(a) CEQA MITIGATED NEGA7IVE DECLARATION (PREVIOUSLY- APPROVED) (b) CONDITIONAL USE PERMIT NO. 2003-04800 (TRACKING NO. CUP2004-04827) Hossein Zandi, Caliber Motors, 5395 East La Palma Avenue, Anaheim, CA 92807, requests review of final elevation plans to construct a new automotive sales dealership. Property is located at the northeast terminus of Via Cortez and south of the SR-91 (Riverside Freeway) and north of Santa Ana Canyon Road (No Address - Caliber Motors). (This item was removed from the Consent Calendar for separate discussion.) Approved Approved (Vote: 6-0; Commissioner Bostwick absent) sr8687av.doc Greg McCafferty, Principal Planner, introduced Item No. 1-C, Conditional Use Permit No. 2003-04800. He stated since Planning Commission approval staff has been working with the applicant to come up with a design solution in order to address Commission's concerns at the public hearing. Staff recommends approval of the final elevation plans with the stipulation and corrections that have been noted earlier on the plans. Applicant's Statement: Joseph Marca, Project Architect, 750 N. Citracado Parkway, #19, Escondido, CA, stated he is present to answer any questions regarding the subject request. Commissioner Romero asked the applicant to summarize the changes made. Mr. Marca stated at the last Commission meeting they were asked to reduce the height of the building, by primarily eliminating the 10-foot high roof top equipment room that was in the original design in order to give the building a more compatible feel with the residential neighborhood. They were given the direction that there was a building in the Savi Ranch area that had some of the traits and elements that were felt generally by the Commission to be beneficial. Therefore, they visited the facility and the buiiding shows the use of punched windows and stone exterior finish, which gives a warmer color. It also has a section of the structure that has a store front window system at the lobbies. He stated using those keys of warmer natural stone elements and smaller window panes, especially in the direction of the residential property, are being used as a major key to produce the elevations they presented. Their greatest concern was the elevation facing the residential neighborhood to the south. They reduced substantially the window area with a high quality slate finish. He explained they also took the opportunity to lower the scale of the building as they studied different roof forms. In addition, they lowered the scale of the building as they took 10 feet of height out where the equipment room was removed, and further lowered the side facing the residential property and the freeway by an additional 6 feet. Therefore, instead of 32 feet along that side they are at 26 feet and the ridge of the existing homes in the area are approximately 22-24 feet high. He feels these efforts have brought the scale of the building down and provide a lot more warmth for the subject project than the previously presented project. Commissioner Flores asked where the equipment is going to be placed. Mr. Marca responded either a roof well would be constructed where no equipment would go above the roof line, or his preference would be to construct a subterranean equipment room, below the building. 01-26-04 Page 2 of 4 JANUARY 26, 2004 PLANNING COMMISSION SUPPLEMENTAL DETAILED MINUTES . Mr. McCafferty stated staff wants to ensure that the applicant is stipulating that the final plans and the plans submitted for building permits are consistent both with the simulations that the applicant is currently holding, as well as the plans that they submit to the Building Division. Mr. Marca apologized and explained that in the rush of trying to create a design and the arrangements in trying to get it approved by Mercedes Benz and his client, and preparing it for the Pianning Department through the holiday period; he stated the information in the right index box was not coordinated with the material shown on the elevation, but they will ensure that it is consistent throughout. Commissioner Flores stated the proposed project seems to be a lot nicer and more pleasing to the eye than the previously proposed project. Commissioner Romero stated the applicant has taken great efforts in being a good neighbor, and he is pleased with the proposed project. Commissioner O'Connell concurred and stated it does look a lot better and would be great for the community. Commissioner Eastman stated together she feels they have come up with a really nice project. Commissioner Buffa concurred with the Commission and stated she appreciates and commends the appiicant and the architect for having made a significant change to the project, in just 5 weeks. Chairperson Vanderbiit-Linares referred to the "display area" illumination and asked the applicant if there are any changes in the amount of lighting that occurs when the business is open compared to when it is closed. • Mr. Marca responded typically the lights are reduced to a more security level lighting after 11 p.m., but they intend to do as they are conditioned. Chairperson Vanderbilt-Linares asked staff for clarification regarding the lighting. Mr. McCafferty stated when Commission originally approved the project they required a combination of lighting, both lower and higher light standards, provided that the overall lighting effect would be similar to having 12-foot standards distributed throughout the display area; and he referred to the originai resolution and pointed out Condition No. 32 regarding the lighting. Chairperson Vanderbilt-Linares stated he doesn't feel the condition addresses the lighting after hours, and asked if there is a standard requirement pertaining to the degree of illumination for this type of situation when a product is on display. Mr. McCafferty stated there have been limited numbers of circumstances where an auto dealership is right up against a residential land use. He stated to the Commission that there is a mitigation measure that should take care of the issue. Selma Mann, Assistant City Attorney, stated the subject item has already been set for a public hearing by the City Council, and the Planning Commission's previous action is therefore void. This in effect would take a form of a recommendation to the City Council for consideration, when the City Council reviews the entire item at the public hearing on February 10, 2004. ACTION: Commissioner Eastman offered a motion, seconded by Commissioner Flores and MOTION CARRIED (Commissioner Bostwick absent), that the Anaheim City Planning Commission does hereby determine that the previously-approved Mitigated Negative Declaration is adequate to serve as the • required environmental documentation for the subject request. 01-26-04 Page 3 of 4 dANUARY 26, 2004 PLANNING COMMISSION SUPPLEMENTAL DETAILED MINUTES . Commissioner Eastman offered a motion, seconded by Commissioner Fiores and MOTION CARRIED (Commissioner Bostwick absent), that the Anaheim City Planning Commission does hereby approve Final Elevation Pian Nos. 1 through 4, for a previously-approved automotive sales dealership because the proposed finai plans comply with the conditions of approval for Conditional Use Permit No. 2003-04800 and the Commission's desire for a high quality building that incorporates rich materials and articulation while complementing the adjacent residential neighborhood.
