63-1025 RESOLUTION NO. 63R-I025 A RESOLUTION OF 1HE CITY mUNCIL OF TI-IE CITY OF ANAHEIM RE-ESTABLISHING VARIANCE NO. 1339. WHEREAS, the City Council did heretofore, on April 4, 1961, adopt Resolution No. 6790 granting Variance No. 1339 to William and Genowefa Hurley, 1703 Crone Avenue, Anaheim, California, permitting the garage located on the following described property situated in the City of Anaheim, County of Orange, state of Cali- fornia, to wit: Lot 221 of Tract 2377, as per map recorded in Book 75, Pages 29 to 35, both inclusive, of Miscellaneous Maps In the Office of the County Recorder of Orange County, California. to be used for a T.V. and radio repair shop, and permitting the attachment of a 3 by 8-foot sign to the Enclid Street side of said garage, subject to certain conditions set forth in said resolution; and follows: WHEREAS, Condition No.3 of said resolution reads as "3. That said variance is granted for a period of two (2) years from date hereof and shall be subject to review by the City Council at the end of said two-year per- iod." AND w~EREAS, the two-~ar period for which said variance wa s gran ted hav! ng expir ed, the City Ceunci 1 did fIx tJE 17th day of December, 1963 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing to review and consider all evidence and reports relative to the re- establishment of said variance, and notices of such public hear- ing were duly given as required by law and the provisions of Title 18, Chapter 18.16, of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, the City Council does find that: 1. There are exceptional or extraordinary circumstances or cond i tions appl icable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the re-establishment of said variance will not be materially detrimental to the public welfare nor injurious to the property or improvements in such vicinity and zone in which the property is located. 4. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Variance No. 1339 be, and the same is hereby re-established permitting the continued use of the garage situated on the property hereinbefore described for a T.V. and radio repair shop, and permitting the existing sign to be turned 900 so tha t it can be viewed from both Crone Avenue and Eucl id Street, subject to the following conditions: 1. That the existing driveway be widened to permit the parking of two cars only and that a line be painted on said driveway indicating the ~pace for the parking of sa! d cars. 2. That landscaping be installed and maintained on that portion of the cemented front yard not devoted to driveway purposes. The City Council hereby reserves tha right to revoka such variance permit for good,-cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim fvfunicipal Code and reg.t lations and the conditions herein. Said re-established variance is granted for the term prescribed by the Anahe'im Municipal Code unless otherwise specified herein.
