ZONING SUPERVISOR~ Ronald Thompson~ PERSONNEL DIRECTOR~ Roy Heissner~ Mayor Pebley called the meeting to order~ RECOMMENDATION - KINGSMEN DRUM & BUGLE CORPS: The City Clerk read recommendation from the Anaheim Chamber of Commerce that the Kingsmen Drum & Bugle Corps be officially recognized by the City of Anaheim as the Anaheim Kingsmen Drum & Bugle Corps, that they be presented with an official City of Anaheim flag, and be called opon to appear at appropriate city functions~ Discussion was held pertaining to liability insurance coverage held by the city, and at the conclusion thereof, action was deferred one week (June 6, 1967) for further investiga, tion~ MINUTES: Minutes of the Anaheim City Council meeting held May 9 and 16, 1967, were approved on motion by Councilman Krein, seconded by Councilman Dutton. MOTION CARRIED. WAIVER OF READING -. ORDINANCES .AND RESOLUTiONS~ Councilman Krein moved to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading is hereby given by all Councilmen unless after reading of the title, specific request is made by a Councilman for the reading of such ordinance or resolution~ £ounciiman Schu~te secoaded the motion~ MOTION UNANIMOUSLY CARRIED~ REPORT - ~'INANCIAL DEMANDS AGAINST THE C!T'Y~ Demands against the city in the amount of $126,829.29, in accordance with the 1966-67 Budget, were approved~ PUBLIC HEARING - HOUSEMOVING PERMIT: Application submitted by Donald J. Casmero requesting permission to move a dwelling from 722 Solway Street, Glendale, to 1405 East Romneya Drive, Anaheim, was reviewed by the City Council together with recommendations of the Building and Zoning Divisions that said request be approved subject to street dedication, and street and sidewalk improvements by the petitioner~ Attention was called to communication dated May 24~ 1967~ from Howard W~ and Sarah J. Doering, 1140 Liberty Lane~ expressing opposition to sabject housemoving permit. Zoning Supervisor Ronald Thompson reported that to move the dwelling unto subject property would require removal of the existing barn and a small structure~ He called attention to recommendations of the Zoning and Boilding Divisions, noting that the dedication and improvements could be required prior to final building inspection, or the City Council might require an agreement with the applicants for said improvements and dedication- The Mayor asked if the applicant wished to address the City Council. Mrs. Marlene Casmero, 140.5 East Romneya Drive, addressed the Council advising that the easement for dedication of property for the widening of Romneya Drive had been signed this week~ that the improvements would be installed~ Mayor Pebley asked if anyone wished to address the City Council in opposition, there being no response~ declared the hearing closed. Avenue on Parcel 10 and the westerly 22~50 feet of Parcel 9~ Further subject to the dedication by the owners of access rights to be drawn up by the private parties to run in favor of Lots 1 to 8 inclusive, as to access to the two dedicated driveways~ so that the lots on which the driveways are located will not have complete control and cannot shut off the access to all except themselves~" Mr~ Thompson reviewed the location of subject property and the existing uses and zoning in the immediate area, briefing findings and action taken by the City Planning Commission. He reported that the conditional use permit was terminated at the Planning Commission hearing at the request of the applicants; however they asked for Council consideration of the request for access to Underhill Avenue and State College Boulevard, and for signs to be in conformance with the C-1 Zone, to allow more flexibility for commercial development of the property° Mayor Pebley asked if the applicant had any additional evidence to offer; there was no response. PUBLIC HEARING - RECLASSIFICATION NO. 66-67-57: Submitted by Frank L. Taylor requesting change of zone from R-3 to C-1 to allow development of a con- venience market; property located at the southwest corner of Walnut Street and Cerrito$ Avenue. The City Planning Commission pursuant to Resolution No. PC67-82 recommended denial of said reclassification. Zoning Supervisor Ronald Thompson noted the location of subject property and the existing uses and zoning in the immediate area, calling attention to findings of the Commission in t~eir recommended denial of subject reclassification° Mayor Pebley asked if the applicant wished to address the City Council~ Mr. M, S~ Bernard, 615 West 8th Street, Santa Ana, Attorney representing the petitioner, advised that the petitioner purchased the property with an existing variance for a service station, which subsequently expired. Due to the location of the property, across the street from the hotel, parking lot and golf course, he was of the opinion that the market would be ~:~patib].e to the a?~,a, a~i would serve the R-3 zoned properties ~c ~i~e sou~h a.:.~.l west~ Mr. Bernard further advised of the fact that the property owner is an invalid, and due to circumstances beyond his control, the anticipated income from the property has never been realized because of the expiration of the variance prior to development. Robert G~ Seaman~ representing the Disneyland Hotel~ 1441 South West Street~ .amvised that in accordance with the master plan for the hotel property, there were existing and futu~e hotel rooms and suites which would over-iock the proposed development~ and the development of said property would have a bearing on the hotel, Tb~t he was strongly opposed to the pro~ posed development~ ~aing '~f the opinion that there was no sufficient need for a convenience market to warran~ ~he change~ a~d he thereupop requested that the R-3 zoning be retained~ Councilman Chandler pointed cut the area designated as commercial- recreation on the General Plan map~ bordering on. the east side of Walnut Street across from subject property~ and noted agricultural areas that cross Cerritos Avenue to the north~ He asked why a neighborhood market would be more objectionable than the service station which was previously approved for the property~ Mr~ Seaman advised it was his personal opinion that there was no principal need for a service station at that location today~ although there may be at some future time; that he did not believe a neighborhood market would be compatible at the location under discussion. Mr~ Gene Meuller, representing Magnum Trust~ Inc~, addressed the City Council advising that the 7-~Eleven Markets based their proposed development on a market study conducted in the area~ In rebuttal~ Mr~ Bernard called attention to the attractively built and well maintained markets of Magnum Trust~ Inc.~ and failed to see how the proposed market could be detrimental to the area~ Mayor Peb!ey declared t~e hearing cl~sed~ In answer to Council questioning~ Mr~ Murdoch advised that although there has been n.o definite proposal submitted~ the owner o~ properties to the north has indicated at various meetings that he is interested in a commercial-recreation type of development~ Mro Murdoch was of the opinion that there would be requests made for' expansion of the co~arciai~recreation area~ or for uses which would be cc~,patible therewith. RESOLUTION NO, 67R-296: Councilman Krein stated that he saw no b&sis for granting subject request at this time~ and there~pon offered Resolution Noo 67R-296 for adopt~on~ upholding action taken by the City Planning Commission denying subject reclassification. CITY PROPERTY INSURANCE PROGgAM: Reference was made to communication dated May 23, 1967, from Insurance Consultants Bayly, Martin & Fay, Inc~ recommending termination of the city's current property insurance policies, effective July 1, 1967, and new coverage placed, consolidating the Convention Center with the City's Basic Property Program° Also recommended was that competitive bids be secured from any interested agent or broker who is a resident of Anaheim. Due to a possible conflict of interest, Councilman Chandler abstained from the discussion and action on this issue. The City Manager called attention to the fact that the current method of insurance coverage is through an insurance association. At the invitation of Mayor Pebley, Mr. William J. Walker, representing the Anaheim Insurance Agents Association, advised that the Association is composed of a large majority of the active insurance agents in the city, and in his opinion~ the difference in the recommended competitive bidding and the current method of going through the Association is that there would be a number of bids from agents outside the Association, and possibly some agencies would withdraw from the organization in order to be eligible for bidding. In answer to Council questioning, Mr. Walker advised that all members of the Association make a cOnsiderable effort to obtain the lowest possibl'e', premium price for municipal insurance coverage. Discussion was held by the City Council, City Manager and City Attorney, and it was the consensus of the City Council that there was no basis for a change in the present policy of obtaining property insurance through the Anaheim Insurance Agents Association; thereupon it was moved by Councilman Krein~ seconded by Councilman Schutte, that the consolidation of the Convention Center with the City's Basic Property Insurance Program be approved, current policies to be terminated or negotiated by July 1, 1967. Grove, Anaheim, Westminster and Huntington Beach, for increased water rates, as set forth in Public Utilities Commission Decision No. 72496, Case Ne. 5841, dated May 23, 1967. Councilman Krein seconded the motion. MOTION CARRIED. PROPOSED BUDGET 1967-68: City Manager Keith A. Murdoch presented the proposed Budget for the year 1967-68, together with the following message: "To the City Council and Citizens of Anaheim: The program for next year's operation, as expressed in the proposed budget for 1967~68, is primarily an operating budget, although it does include some sizeable capital improvements which cannot logically be postponed. This budget does not carry out the initial phase of a tentative long range capital improvement program, It is doubtful that much of the long range program can be carried out on a pay-as-you-go basis. The capital improvements are too costly to include in any single year's expenditures, therefore, many should be financed ena long range basis consistent with the usable life of the improvements. Anaheim's capital improvement requirements have not had a good community appraisal since 1959, when a Citizen's Committee of approximately one hundred persons studied the community's needs in considerable detail. With such major items facing the city as additional fire stations; an alley reconstruction program; continued expansion and acquisition of electrical system; purchase and development of park sites; completion of telemetry for the utilities system; extension of water system, various maintenance buildings; addition to the police facility; construction of a city hall; continued street widening; continuation of storm drainage construction and sewerage; completion of development of existing parks, including additional swimming pools; library branch construction; build-up of bond inventory; installation of additional traffic signals and safety devices; construction of rifle, skeet and archery range; additional golf courses; participation in downtown redevelopment and other improvements, a determined effort should be made to provide those improvements deemed essential. It is suggested that the City Council consider the appointment of a new Capital Improvement Committee to critically review and analyze the needs of the community in light of the developments of the past few years and bring the 1959 Committee recommendations up to date. In the meantime, this year's budget of $33,573,392 can be met without increase in property tax rate for the 16th consecutive year. The adoption of a cigarette tax, however, will increase revenue by about $300,000. Examination of present water rates indicates that there should also be an upward adjustment of rates applicable to customers served outside of the city limits. No adjustments are contemplated for utility rates ~or An&heim residents~.~or customers inside the city limits. The budget shows an increase of $4,353,309 or 14.9%, although only $200,000 of this amount is expected from property taxes. Much of the increase in both revenue and expenditure is due to the opening of the Convention Center. It is expected that the Center will be able to operate in the black even in its first year. The Room Oc.c~panc/ Tax will probably reach $525,000~ Sales and promotional activities for Stadium and Convention Center evepts reflect increases in the Visitor and Convention Bureau contract and in the Fublic tnL)rmation Office budget as well as the direct costs shown in the Stadium and Convention Center budgets~ The Utilities Department budgets with an increase of $1,566,698 make up m~.~st <~f the remaining budgetary increase~ Purchases of additional wholesale electricity ~or distribution to an increasing number of customers at favorable rates increase the budget by $810,000~ Additional water quantities, a higher rate for water purchased from the Metropolitan Water District and an increase in the Orange County Water District "pump tax", all combine to increase the amount needed for water pumped and purchased by $220,250° Additional monies needed to complete the Walnut Canyon Reservoir partially offset by a reduction in the amount needed for water main extensions, bring the total increase in the Water Division budget to $413,226~ Initial construction of the Yorba Electric Substation in the northeast industrial area together with other additions to the electrical system and the aforementioned additional electricity purchased add up to an increase cf $1,153,472 in the Electrical Division budget° An increase in employee retirement system costs of at least $159,980 is caused primarily by a premium adjustment due to additional benefits authorized since the last actuarial study 4 years ago~ The Stadium budget shows an increase of $467,502 due mainly to the inclusion cf a full year's rental payment to the City of Anaheim (California) Stadium~ Inc~ The Police Department budget shows an increase of $187,181 which includes a small addition to the south side of the Police Building and some additional personnel. The Fire Department budget shows an increase of $174,844, reflecting a new station, some additional personnel, and the operation of an alarm system. Although the Park Department shows an increase of $111,209, reflecting additional personnel to maintain an increase in developed acr'eage and a continuation of the development program, nothing has been provided again this year for new park land acquisition. Other departments show lesser increases, but several show decreases, reflecting a reduced activity in building construction and related activities. Revenues from construction activities are down approximately $500,000 from last year, while much of the personnel normally'required for this activity has been shifted to catch up on maintenance~ Forecasts indicate an upswing in construction by late autumn. Engineering services are already feeling this Upsurge. The City Manager's office will be restructured to provide an adminis- ~' trative research team. No additional personnel will be required for this restructuring, The team will concentrate on systems analysis throughout the City's operation to increase efficiency and quality° It will also carry a continuing budget review responsibility~ Better enforcement of zoning laws is now available through a shift of personnel in Development Services, The public assembly regulations will be better enforced with the addition of one fire inspector and occasional detailing of other fire personnel to evening and night inspection duties. The Park and Recreation Department is concentrating on a rather new concept of recreation supervision. The spot light is on training of volunteers and maximum use of volunteer programs. Mayor Pebley declared the hearing closed. Discussion was held by the City Council~ and Councilman Dutton was of the opinion, that a business of the nature proposed was not satis- factory~ due to the close proximity of residential properties on two sides° RESOLUTIONS: Councilman Dutton offered Resolutions~ disapproving Reclassi- fication No. 66-67-58 and Conditional Use Permit No. 935° Councilman Chandler noted that the residential property to the north, and the commercial property to the south, was under one ownership, and that a great portion of the commercial development immediately abuts the Owner's residential development. He called atten- tion to the recent adoption of Chapter 18.37 to the Anaheim Municipal Code, establishing the C-R, Commercial-Recreation Zone, and advised that approval of subject reclassification would establish a resolution of intention to rezone to C-R, all properties in the area; that this action would not remove the M-1 zoning from properties where industrial uses exist, but would allow any owner of land in the area to comply with the conditions of the resolution of intent in order to obtain C-R Zoning, should they so desire. Councilman Chandler pointed out that the approval of subject petition would not alter the rights of any property owner, as reclassifica- tion is a two-phase procedure; no one would be required to complete the C-R zoning requirements, if C-R zoning was not desired. The Mayor asked if anyone wished to address the City Council. Mr. Richard Bruce, 9200 Kraemer Road, Whittier, Attorney repre- senting Ling Altec, Inc., located at 1515 Manchester Avenue, advised that he was present to obtain clarification of the proposed reclassification, which he felt had been given in the preceding reports and discussion; that their property is located in an M-1 Zone, and they were concerned that their operation not become a non-conforming use at some future time. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed.
