PRESENTATION: Councilman Krein presented Mayor Pebley with a gavel for use
during his term as Mayor.
Mayor Pebley extended his thanks, and presented Councilman Krein
with the gavel which he had used during the past two years.
Mayor Pebley called the meeting to order.
RESOLUTION OF COMMENDATION~ Resolution of Commendation was unanimously adopted
by the City Council recognizing Dr. Albert Schweitzer School for being
awarded the George Washington Honor Medal for the third time by the Freedoms
Foundation at Valley Forge.
PROCLAMATIONS: The following proclamations were issued by Mayor Pebley, and
unanimously ratified by the City Council:
"Telephone Pioneer Week" May 7 to 13.
"Hire a Veteran Week" - May 7 to 13.
"Anaheim Bicycle Safety Week" - May 8 to 13.
"Support Our Servicemen Week" - May 29 June 4.
INTRODUCTION: Mrs. Mary Freck, Local President of the American Field Service,
briefly explained the exchange student program of international scholarships,
and introduced Miss Bettina Von Kleist, from Dortmund, Germany, who currently
attends Loara High School.

Mayor iPebley extended thanks to Miss Von Kleist and the Mayor of

the Mayor of Dortmund.
WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Krein moved to
waive the reading in full of all ordinances and resolutions, and that
consent to the waiver of reading is hereby given by all Councilmen
unless after reading cf the title, specific request is made by a
Councilman for the reading of such ordinance or resolution. Councilman

REPORT FINANCIAL DEMANDS AGAINST THE CITY; Demands against the City in the
amount of $1,233,133~51, in accordance with the 1966-67 Budget, were

PUBLIC HEARING - VARIANCE NO0 1856; Submitted by Villa Fontaine Enterprises,
Inc., requesting waiver of maximum permitted sign area on C-1 zoned property
briefly described as located at 2856 West Lincoln Avenue.
The City Planning Commission pursuant to Resolution No. PC67-53
granted s~id variance, allowing a sign limited to 20 square feet only,
subject to the following condition;
That s~bject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim, marked
Exhibit No, 1, provided, however, that the proposed sign shall conform
with the requirements of the R-3, Multiple Family Residential, Zone
as to size and further provided, that the sign shall not be placed
in the curb to curb roadway.

Zoning Supervisor Ronald Thompson noted the location of subject
property, advising that a 60 foot private access road extends southerly
from Lincoln Avenue approximately 160 feet to serve the apartment development
at the rear of two C-1 zoned parcels, located on both sides of said roadway.
That an existing illegal sign was approved for the property for a six month
period in 1963, subject to the posting of a bond to insure removal of the
sign, which condition was never met.
Findings of the Planning Commission in granting the requested
sign for a 20 square foot area only were noted by Mr. Thompson, and he
advised that the requested sign was proposed to be located in the center
of the access drive, and it was a requirement of the Commission that the
sign be placed outside the actual roadway. He further noted evidence
submitted to and considered by the City Planning Commission.
Mayor Pebley asked if the petitioner wished to address the City
Council~
Mr. Pierce, 1736 Antigua Way, Newport Beach, co-owner of the
apartment development, advised that the requested sign is necessary
as rapid traffic on Lincoln Avenue cannot see their apartment units 200 feet
to the rear. He noted that there would be large commercial signs on the two
adjacent parcels in the future, however the requested sign would not affect
any other residential property in the area. He was of the opinion that the
situation was an unusoal one, and a 20 square foot sign would go unnoticed
adjacent to commercial signs.
In answer to Council questioning, Mr. Pierce advised that they
own the 60 foot access road, however private easements have been
granted to the owners of the commercial parcels.

The Mayor asked if anyone desired to offer opposition to the
requested sign.
Mrs, Mary Androus, 10~3 Fairway Drive, Orange, one of the owners
of the commercial parcels adjacent to the property, submitted and read letter
dated April 25, 1967, setting forth objections to subject variance, being of
the opinion that no hardship exists, and to approve the sign would establish
a precedent for ~:ther apartment complexes throughout the city.
The Mayor asked if anyone else had opposition to offer.
Mr~ Harold F. andrcus, 10~3 Fairway Drive, Orange, advised that
at the time they purchased the C-1 parcels of property, it was their under-
standing that the private access road between the two parcels, in effect,
converted them tc corner properties, and that the large sign would be removed
when the apartment complex was ?0 percent occupied, or nc>t more than one year
after construction was completed, after which no sign would be necessary.
When the petitioners were; reqi~ested te remove the sign in August of 1966,
said sign was relocated to the present site, within the 60 foot right-of-way.
He requested that the variance be denied~
Mayor Peblev asked if an'ycne had opposition te offer, there being
no response, asked if the petitioners desired to address the Council in
rebuttal,
Mr~ Pierce advised that they were willing to locate the new sign
on any appropriate p~rti;>n of their property designated by the City. He
noted that no hardship exists .at the present time, as the vacancy factor is
low, which he attributed to the fact that they have a large sign on the
property, and new constr~cti,;;n ;;~f large multiple family residential complexes
has been. insignificant dt~ring past months, however this situation will soon
be changed.
Regarding the failure to pcs, t the required bond for the existing
sign, Mr~ Pierce advised that it was an an oversight o~ thc£r part, and he
advised that the existing sign would be rem~-~ved

Mr, Geisler advised that the situation was peculiar, as the ownership
is split, the C-1 property being divided by the private roadway, and under
the Sign Ordinance the commercial property owners have the ~ight to install
a sign on each side of the private street, That this access road is in effect
a part cf the R-~ property to the. rear, although it is zoned C-l, and therefore
is entitled to an identific~.tion sign,
Discussion was held by the City Co~ncil and the City Attorney
relative te individual rights cf the petitioners for the identification
sign and rights of the commercial property owners, at the conclusion thereof,
Councilman Chandler m~ved that Council determination on Variance No. 1856 be
continued one week (May 2, 1967) to allow the i~dividual owners an opportunity
to resolve their differences, and to allc,w petitioners an opportunity to
remove the existing illegal sign, £cuncilman Krein seconded the motion.

and further requesting waivers of maximum building height within 150 feet

granted Variance No, 186~ in part, denying the request for waivers of front

Council and recorded in the office of the Orange County Recorder.
2. That this Variance is gr~nted subject to the completion of Reclassifica-
tion Nc. 66-67-56.
3. That subject property shall be developed substantially in accordance with

Mr. Thomps~:n no::~d the location of subject property and the

to and considered by the City Planning Commission. He called attention to
findings of the Planning Commission precedent to the action taken on subject
applications,
Mr. James Schuler, representing the petitioner, submitted a
lot study contrasting a four unit multiple family residential structure
having the required 15 foot front yard setback with the same building
using a front setback of 9 feet, and advised that the primary reason for
requesting 9 and 12 foot front setbacks was to provide a greater court
yard area for the residents. He noted that if said waiver of front yard

setback requirements were granted, three units out of every four would be first
floor units having patio areas, but fifteen foot front setbacks would allow
only two patio apartments. He was of the opinion that the lesser setback
wculd provide ample room for attractive front landscaping and green area.

TENTAtiVE MAP TRACT NOo 6373__i Developer, Covington Brothers Construction
Company; property located on the north side of Orangewood Avenue, east of
Haster Street (prcperty described in Reclassification No~ 66-67-56), and
contains 5 acres proposed for subdivision into 16 R-3 zoned lots.
The City Planning Commission at their meeting held March 27, 1967,
approved said tentative map, subject to the following conditions:
1. That should this subdivision be developed as more than one subdivision,
each subdivision thereof shall be submitted in tentative form for approval°
2. That the approval of Tentative Map of Tract No. 6373 is granted subject
to the approval of Reclassification No. 66~67-56 and Variance No. 1864.
3. ~at the vehicular access rights to Orangewood Avenue shall be dedicated
to the City of Anaheim.
4~ That a modified cul-de-sac be provided at the terminus of Pearson
Avenue subject to the approval of the City Engineer~
That the alleys shall be returned to '~" Street between Lot Nos. 1-2

Councilman Krein moved that Tentative Map, Tract No. 6373 be approved

PROPOSED AMENDMENT - R-2 5~000 LOT COVERAGE STANDARDS: The City Planning
Commission, pursuant to Resolution No. PC67-59, recommended an amendment
to the Anaheim Municipal Code, Title 18, Zoning, Chapter 18.26 R-2 5,000
One Family Zone, Section 18.26.050(3) Site Development Standards, Coverage,
in accordance with Exhibit "A", attached to said resolution.
Associate Planner Charles Roberts reported that the proposed
amendment would reduce lot coverage in the R-2 5,000 zone from 45 percent
to 40 percent~ He briefed the background of the proposal, and noted
findings of the City Planning Commission, calling attention to the finding
that the approval of subject amendment would bring the minimum open area
on these lets into direct proportion with the open area provided for R-1
lots, while permitting co~zerage o£ 2,000 square feet of a 5,000 square
foot lot.
Mayor Pebley asked if anyone wished to address the City Council
pertaining to the proposed amendment, there being no response, declared
the hearing closed.
In answer to Council questioning, Mr. Orsborn reported that it
was felt lot coverages in the R-2 5,000 Zone should have a proportionate
ratio to that in the R-1 single family residential zone (7200 square foot
lots), and in actual practice, it was found that existing code provisions
for setbacks in the R-2 5,000 Zone are net sufficient to prevent excessive
lot coverage~ That most of the homes constructed in this zone are two
story, which allows ample latitude for floor area so that lot coverage can
be in proportion~ He further advised that 40 percent lot coverage was
average for existing two story homes in the R-2 5,000 Zone.

SECTION 18.26.O50, PARAGRAPH(3), OF THE ANAHEIM MUNICIPAL CODE. (R-2 -
5000 - Site Development Standards)
SIGN RE~UEST~ Application for sign permit to allow sign on the west side of
Manchester Avenue north of Freedman Way, submitted by J. W. McMichael,
was continued from the meeting of March 28, 1967 at the request of the
applicant.
Communication dated April 24, 1967, was submitted from the
petitioner requesting further continuance for approximately 45 days.
On motion by' Councilman Schutte, seconded by Councilman Krein,
said sign request was continued to June 13, 1967, 1:30 P.M. MOTION CARRIED~
PERMIT - DISNEYLAND FIREWORKS DISPLAY: Application for the 1967 Summer Season
fireworks display at Disneyland Park, commencing at 9:00 P.M. June 23
through September 30~ also at midnight New Year's Eve, December 31, was
submitted by Atlas Fireworks Company, together with explanatory letter
dated April 17, 1967 from Jack Bo Lindquist, Director of the Marketing
Division at Disneyland, and report from Assistant Fire Chief of the City
of Anaheim, James J0 Heying~
On motion by Councilman Dutton, seconded by' Councilman Krein,
said application for fireworks display at Disneyland Park was granted as
requested. MOTION CARRIED.
RECLASSIFICATION NO. 66-67-52 ~VA. RIANCE NO~ 1858): The City Council, at their
meeting held March 28, 1967, adopted Resolution of Intent No. 67R-176,
approving R-3 zoning on property located on the east side of Palm Lane,
south of Ball Road, said approval being subject to certain conditions.
Request of Russel A. Betker, of Betker Construction Corporation,
dated April 21, 1967, was submitted for amendment to Conditions Nos. 4 and
7 of said resolution to allow recordation, of required parcel map prior to
final building inspection and to eliminate said Condition No. 4 from

Condition No. 7 which establishes a 180 day time limit for certain conditions.
Also submitted and reviewed by the City Council were reports from

RESOLUTION NO. 67R-234: Councilman Dutton offered Resolution No. 67R-234
for adoption, amending Conditions Nos. 4 and 7 of Resolution No. 67R-176,
to read as follows~

shall be submitted to the City of Anaheim for approval, and then

ALCOHOLIC BEVERAGE LICENSE APPLICATION: Application submitted by Jerome A. and

was presented by the City Manager to the City Council for their information.
No Council action was taken on said application.
NORTHEAST SUBSTATION PROJECT -. CONSULTING ENGINEER: Mr. Murdoch reported on
negotiations for a proposed contract to provide consulting engineering
services for the design of the Northeast Substation Project, and asked for
an expression by the City Council relative to the suggestion that negotiations
for a formal quotation be carried out with the firm recommended by the Staff
Committee, with the proposed contract to be brought before the City Council
for necessary action.
The City Council indicated approval of the method suggested to
select a consulting engineering firm.

REQUEST - WOMEN'S DIVISION OF THE ANAHEIM CHAMBER OF COMMERCE: The City Manager
reported on request received from the Women's Division of the Anaheim Chamber
of Commerce, that the City of Anaheim contribute $50.00 to defray the cost
of installing a banner across a city street advertising their "Cultural
Month"
Councilman Chandler stated that if an expenditure of funds were
made, it would be the first instance that the City Council had done so, to his
knowledge. He recognized the fine work done by the organization, but was of
the opinion that to grant subject request would open the door to other
requests from the many charitable organizations within the city.
The City Council took no action on the foregoing issue.

CONTINUED PUBLIC HEARING ~- RECLASSIFICATION NO. 66-67-50: Submitted by Henry
Lestmann requesting change of zone from C-l, General Commercial, to delete
deed restrictions and allow the full range of C-1 uses~ property briefly
described as located at the southwest corner of Orange and Magnolia Avenues.
The City Planning Commission pursuant to Resolution No. PC67-38
recommended denial of said reclassification.

Mr. Thompson reviewed the location of subject property, the
findings and action taken by the City Planning Commission and the evidence
presented to the City Council. He advised that a concept plot plan indicating
how commercial facilities might be developed on the property under C-1
development standards, had been submitted by the petitioner. (Said plan was
posted on the east wall of the Council Chamber)
Mayor Pebley asked if the applicant or his representative wished
to address the City Council.
Mr. Harry Knisely, Attorney representing the petitioner, submitted
copies of said plot plan for Council review, and advised that the plan had
been prepared in an effort to give maximum protection to the neighbors. He
noted that at the present time, there are no tenants for the proposed
development.
Mr. Knisely further advised that the petitioner is willing to
stipulate that there will be no sale of alcoholic beverages on the property,
and will agree to deed restrictions or any appropriate method to insure the
stipulation. He was of the opinion that the layout shown on the plot plan
is compatible to the area and provides a comparatively low density of
commercial development.
The Mayor asked if anyone wished to offer opposition to the
proposed reclassification.
Mr. Dick Shimeall, 2767 West Broadway, addressed the Council as
a member of the church across the street from subject property, and a member
of the Magnolia School District, being of the opinion that if a service
station at the corner expected to stay in business, traffic would have to
increase in the area, causing a hazard to the approximately 450 school
children crossing at this intersection.
Gloria Ditch, 505 Anthony Drive, member of St. Paul's Presbyterian
Church located at the southeast corner of the intersection, submitted and
read statement of the Session of said church, wherein unanimous vote was
recorded, opposing the requested change of zone on the basis of possible
distraction to worship services. She advised that there are two other
churches in the immediate area.
Reverend Roy Lash, one of the Ministers of the Presbyterian
Church, advised that their ten year old church community reaches into other
areas such as Garden Grove, La Palma, Cypress, Stanton and Buena Park, and
he noted the substantial investment which they have in their property,
advising that the corner portion has been reserved for a new sanctuary,
directly across the street from the proposed service station. He failed to
see any evidence of a practical need for a service station at this location,
and thereupon requested that the existing deed restrictions limiting the use
of subject property to business and professional offices and related uses
be retained.
The Mayor asked if anyone else wished to offer opposition, there
being no response, asked if the petitioner's representative wished to speak
in rebuttal.
Mr. Knisely recognized the sincerity of their objections, however
in his opinion the traffic necessary to support a service station already
exists; the expected commercial uses would be basically conducted during
daylight hours with the possible exception of the service station. He noted
that although the restricted C-1 zoning was approved by the City Council in
1961, no development has taken place, and in his opinion, property owners
have the right to develop their property to its highest and best use so long
as such development is controlled for the protection of other properties
in the area.
Mayor Pebley declared the hearing closed.

RESOLUTION NO. 67R-241: Council discussion was held, and Councilman Dutton was
of the opinion that the property had been commercial in nature for some time,
however had not developed; that possibly the limitations thereon were too
restrictive. He thereupon offered Resolution No. 67R-241 for adoption,
authorizing preparation of necessary ordinance changing the zone to C-l,
unrestricted, subject to the following conditions:
1. That street improvement plans shall be prepared and all engineering re-
quirements of the City of Anaheim along Magnolia and Orange Avenues, such
as curbs and gutters, sidewalks, street grading and paving, drainage
facilities, or other appurtenant work shall be completed as required by
the City Engineer and in accordance with standard plans and specifications
on file in the office of the City Engineer; or that a bond in an amount
and form satisfactory to the City of Anaheim shall be posted with the City
to guarantee the installation of said engineering requirements.
2. That the owner(s) of subject property shall pay to the City of Anaheim the
sum of 15¢ per front foot along Magnolia and Orange Avenues, for tree
planting purposes.
3. That any air-conditioning facilities proposed shall be properly shielded
from view, prior to final building inspection.
4. That Condition Nos. 1 and 2, above mentioned, shall be complied with
within a period of 180 days from the date hereof, or such further time
as the City Council may grant.
5. That there shall be no sale of alcoholic beverages conducted on subject
property.

Prior to stating his vote, Councilman Schutte advised he did not
feel the approval of subject reclassification would in any way be harmful to
the churches in the area.

CONDITIONAL USE PERMIT NO. 927: The City Clerk reported that public hearing on
Conditional Use Permit No. 927 (Tierro de Oro, applicant for permission to
establish sand and gravel excavation and removal operation) was continued
from the meeting of April 18, 1967 to May 2, 1967. That request has been
received from the applicants for further continuance to May 16, and while
the continued public hearing will be scheduled on May 2 City Council Agenda,
it was felt that the interested parties should be notified that the Council
will be asked to consider an additional continuance.
On motion by Councilman Krein, seconded by Councilman Dutton, the
City Clerk was instructed to give notice that the City Council will probably
take action on May 2, 1967 to continue said public hearing to May 16, as

VARIANCE NO. 1865: Submitted by Samuel Magid requesting waivers of maximum
number of free standing signs and minimum distance between free standing
signs; C-1 zoned property located at the northwest corner of Ball Road and
Euclid Streets.

.granted said variance, subject to conditions.

At the City Council meeting held April 18, 1967, review of action
taken by the City Planning Commission was requested by Councilman Dutton,
and the City Clerk instructed to schedule public hearing before the City
Council.
Councilman Dutton reported that he had subsequently examined the
property, and found that the approval of said variance would not be granting
a right to the applicants that had not been granted to other people in the
area, and in his opinion any further delay would cause an unnecessary hardship
to the petitioners. He thereupon requested permission to withdraw his
former request for review of subject application.
On motion by Councilman Chandler, seconded by Councilman Dutton,
request for public hearing before the City Council on Variance No. 1865 was
waived. MOTION UNANIMOUSLY CARRIED.
