Transportation Manager and his or her authorized designees, are hereby authorized to erect and maintain temporary signs or signals regulating traffic and movement of vehicles upon the streets in the City, so as to prohibit travel or turning of vehicles upon said streets as, in their opinion, the occasion may require. No driver of a vehicle shall disobey the instructions of the signs." SECTION 16. That Section 14.20.070 of Chapter 14.20 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 17. That Chapter 14.24 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.24.010 DEFINITIONS. As used in this chapter, the following definitions shall apply: .010 `Chief of Police' means the Chief of Police of the City of Anaheim or his or her designee. .020 `Parade' shall mean any march, demonstration, procession, run, motorcade, or promenade consisting of twenty or more persons, animals, or vehicles, or a combination thereof, having a common purpose, design, destination, or goal which march, demonstration, procession, motorcade, or promenade takes place upon any public place, street or sidewalk and which does not comply with normal and usual traffic regulations or controls. .030 `Person' means and includes any individual, firm, partnership, association, corporation, company, or organization of any kind. "14.24.020 PARADE PERMIT REQUIRED. .010 It shall be unlawful for any person to engage in, conduct, participate in, or carry on the activity of a parade without a permit issued therefor pursuant to the provisions of this chapter. .020 It shall be unlawful for any person who engages in, conducts, participates in, or carries on the activity of a parade to violate any term or condition of any parade permit issued pursuant to this chapter, or otherwise fail to comply with any applicable provision of this chapter. I "14.24.030 PROCEDURE FOR OBTAINING A PARADE PERMIT. .010 Deposit. Each application for a permit to conduct a parade shall be accompanied by a nonrefundable fee of twenty-five dollars ($25.00) for the purpose of paying the cost of processing said application. .020 Application. Any person desiring to conduct a parade shall apply to the Chief of Police for a permit at least seven (7) days in advance of the date of the proposed parade. The Chief of Police shall, for spontaneous parades in reaction to current events, consider any application for a permit to conduct a parade which is filed less than seven (7) days, but at least twenty-four hours prior to the time such parade is to be conducted. The application for such permit shall be on a form provided by the Chief of Police, shall be verified, shall be accompanied by the application deposit referred to in subsection .010 above, and shall contain the following information: .0201 The name, address and telephone number of the person or persons seeking to conduct a parade; .0202 If the parade is proposed to be conducted for, on behalf of or by an organization, the name, address and telephone number of the headquarters of the organization, and of the responsible officer of such organization; .0203 The name, address and telephone number of the parade chairperson, or the person otherwise responsible for its conduct, which person shall be present during the entire parade; .0204 The date(s) on which the parade is to be held; 0205 The route to be traveled, including the starting point and termination points on each date: .0206 The approximate number of persons, animals, and vehicles taking part in the parade, including the type of animals and description of vehicles; .0207 The starting and approximate ending times of the parade on each date; .0208 Whether such parade will occupy all or only a portion of the width of the streets proposed to be traversed; if only a portion of the width of the streets will be occupied, the number of lanes in each direction which will be occupied; 0209 The location by streets of assembly and disassembly of such parade; .0210 The time at which units of the parade will begin assembly in the assembly area; and 0211 The approximate length (in linear feet) of the parade. 10 .030 Notification of Completed Application. Within two (2) business days after the submission of the application, the Chief of Police or the Chief of Police's designee shall notify the applicant. in writing, whether the application is complete. If no such notice is given within forty- eight hours after submission, the application will be deemed to be complete. .040 Indemnification. Prior to issuance of any permit pursuant this chapter, the Chief of Police shall require the applicant to execute a covenant in substantially the following form: `That, in consideration of the issuance of this permit, the permittee and any other persons, organizations, firms or corporations on whose behalf the application is made (the `sponsoring organization') will hold harmless and indemnify the City of Anaheim and its elected officials, officers, employees and agents from any damages which may arise as a result of the conduct of the permittee, the sponsoring organization and any individuals acting pursuant to the sponsoring organization's authority, for which the permit is issued.' .0.50 Transmittal of Application. Upon receipt of the application, the Chief of Police shall transmit a copy of such application to the following: City Manager, Director of Public Works/City Engineer, and Fire Chief. Each of the foregoing may review and provide a written report to the Chief of Police within five (5) days after the filing of such application with recommendations, if any, relating to the required findings set forth in subsection .060 and/or .070 below. Immediately upon issuance of a permit, the Chief of Police shall transmit a copy thereof to each of the above departments. .060 Findings Required for Issuance of Permit. The Chief of Police shall issue a permit for a parade upon finding that all of the following facts exist (and upon receipt of payment of the traffic control, clean-up and repair deposit referred to in section 14.24.040.020 of this chapter) : .0601 The conduct of the parade will not substantially interrupt the safe and orderly movement of traffic in the area of its route, .0602 The concentration of persons, animals and vehicles in the parade will not unreasonably interfere with proper fire and police protection, or ambulance service to areas in the vicinity of the parade or its assembly or disassembly areas; .0603 The parade is not proposed for a time and location for which another parade permit has been previously issued; .0604 The proposed area for the parade, including the assembly and disassembly areas, can physically accommodate the number of participants expected to participate in the parade, as reflected in the application completed and submitted pursuant to the requirements of this chapter. .070 Contents of Permit. Each permit shall set forth the following information and conditions as that information is set forth in the approved application: .0701 The name(s), address(es) and telephone number(s) of the person(s) to whom the permit is issued; .0702 The name(s ), address(es) and telephone number(s) of the sponsoring organization (s), if any, and of the responsible officer of any such organization; .0703 The name, address and telephone number of the parade chairperson, or the person otherwise responsible for its conduct, which person shall be present during the entire parade; .0704 The date(s) on which the parade is to be held; 0705 The route to be traveled, including the starting and termination points on each date; .0706 The approximate number of persons, animals and vehicles taking part in the parade, including the type of animals and description of vehicles; 0707 The starting and approximate ending time for the parade on each date; .0708 Whether such parade will occupy all or only a portion of the width of the street(s) which will be traversed; if only a portion of the width of the street(s) will be occupied, the number of lanes in each direction which will be occupied by the parade; area; .0709 The location by streets of assembly and disassembly of the parade; .0710 The time at which units of the parade will begin assembly in the assembly 0711 The approximate length (in linear feet) of the parade. .080 Combined Application and Permit. The application and permit maybe combined into a single document. A completed application form containing all of the information required by subsections .020 and .070 of this section 14.24.030, when approved and signed by the Chief of Police, shall constitute the permit required by this chapter. A copy of said permit shall be maintained and kept upon the person in charge of the parade at the parade site at all times during the parade, including any assembly and disassembly periods, and shall be presented to any peace officer for inspection upon request. .090 Findings Required for Denial of Permit. The Chief of Police shall deny an application for a parade permit and notify_ the applicant of such denial upon finding one or more of the following facts exist: .0901 The Chief of Police makes any finding(s) contrary to the findings required to be made for the issuance of a permit; 1? .0902 The information contained in the application is false or intentionally misleading in any material detail. .0903 The parade or assembly is proposed to take place in the roadway portion of any street in a commercial zone during, or partially during, the hours of 8:00 a.m. to 10:00 a.m. or during, or partially during, the hours of 4:00 p.m. to 6:30 p.m., Monday through Friday, unless the parade or assembly will occur on a national holiday or local day of celebration declared by the City Council; or .0904 The parade or assembly will require the simultaneous closure of the entire roadway portion of more than two streets (in at least one direction thereof) between the hours of 7:00 a.m. and 8:00 p.m., Monday through Friday, or between the hours of 10:00 a.m. and 6:00 p.m. on Saturday, unless the parade or assembly will occur on a national holiday or local day of celebration declared by the City Council; or .0905 The parade or assembly, will require closure of more than one-half of the roadway portion of any street (in at least one direction )in a commercial zone for more than three hours on any one day between the hours of 7:00 a.m. and 8:00 p.m., Monday through Friday, unless the parade will occur on a national holiday or local day of celebration declared by the City Council. .100 Decision by Chief of Police. The Chief of Police shall act upon the application within five (5) days after the filing thereof. If the Chief of Police finds that such permit should not be issued, he shall mail a notice of his action denying the permit, stating in general terms the reasons for his denial of the permit within said five (5) day period. "14.24.040 PAYMENT FOR CITY PERSONNEL. .010 A permittee under the provisions of this chapter shall reimburse the city for all traffic control costs incurred in connection with diverting traffic due to the closure of streets. No portion of the fee charged shall be based upon the need for security or increased police protection due to the nature of the parade. .020 Prior to issuance of any permit pursuant to this chapter, and within five (5) days following the filing of the permit application, the Chief of Police shall determine the number of police officers needed for the traffic control purposes for said parade and employees in other City departments for traffic control, clean-up and repair of the right-of-way along the parade route. When the number of said officers and employees is determined, the Chief of Police shall also determine the estimated cost of providing said officers and employees (including equipment and traffic control devices) and inform the person, firm or corporation conducting said parade of such estimated costs. The permit applicant may, but shall not be required to, deposit such estimated cost with the Chief of Police prior to the issuance of any permit pursuant to this chapter. .030 Within thirty (30) days following completion of the parade, the Chief of Police shall calculate the final costs of traffic control, clean up and repair required by said parade and notify the permittee of such final cost. Within ten (10) days following the mailing of such notice to the 13 permittee, the permittee shall pay to the City the amount, if any, by which the final cost exceeds the estimated cost theretofore deposited with the Chief of Police. Such amount shall constitute a debt due and owing to the City of Anaheim by the permittee. In the event the estimated cost exceeds the final cost, the excess will be refunded to the permittee within ten (10) days following the mailing of the notice of the final cost to the permittee. "14.24.045 WAIVER OF FEES AND COSTS FOR INDIGENTS. Indigent individuals or organizations may apply for a waiver of any or all of the City's fees and costs, in whole or part, otherwise required by this chapter. An application for any such waiver shall be made in writing to the Chief of Police at or prior to the time said fee, deposit or cost amount is due. Said application for waiver must show in writing, under penalty of perjury, that the parade permit applicant is indigent and, if the indigent is an individual, that such individual is either (a) a welfare recipient, or (b) his or her family income is less than 125% of the poverty line income established under federal law based on the number of dependents in the family, or (c) his or her family income is otherwise insufficient to pay both for necessaries of life and the City's fees and costs (or the portion thereof for which the waiver is requested). The Chief of Police shall act upon such waiver request and provide written notice of the decision within three (3) days following the receipt of such waiver request. "14.24.050 APPEAL TO CITY MANAGER. .010 Any person aggrieved by any decision of the Chief of Police made pursuant to this chapter shall have the right to file a written appeal within five (5) days with the City Manager. .020 The City Manager shall within two (2) business days after the timely filing of such appeal act thereon. If the City Manager finds in favor of the appellant, the appellant shall immediately receive written notice thereof and, if such decision is to approve or conditionally approve and parade permit, the permit shall immediately be issued upon payment of the traffic control, clean-up and repair deposit referred to in section 14.24.040.020 of this chapter. If the City Manager finds that such appeal should not be granted, he shall within such time mail written notice of his action denying the appeal, stating in general terms the reasons for his denial of the appeal. If the denial occurs less than three (3) business days prior to the requested date of the parade, the City Manager shall also make reasonable efforts to provide telephonic notice of such denial. Failure to act within the specified time period shall be deemed a denial of the appeal. The decision of the City Manager shall be final." "14.24.060 CONDUCT OF PARADE PERMITTEE. Each permittee hereunder shall comply with all terms, conditions and provisions of the permit and with all applicable laws of the State of California and the City of Anaheim. Each permittee shall ensure that the person in charge of the parade will at all times carry such permit on his or her person during the conduct of the parade. 14 "14.24.070 REVOCATION OF PERMITS. The Chief of Police may revoke a parade permit issued pursuant to this chapter if the Chief of Police finds that any term, condition, restriction or limitation of such permit has been violated, or if the Chief of Police finds that as a result of changed circumstances any one or more of the standards specified in this chapter has not been satisfied. Notice of such action revoking a permit shall be delivered in writing to the permittee by personal service or by certified mail. Appeal from any such revocation may be taken within the same time and manner as specified in Section 14.24.050 of this chapter. " 14.24.080 INTERFERENCE. No person shall knowingly join or participate in any parade conducted under permit from the Chief of Police in violation of any terms of said permit, nor knowingly join or participate in any permitted parade without the consent and over the objection of the permittee, nor in any manner interfere with its progress or orderly conduct. "14.24.090 JUDICIAL RELIEF. The provisions of Section 1094.8 of the California Code of Civil Procedure shall govern any application for administrative mandamus based upon a final decision rendered under the provisions of this chapter." SECTION 18. That Section 14.28.020 of Chapter 14.28 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 19. That Section 14.28.030 of Chapter 14.28 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety SECTION 20. That Section 14.28.040 of Chapter 14.28 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: 14.28.040 ROLLER SKATING, SKATEBOARDING, TOY VEHICLES ON ROADWAY OR SIDEWALKS PROHIBITED. It shall be unlawful for any person to go upon any roadway or sidewalk while upon roller skates or upon a skateboard, or while riding in or upon any coaster, toy vehicle or similar device. Anv violation of this section shall be punishable as an infraction." 15 SF,CTION ? t That Section 14.32.050 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.050 BUS LOADING ZONES TO BE ESTABLISHED. The Traffic and Transportation Manager, with the approval of the Chief of Police or his or her designee, is hereby authorized to establish bus loading zones for the loading and unloading of buses of common carriers of passengers and to determine the location thereof, subject to the limitations and directives as set forth herein: .010 The word "bus" as used in this section shall mean any motor vehicle, other than a motor truck or truck tractor, designed for carrying more than ten persons including the driver and used or maintained for the transportation of passengers. .020 No bus zone shall exceed one hundred feet in length, except that when satisfactory evidence has been presented to the City Traffic and Transportation Manager showing the necessity thereof. The City Traffic and Transportation Manager may extend bus zones not to exceed a total length of one hundred thirty feet. .030 When it is necessary to remove parking meters in order to establish a bus zone, satisfactory evidence shall be presented to the City Traffic and Transportation Manager who may authorize the removal. .040 Bus zones shall be indicated by signs and/or red colored curbs with white or silver letters applied, indicated "No Standing — Bus Loading Zone" on the top of curbs in such zones. .050 No bus shall stand in any bus zone longer than necessary to load or unload passengers, except that at the terminus of any route a bus may stop and wait without loading or unloading passengers for a period not to exceed fifteen minutes. 060 No person shall stop, stand or park any vehicle except a bus in any bus zone." SECTION 22. That Section 14.32.1 10 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.332.110 THIRTY -MINUTE PARKING ZONES. "It is unlawful for any person to park, or leave standing, any vehicle for a period of longer Z. -- than thirty minutes on any street, or portion thereof, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion HR thereof, as a thirty -minute parking area. The Traffic and Transportation Manager shall erect or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." SECTION 23. That Section 14.32. 1220 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.120 TWENTY -MINUTE PARKING ZONES. It is unlawful for the operator of any vehicle to park, or leave standing, such vehicle for a period longer than twenty minutes between the hours of nine a.m. and six p.m. of any day except Sundays and holidays, on any street or any part of any street of the City of Anaheim which has been designated by ordinance or resolution of the City Council of the City of Anaheim as a twenty -minute parking area, which areas have been indicated by placing and maintaining green paint or other green material upon the curb surface within the area so designated. Such curb surfaces now have and there shall be maintained upon them the following words in white or aluminum colored letters: `PARKING LIMIT 20 MINUTES 9:00 A.M. TO 6:00 P.M."' SECTION 24. That Section 14.32.130 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.130 FIFTEEN -MINUTE PARKING ZONES. It is unlawful for the operator of any vehicle to park, or leave standing, such vehicle for a period longer than fifteen minutes between the hours of 9:00 a.m. and 10:00 p.m. of any day on any street. or any part of any street, of the City of Anaheim, which has been designated by ordinance or resolution of the City Council of the City of Anaheim as a fifteen -minute parking area, which area has been indicated by placing and maintaining green paint or other green material upon the curb surface within the area so designated, by the Superintendent of Streets. Such curb surfaces now have and there shall be maintained upon them the following words in white or aluminum colored letters: 'PARKING LIMIT 15 MINUTES 9:00 A.M. TO 10:00 P.M. EVERY DAY."' SECTION 25. That Section 14.32.135 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: IRA "14.32.135 FIFTEEN -MINUTE PARKING ZONES (SIX A.M. TO SIX P.M.). It is unlawful for any person to park, or leave parked, any vehicle for a period longer than fifteen minutes on any street, or portion thereof, between the hours of 6:00 a.m. and 6:00 p.m. of any day except Saturdays, Sundays, and holidays, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as a fifteen -minute parking area. The City Traffic and Transportation Manager is hereby authorized and directed to erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." SECTION 26. That Section 14.32. 140 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 27. That Section 14.32.150 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.150 ONE-HOUR PARKING —STREETS DESIGNATED —NINE A.M. TO SIX P.M., SUNDAYS EXCEPTED. It is unlawful for any person to park or leave parked any vehicle for a period longer than one hour on any street, or portion thereof, between the hours of nine a.m. and six p.m. of any day except Sunday, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as a one-hour parking area. The City Traffic and Transportation Manager shall erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." SECTION 28. That Section 14.32. 151 of Chapter 14-32 of Title 14 of the Anaheim Municipal Code be, and the salve is hereby, amended in its entirety to read as follows: "14.32.151 THREE-HOUR PARKING — STREETS DESIGNATED. It is unlawful for any person to park or leave parked any vehicle for a period longer than three hours on any City street, or portion thereof, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as a three-hour parking area. The City Traffic and Transportation Manager shall erect, or cause to be erected. signs along said streets or portions thereof so designated giving notice of such restriction." V SECTION 29. That Section 14.32.153 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.153 PARKING RESTRICTED — NINE P.M. TO SIX A.M. — STREETS DESIGNATED. It is unlawful between the hours of nine p.m. and six a.m. of the following day to park or leave parked any vehicle upon any City street, or portion thereof, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as so restricted.. The City Traffic and Transportation Manager is hereby authorized to designate any exemptions to such restriction, and shall erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." SECTION 31. That Section 14.32.154 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.154 PARKING RESTRICTED — SIX P.M. TO SIX A.M. — STREETS DESIGNATED. It is unlawful between the hours of six p.m. to six a.m. of any day to park or leave parked any vehicle on any City street, or portion thereof, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as so restricted.. The City Traffic and Transportation Manager shall erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." B SECTION 32. That Section 14.32.155 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.155 PARKING RESTRICTED — SEVEN A.M. That Section 14.32.160 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.160 PARKING RESTRICTED —THREE A.M. TO SIX A.M. It is unlawful between the hours of three a.m. and six a.m. of any day to park or leave parked any vehicles upon any City street, or portion thereof, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as so restricted. The City Traffic and Transportation Manager shall erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." SECTION 37. That Section 14.32. 185 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.32.185 NO PARKING ON SUNDAYS — SIX A.M. TO ONE -THIRTY P.M. — STREETS DESIGNATED. It is unlawful between the hours of six a.m. and one -thirty p.m. on Sundays, to park or leave parked any vehicle upon any City street, or portion thereof, which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as so restricted. The City Traffic and Transportation Manager shall erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction." 21 6-iij SECTION 38. That Section 14.32.189 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code be. and the same is hereby, amended in its entirety to read as follows: "14.32.189 NO STOPPING AT ANYTIME —TOW AWAY BUS ZONES OR STREETS DESIGNATED. .010 No person shall stop or leave standing any vehicle on any City street, or portion thereof. designated as a bus loading zone or a no stopping at any time area which has been so restricted by ordinance or resolution of the City Council and where signs have been erected designating such street, or portion thereof, as so restricted. The City Traffic and Transportation Manager shall erect, or cause to be erected, signs along said streets or portions thereof so designated giving notice of such restriction and designating that violators will be towed." .020 Buses shall be exempt from the provisions of this section. .030 All police officers of the City of Anaheim are authorized to remove or cause to be removed any vehicle which is parked or left standing in violation of this section. The owner and operator of the vehicle shall be liable for towing and storage charges. The person causing removal of such vehicle shall comply with Sections 22852 and 22853 of the California Vehicle Code." SECTION 39. That Section 14.48.050 of Chapter 14.48 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.48.050 THROUGH TRUCK ROUTES. Except as otherwise provided in this chapter, it shall be unlawful for any operator of a truck, as defined in Section 14.48.0101 to operate said truck on or along any street or route in the City of Anaheim other than hereinafter set forth: .010 Beach Boulevard from northerly City limits to southerly City limits. 35 .020 Imperial Highway from northerly City limits to Riverside Freeway. .030 Lincoln Avenue from westerly City limits to easterly City limits. .040 State College Boulevard from northerly City limits to southerly City limits. .050 Ball Road from westerly City limits to easterly City limits. .060 Euclid Street from northerly City limits to southerly City limits. .070 Katella Avenue from easterly City limits to westerly City limits. .080 Kraemer Boulevard from northerly City limits to Riverside Freeway. .090 Tustin Avenue from northerly City limits to Riverside Freeway. .100 Knott Avenue from northerly City limits to southerly City limits. 1 10 Harbor Boulevard from Katella Avenue to southerly City limits. 120 La Palma Avenue from westerly City limits to Euclid Street and from Imperial Highway to Kraemer Boulevard. 1 0 Brookhurst Street from northerly City limits to southerly City limits. .140 Orangethorpe Avenue from westerly City limits to easterly City limits. .150 Lakeview from northerly City limits to 91 Freeway. The provisions of this section shall not apply to any freeway or highway under the jurisdiction of the State of California Department of Transportation." SECTION 47. That Section 14.56.010 of Chapter 14.56 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: 36 "14.56.010 DECLARATION — INTERSECTIONS WHERE RIGHT TURN AGAINST RED OR "STOP" SIGNAL IS PROHIBITED. It shall be unlawful for any person operating any vehicle to make a right turn against a red or "stop" signal when a sign giving notice of such prohibition is posted as hereinafter specified." SECTION 48. That Section 14.56.020 of Chapter 14.56 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.56.020 AUTHORITY TO POST SIGNS. With respect to any intersection restricted pursuant to Section 14.56.010 above, the City Traffic and Transportation Manager is hereby authorized to place and maintain, or cause to be placed and maintained, appropriate signs at or near those corners where the City Traffic and Transportation Manager determines that the making of a right turn against a red or "stop" signal would seriously interfere with the safe and orderly flow of traffic." SECTION 49. That Section 14.56.040 of Chapter 14.56 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 50, That Section 14.56.050 of Chapter 14.56 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.56.050 DECLARATION — INTERSECTION WHERE LEFT TURN MAYBE PROHIBITED. It shall be unlawful for any person operating a vehicle to make a left turn at any location where such turns are prohibited by ordinance or resolution of the City Council and when a sign is posted giving notice that such turns are prohibited as hereinafter provided." SECTION 51. That Section 14.56.060 of Chapter 14.56 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "14.56.060 AUTHORITY TO POST SIGNS. The City Traffic and Transportation Manager is authorized to place and maintain, or cause to be placed and maintained, appropriate signs giving effect to Section 14.56.050 where the City Traffic 37 and Transportation Manager determines that the making of such turns would seriously interfere with the safe and orderly flow of traffic at the intersection." SECTION 52. That Section 14.56.080 of Chapter 14.56 of Title 14 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 53. That subsection .020 of Section 15.08.020 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: ".020 Divisional Lines. "Divisional lines," as used in this chapter and shown in the Address and Street Name Master Plan, shall mean those streets or other lines which establish the base line for premises numbering and the directional designation for streets in the City of Anaheim. The streets which serve as "divisional lines" include the following, and no others: North Anaheim Boulevard northwesterly to SR 91 (Riverside/Artesia Fwy.), North Lemon Street northerly of SR 91 (Riverside/Artesia Fwy.), South Anaheim Boulevard southeasterly to the Anaheim Boulevard overpass of the Santa Ana Freeway, South Haster Street, West Lincoln Avenue, East Lincoln Avenue northeasterly to East Center Street, and East Center Street northeasterly to State College Boulevard. Easterly of State College Boulevard to the intersection of the Newport Freeway and the Riverside Freeway. the north -south divisional line shall follow a meandering line as shown on the Address and Street Name Master Plan. Easterly of the intersection of the Newport Freeway and the Riverside Freeway the north -south divisional line shall be Santa Ana Canyon Road." SECTION 54. That subsection .090 of Section 15.08.020 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: ".090 Street. A "street" is a public or recorded private right-of-way which affords primary means of vehicular access to abutting property. Such a right-of-way may be designated as, but not limited in designation to, one of the following: avenue, circle, drive, lane, road, street or a derivative thereof. Furthermore, it shall be assumed that all streets shall be officially named and numbered." SECTION 55. That subsection .010 of Section 15.08.040 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: .010. Tentative Tracts and Parcel Maps. It shall be the duty of the Director of the Planning Department or his or her designated representative to approve street names for any streets proposed W in conjunction with tentative tract maps or parcel maps. The developer shall submit to the Planning Department a list of names for the streets proposed on said maps. The Director of the Planning Department or his or her designated representative will review such names and, if it is determined that said names satisfy the provisions of this chapter and do not conflict with the Address and Street Name Master Plan, approve the proposed street names. Furthermore, the Director of the Planning Department or his or her designated representative will determine whether the proposed streets shall be designated as, but not limited in designation to, one of the following: avenue, circle, drive, lane, road, street or a derivation thereof." SECTION 56. That subsection .020 of Section 15.08.040 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: ".020 Final Tract Maps. Every final tract map submitted to the City Council for its approval prior to recordation with the Orange County Recorder's Office shall show the official name of any and all streets as recommended by the Planning Department. If private streets are shown, the words "private drive" shall follow the named street and be recorded on any final tract map. Prior to submittal to the City Council, it shall be the duty of the City Engineer or his designated representative to determine whether said final tract map satisfies the provisions of this chapter." SECTION 57. That Section 15.08.050 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "15.08.0.50 ISSUANCE OF PREMISES NUMBERS. It shall be the duty of the Building Official or his or her designated representative to assign the respective numbers for premises in the manner prescribed in this chapter. No building permit shall be issued for any building or structure until the owner has obtained an official number." SECTION 58. That Section 15.08.060 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "15.08.060 AFFIXING PREMISES NUMBERS. It shall be the responsibility of the owner to affix the official premises numbers to his or her buildings or units. Numerals indicating the official premises number of each building or each front entrance shall be placed in accordance with City standards as determined by the Building Official." 39 SECTION 59. That Section 15.08.070 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "1.5.08.070 EXCEPTIONS. There exist at the present time, and will be established in the future, unique situations which permit street naming and premises numbering not in conformity with the provisions of this chapter. It will be the responsibility of the Building Official and the Director of the Planning Department or their designated representatives to review such unique situations in order to determine whether an exception to the provisions of this chapter can be made. In such cases, the following criteria of street naming and premises numbering shall be adhered to: .010 Residential Complexes. Residential complexes made up of either single or multiple -family residential structures wherein one or more of those structures do not front on a dedicated public street or an officially named private street may be assigned building numbers in accordance with the nearest and most appropriate street. The building numbers shall advance sequentially along the primary access right-of-way through the complex. The building numbers shall be consistently either odd or even as provided for in Section 15.08.030.040. .020 Curving and Meandering Streets. If a curving or meandering street runs predominantly in one direction, it may have one name and one sequence of premises numbers; however, a curving or meandering street that is intersected by one or more other streets or that changes direction forty-five degrees or more may be assigned another name, the appropriate directional designation, and the appropriate premises numbers in accordance with the provisions of this chapter. .030 Cul -de -Sacs. A cul-de-sac less than one hundred feet in length may have the same name and be numbered in the same numerical sequence as the street which it intersects. .040 Closed Loop Streets. Closed loop streets less than one thousand feet in length with only one point of intersection with another street may have the same name and numerical sequence throughout. Premises numbering shall be in sequence with even numbers on the outside and odd numbers on the inside; however, open-ended loop streets which intersect another street at more than one point shall not have the same name throughout." SECTION 60. That Section 15.08.080 of Chapter 15.08 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: . "15.08.080 ANNEXATIONS. Following the annexation of a parcel of land to the City of Anaheim, it shall be the duty of the Building Official or his or her designated representative to assign the appropriate premises numbers to all buildings and structures within said annexation. The Building Official shall notify owners of all such buildings or structures of said change." SECTION 61. That Chapter 15.12 of Title 15 of the Anaheim Municipal Code be, and the same is hereby, repealed in its entirety. SECTION 62. SEVERABILITY The City Council of the City of Anaheim declares that should any section, paragraph, sentence or word of this ordinance hereby adopted be declared for any reason to be invalid, it is the intent of the Council this it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 63. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal or amendment of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date thereof, nor be construed as a waiver of any tax, license or penalty or of the penal provisions applicable to any violations thereof. The provisions of the ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 64. PENALTY. Except as may otherwise be expressly provided, any person who violates any provision of this ordinance is guilty of a misdemeanor and shall, upon conviction thereof, be punished in the manner provided in Section 1.01.370 of the Anaheim Municipal Code.
