AN ORDINANCE OF THE CITY OE ANAHEIM AM]iNDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING° (66~67-64 (1) M-l) PUBLIC HEARING - RECLASSIFICATION NOo 66=67~65 AND VARIANCE NOo 1881: Submitted by Wilbur Wright, et al, requesting change of zone from R-2 to R-3, and permission to establish a ].56 unit apartment complex, with waivers of minimum distance between buildings, carport location and maximum dwelling unit distance from a dedicated street~ property located on the north side of La Palma Avenue, east of Sunkist Street. The City Plmnning Commission pursuant to Resolution No. PC67-11.1 recommended approval cf said reclassification, subject to the following conditions~ 10 That the owner c~f subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street, along La Palma Avenue, for street widening purposes. That street improvement plans shall, be prepared and all engineering requirements cf the City of Anaheim along La Palma Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer and i.n accordance with standard plans and specifications on file in the office of the City' Engineer, and that a bond in an' amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirementso That the owner of subject property shall pay to the City of Anaheim the sum of $2000 per front foot along La Palma Avenue for street lighting purposes~ 4o That the owner ~f subject property' shall pay to the City of Anaheim the sum of 15¢ per front foot along La Palma Avenue for tree planting purposes. On motion by Councilman Dutton, seconded by Councilman Schutte, said action continuing decision on General Plan Amendment No° 90 was reaffirmed° MOTION CARRIED° RECLASSIFICATION NO0 66-67-1 AND TENTATIVE MAP, TRACT NO. 4241 - EXTENSION OF TIME~ Request of C~ J. Queyrel of Anacal Engineering Co., dated June 5, 1967, was submitted for one year extension of time to Tentative Tract No~ 4241 (Reclassification No~ 66-67-1), for compliance with certain conditions~ On the recommendations of the Development Services Department and the City Engineer, one year extension of time from August 2, 1967, was granted to said reclassification and tentative tract, on motion by Councilman Chandler, seconded by Councilman Dutton~ MOTION CARRIED° RECLASSIFICATION NOo 66~-67~22 ~ EXTENSION OF TIME: Request of Henry Reichert, Developer, dated May 31, 1967, was submitted for 180 day extension of time to Reclassification 66~67~-22 for compliance with certain conditions, pursuant to Resolution No. 67R-40~ On the recommendation of the Development Services Department, Zoning Division, 180 day extension of time was granted, effective July 15, 1967, provided that the required dedication for widening of Lewis Street be accomplished within thirty days from this date, on motion by Councilman Schutte, seconded by Councilman Dutton~ MOTION CARRIED~ FINAL __MAP~ TRACT NOo 6294~ Developer, GoI.S~ Development Company of Santa Ana; He noted that negotiations previously authorized by the City Council were not to exceed $92,426~75, being the opinion of value submitted for the total 4~03 acres net. He further reported that the property owner had agreed to sell the property for $100,000o00, and thereupon, recommended that purchase of said property be authorized in that amount~ Councilman Chandler moved that purchase of the Griffith property, in the amount of $100,000o00, be authorized, as recommended~ Councilman Dutton seconded the motion~ MOTION CARRIED° CANCELLATION OF FAITHFUL PERFORMANCE BOND: On report and recommendation of the Finance Director, Councilman Chandler moved that Aetna Casualty Insurance Company Bond No~ 33F 5880BC, Faithful Performance Bond for Director of Public Works Thornton Es Piersall, in the amount of $1,000,000~00, in favor of the City of Anaheim (California) Stadium, Inc., be cancelled as of June 30, 1967o Further, that the recommendations of the Finance Director relative to revised limits on employee's faithful performance bond coverage be accepted, subject to an interpretation of Section 1~04~390 of the Anaheim Municipal Code by the City Attorney~ Councilman Dutton seconded the motion~ MOTION CARRIED~ BOILER AND MACHINERY INSURANCE ¥IRE AND LIABILITY~ Finance Director Douglas K. Ogden advised that the City's inspection insurance coverage for boilers and machinery expires July 1 e.f this year° He reported on proposals obtained by the Anaheim Insurance Agents Association, advising that the lowest quotation received was that cf Pacific Indemnity Insurance for a five year period, inspection services only, in the amount of $32,011o00~ The alternate proposal of Pacific Indemnity was for $10,000~00 deductible extended coverage, to include transformers and other electrical apparatus in addition to boilers, in the amount of $17,838~00 for a five year period~ Due to the amount of premium, compared to the risk involved, the Finance Director recommended cancellation of subject coverage° Councilman Chandler moved that subject insurance be discontinued, inspections in the futore to be made by the City staff~ Councilman Schutte seconded the motion° MOTION CARRIED° FIRE ~ EXTENDED COVERAGE AND EARTHQUAKE INSURANCE~ Mr° Ogden reported that quotations received by the Anaheim Insurance Agents Association for fire insurance and extended coverage on all City properties, and earthquake insurance for the Convention Center, were not complete° He recommended that the City Manager be authorized either to extend present policies for a thirty day period~ or te obtain necessary' coverage and report to the City Council thereafter~ It was moved by Councilman Schutte, seconded by Councilman Dutton, that the City Manager be authorized to secure insurance coverage for an additional thirt~ days, pending completion of quotations, with authority to obtain proper coverage, to be reported to the City Council for ratification at a later date.
