A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM WAIVING THE
STATUTORY NOTICE BY THE STATE OF
CALIFORNIA OF ITS INTENT TO RELINQUISH
A PORTION OF CERTAIN STREETS AND
FORMER STREETS ADJACENT TO THE I-5 TO
THE CITY OF ANAHEIM
WHEREAS, the State of California ("State") possesses real property interests in
those portions of existing streets and former streets within the City of Anaheim known as
Manchester Court and "old" Manchester Avenue east of Loara Street; Loara Street north of
Lincoln Avenue; and "old" Lincoln Avenue east of the southerly terminus of Manchester Court
(hereinafter collectively referred to as "Frontage Roads and Streets", as depicted on the map
attached hereto and incorporated herein by this reference as Exhibit B; and
WHEREAS, the State wishes to relinquish its rights and interests in said Frontage
Roads and Streets to the City of Anaheim, under the provisions of Section 73 of the Streets and
Highways Code: and
WHEREAS, Section 73 of the Streets and Highways Code requires that the State
notify any city to whom the State intends to relinquish a highway of its intent to do so not less
than ninety (90) days before recordation of such relinquishment: and
WHEREAS, representatives of both the City of Anaheim and the State have
previously met regarding the relinquishment of the Frontage Roads and Streets, such that the
ninety day written notice of intent to relinquish established by Section 73 will prolong the
process of relinquishment without any benefit to the City or the State.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that the City of Anaheim hereby waives its right to receive ninety days prior notice by
the State of its intent to relinquish said Frontage Roads and Streets to the City of Anaheim
pursuant to Section 73 of the Streets and Highways Code.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 3rd day of August ,2004, by the following roll-call vote:
