2004-167RESOLUTION NO. 2004-167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A SCHEDULE OF FINES AND INTEREST CHARGES PURSUANT TO CHAPTER 1.20 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE WHEREAS, Chapter 1.20 of Title 1 of the Anaheim Municipal Code establishes an administrative procedure for the issuance of civil citations and imposition of civil fines for certain violations of the Anaheim Municipal Code as an alternative to the issuance of criminal complaints and imposition of criminal fines through the judicial process; and WHEREAS, Section 1.20.070 of Chapter 1.20 of Title 1 of the Anaheim Municipal Code provides that the amount of the civil fines imposed pursuant to said Chapter 1.20 shall be in accordance with a schedule of fines adopted by resolution of the City Council; and WHEREAS, subsection .020 of said Section 1.20.070 provides that the schedule of fines may also specify the amount of any interest and/or late payment penalty owed for any fine not paid within thirty days following the due date thereof; and WHEREAS, the City Council desires, by this resolution, to adopt and establish the schedule of fines for citations issued pursuant to Chapter 1.20 of Title 1 of the Anaheim Municipal Code and to adopt and specify the rate of interest which shall be imposed on any such civil fines not paid within thirty days following the due date thereof. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The following schedule of civil fines is hereby adopted pursuant to the provisions of Section 1.20.070 of Chapter 1.20 of Title 1 of the Anaheim Municipal Code (the "Code"): First offense Second offense with twelve month period Subsequent offenses with twelve month period $100 $200 $500 2. Any civil fine, or portion thereof, imposed pursuant to said Chapter 1.20 and in such amount as set forth in this resolution, which remains unpaid for more than thirty days following the later of: (i) the due date as specified in subsection .030 of Section 1.20.070 of the Code, or (ii) with regard to any civil fine the advance deposit of which has been waived pursuant to Section 1.20.090 of the Code, the date of issuance of the administrative order as specified in Section 1.20.110 of the Code, or (iii) with regard to any civil fine the advance deposit of which has been waived pursuant to Section 1.20.090, the date of any final judicial decision as specified in Section 1.20.120 of the Code, shall bear interest thereon at the rate of one and one-half percent (11/2%) per month from such date until the date paid in full.
