2004-144RESOLUTION NO. 2004 -144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A REVISED SCHEDULE OF PARKING VIOLATION PENALTIES WHEREAS, fees and charges to be collected within the City of Anaheim may be adopted by resolution of the City Council; and WHEREAS, the purpose of the Street Sweeping Parking Citation Program is to improve the cleanliness of public streets and increase the efficiency of sweeping operations; and WHEREAS, the City of Anaheim restricts parking on street sweeping days by using signs to publicize "no parking" hours; and WHEREAS, thc City Council is authorized to establish the parking violation penalty schedule as described in Section 40203 and 40203.5 of the State of California Motor Vehicle Code; and WHEREAS, the City Council is encouraged by the Vehicle Code to standardize parking violation penalties charged within the County of Orange; and WHEREAS, parking violation penalties are collected and enforced as civil penalties which are equal to or lower than such penalties in other cities in Orange County. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the following civil penalties for parking violations be adopted commencing July !, 2004: 1. PARKINO PENALTY SCHEDULE (a) (b) (c) A notice of parking violation shall be affixed to each vehicle parked upon a public street or alley in violation of the restrictions upon parking thereon. A civil penalty in the amount of $29.00 is hereby imposed for each notice of parking violation issued for such violation. The written "Notice of Parking Violation" shall list the address of the person or agency authorized to receive payment of the parking penalty and shall include a statement, in bold print, that payments of the parking penalty for the parking violation may be sent through the mail together with instructions on obtaining information on the procedures to contest the "Notice of Parking Violation". The registered owner of the vehicle receiving the "Notice of Parking Violation" shall have 21 calendar days from the issuance of a notice or 14 2004. calendar days from the mailing of a notice of delinquent parking violation to request an initial review of the notice at no additional charge for the review. If no response to the notice of parking violation is received by the City of Anaheim within 35 calendar days from the date of the "Notice of Parking Violation," the sum of $28 for late payment shall be added to the penalty due and owing. BE IT FURTHER RESOLVED that this resolution shall be effective on July 1.
