ITEMS OF PUBLIC INTEREST: Oath and Affirmation of Allegiance for the appointment of a New Planning Commissioner - David Romero Sheryll Schroeder, City Clerk, officially conducted the swearing-in of new Planning Commissioner David Romero. PUBLIC COMMENTS: NONE This is an opportunity for members of the public to speak on any item under the jurisdiction of the Anaheim City Planning Commission or public comments on agenda items with the exception of public hearing items. CONSENT CALENDAR: Item 1-A through 1-C on the Consent Calendar will be acted on by one roll ca(I vote. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Planning Commission, staff or the public request the item to be discussed and/or removed from the Consent Calendar for separate action. Commissioner Bristol offered a motion, seconded by Commissioner Eastman and MOTION CARRIED (Commissioners Boydstun and Vanderbilt absent), for approval of Consent Calendar Items (1-A through 1-C) as recommended by staff. UNANIMOUSLY APPROVED • 1. REPORTS AND RECOMMENDATIONS A. a) CEQA ENVIRONMENTAL IMPACT REPORT NO. 321 (PREV.-CERTIFIED) b) VARIANCE NO. 2000-04417 (TRACKING NO. VAR 2002-04518) - REQUEST FOR A RETROACTIVE EXTENSION OF TIME: The Regents Group, Attn: David A. Rose III, 420 McKinley Street, Suite 111-120, Corona, CA 92879, requests a retroactive extension of time to comply with conditions of approval for a previously-approved waiver of minimum required setback adjacent to the SR 57 (Orange) Freeway to construct a 2-story and 4-story office building. Commissioner Bristol offered a motion, seconded by Commissioner Eastman and MOTION CARRIED (Commissioners Boydstun and Vanderbilt absent), that the Anaheim City Planning Commission does hereby approve the request for a one (1) year retroactive extension of time (to expire February 26, 2003) based on the following: • (i) That the proposed use remains in conformance with the current zoning code and General Plan land use designation, and that there have been no code amendments that would cause the approval to be inconsistent with the zoning code. PC2002-119 SR8396KB.DOC Chairperson Bostwick introduced Item No. 2 as Conditional Use Permit No. 2002-04554, 1126 Norfh Euclid Street, a request to construct a 36-unit detached residential condominium subdivision with waivers. • Applicant's Testimony: Brian Johnson, 34352 Shore Lantern, Suite 135, Dana Point, CA, representing Pelican Homes, states he and staff differ in relation to the front wall adjacent to Euclid Street. During the Planning Commission 08-12-02 Page 6 AUGUST 12, 2002 PLANNING COMMISSION MINUTES • Meeting of July 29, 2002, a 3-foot high wall combined with 3-foot high Plexi glass was proposed and denied. Currently he proposes a 3-foot high wall combined with 3-foot high wrought iron. He feels it would not create a massive wall adjacent to Euclid Street but would create more security, and the wrought iron could be painted to match the exterior of the building. THE PUBLIC HEARING WAS CLOSED. Commissioner Eastman asked if he had any photos to illustrate how the fence would look. Mr. Johnson responded no, but the 3-foot wall would stay the same and 3-foot wrought iron measuring approximately 6 inches wide would be placed on top of it. Commissioner Eastman states she would want to know what the wall looked like before she could support it. She feels from a historical standpoint it would be a Mediterranean look. Mr. Johnson asked if a condition could be added to state that the 3-foot wall and 3-foot wrought iron combination would have to meet Planning Commission's approval. Greg McCafferty, Principal Planner, states anything above 3-feet, regardless of the combination, is a waiver from City code. Chairperson Bostwick states a condition could be added that the plans would have to come back for approval by the Planning Commission as a Reports & Recommendations item. Commissioner Koos states he is not comfortable with increasing the wall height above 3 feet because it creates a fortified look. He feels it adds to the streetscape and does not take away from the value and • safety of the homes or peoples desire to live there. Commissioner Bristol states he compared Broadway to Euclid Street and there is a big difference. Broadway has a hedge-type look to help break it up. He has seen projects on Brookhurst Street and Lincoln Avenue and it looks boxy and private. He is in favor of the 3-foot wall and 3-foot wrought iron combination. Commissioner Koos asked Commissioner Bristol if he would reiterate the Reports & Recommendations Item until he is comfortable with the design. Commissioner Bristol responded yes, because Commission is happy with the rest of the site and the wrought iron could be designed in the Spanish/Mediterranean style. Commissioner Eastman states she is against the fortified look but is swayed by the busyness of the commercial street and the fact that the houses that would front on Euclid Street would virtually not have a backyard. She feels 5 feet would make it only a couple feet of wrought iron rather than a 50/50 deal, so as not to have a block wall look. The fence would have a nice stucco appearance to match the exterior of the homes, giving it a courtyard look of the older Spanish, smoothed stucco look, seen 50-75 years ago. Commissioner Koos states it is the front elevation of the property, and regardless to whether or not the potential residents have places to recreate is less of a concern than the image of the corridor. Commissioner Bristol states if Commission is trying to generate mid-house block housing, the proposed wall would look better, especially fronting Euclid Street. Commissioner Koos states Commission could approve the variance in a year, after the project is built, if it appears it is not working out. • Chairperson Bostwick states he is torn by the fact that it is on a very busy street, and not having it look closed in with a 6-foot block wall. He prefers wrought iron 5 feet high, without a block wall, and shrubbery 08-12-02 Page 7 AUGUST 12, 2002 PLANNING COMMISSION MINUTES ~ in front of it, similar to what is on Broadway. He feels wrought iron alone gives it a look of an industrial property rather than a residential property. Commissioner Eastman states she is very pleased with the elevations of the project and the design of the units, and if the applicant could do a fence that would look appropriate, architecturally, she could see it looking as it is the biggest, attractive thing about the project. Commissioner Romero states 6 feet, regardless of the material, is too high and would give a closed in look. FOLLOWING IS A SUMMARY OF THE PLANNING COMMISSION ACTION. OPPOSITION: None ACTION: Approved CEQA Negative Declaration Granted Reclassification No. 2002-00075 (to reclassify this property from the RS-A-43,000 Zone to the RM-2400 Zone), subject to the conditions of approval as stated in the staff report dated August 12, 2002. Approved, in part, Waiver of Code Requirement, as follows: Approved waivers pertaining to (a) required improvements of private streets since the existing private street standards were not intended for attached condominium residential developments, but rather for detached dwelling units. The plans provide adequate • pedestrian access from the individual dwelling units to the public right-of-way (Euclid Street), and the Public Works Department will be revising the standards for private streets in the near future, and (f) minimum width of pedestrian accessways since the minimum width of pedestrian accessway was intended for higher density apartment units, with residents sharing the accessway in order to reach their dwelling units. The proposed design is intended for individual accessways for specific residents walking to a specific dwelling unit. (Vote: 5-0, Commissioners Boydstun and Vanderbilt absent) Denied waiver (b) pertaining to maximum fence height since the property is a large, rectangularly-shaped lot with opportunities to comply with the development standards for maximum fence height and such a fence would detract from the design of the project. (Vote: 3-2, Commissioners Bristol and Eastman voted no and Commissioners Boydstun and Vanderbilt absent) Denied waivers pertaining to (c) minimum dimensions of parking spaces, (d) minimum number and type of parking spaces, and (e) minimum building setback since the revised plans have deleted these waivers. PC2002-120 SR8386VN.DOC ~ Chairperson Bostwick introduced Item No. 4 as Conditional Use Permit No. 2002- 04551, 2721 Stonybrook Drive, a request to permit a telecommunications antenna and microwa ve dish on an existing electrical transmission tower and accessory ground-mounted equipment. Applicant's Testimony: Paul Novak, 132 N. Maryland Avenue, Glendale, CA, representing Sprint PCS, states he has no objections to the conditions as they have been rewritten. THE PUBLIC HEARING WAS CLOSED. During The Action: Greg McCafferty, Principal Planner, asked if there was any consideration regarding the issue of landscaping. Chairperson Bostwick asked if a condition could be crafted to state, "If the property ceases to be used as a nursery, the applicant would landscape so that the building and fencing would not be visible from the right-ofi-way". Greg Hastings, Zoning Division Manager, responded yes, it would normally have to be landscaped anyway with any other land use and if it could be used as nursery stock in a fashion where it is semi- permanent, staff could work with the applicant. Commissioner Eastman states it seems reasonable to add a condition that would require the applicant to landscape within the vicinity of the building. • Mr. McCafferty states staff feels there should be a minimum, 10-foot wide landscape strip, visible from Stonybrook Drive. 08-12-02 Page 12 AUGUST 12, 2002 PLANNING COMMISSION MINUTES ~ Commissioner Eastman wished to clarify if the nursery would be a separate business. Mr. McCafferty states because the nursery is already there, the applicant could pull some of the stock forward towards Stonybrook Drive as part of the landscape setback. Chairperson Bostwick asked the applicant to address the issue. Mr. Novak states concern with their ability to impact another co-tenant on the property. Edison owns the property and was able to get the nursery to deal with the unpermitted storage container issue. Sprint PCS is constructing a building quite a distance into the property, approximately 500 feet from Stonybrook Drive. He does not feel it changes visuaf impact upon Stonybrook Drive, and is concerned about having to go back to Edison and interface with another tenant to get something to occur that is far in the distance. Their leased area is approximately 19x19; a relatively small part of the property. He is concerned about the ability of his client, who is going to be in a hurry to get a building permit, etc., to get cooperation out of not just one but potentially two other parties; the nursery and Edison. Mr. Hastings states in the past, Commission has allowed up to a year to install landscaping, giving the applicant the ability to get whatever is needed to activate the antenna. Staff would like to see the property owner be responsible for landscaping the front 10 feet, regardless of which tenant they are working with. The intent is for aesthetics on the property. Commissioner Bristol concurs the building is a nursery and far into the distance. Chairperson Bostwick states he is not in favor of the nursery maintaining items on the property and would rather have it in the ground. He suggests the applicant could have 6 months to a year to get the landscaping installed. . OPPOSITION: None ACTION: Commissioner Bristol offered a motion, seconded by Commissioner Eastman and MOTION CARRIED (Commissioners Boydstun and Vanderbilt absent), that the Anaheim City Planning Commission does hereby concur with staff that the proposed project falls within the definition of Categorical Exemptions, Class 1(Existing Facilities), as defined in the California Environmental Quality Act (CEQA) Guidelines and is, therefore, categorically exempt from the requirement to prepare additional environmental documentation. His property, built in 1965, is quite low and is a slab. The present drainage drains out of a driveway onto Dale Avenue. The applicants are proposing to move the drain approximately 30 feet to the south, to the end of their property, and there is a height difference of over 7 inches. He feels it is necessary to construct the drainage in the driveway fairly low in order to have the rain drain onto Dale Avenue.
