Property is approximately 6.37 acres, located at the northeast corner of Manassero Street and La Palma Avenue. Request to establish a church within an existing office building with waiver of minimum number of parking spaces. Continued from the January 12, 2004, Planning Commission Meeting CONDITIONAL USE PERMIT RESOLUTION NO. PC2004-17 • • (At Chairperson Vanderbilt-Linares'request, Chairperson Pro-Tempore Eastman conducted the meeting.) Chairperson Pro-Tempore Eastman opened the public hearing. Approved Approved Granted sr5080jr.doc Greg McCafferty, Principal Planner, introduced ltem No. 2, as Conditiona{ Use Permit No. 2003-04793, a request to establish a church within an existing office building with waiver of minimum number of parking spaces. ApplicanYs Testimony: Philip Schwartze, representing Cornerstone Church, requested approval of a conditional use permit to establish a church in an existing 130,000 square foot office building. He submitted a letter to the Commission from the Principal of Thomas A. Edison Elementary School, and a list of Cornerstone Church activities. He stated that Cornerstone Church was an existing Anaheim Church located in the industrial area. They have been there some number of years and have been good neighbors. The building they are proposing to relocate into has been vacant for over 13 months. It is an odd size building; too big for most and too small for a select few. Catellus, the property owner, and the previous tenant met the major ten-year commitment for the owner participation agreement. The covenant requires that the Redevelopment Agency and the owner, Catellus, get together and modify the agreement and Commission's approval of the conditional use permit would set the stage for the negotiations to commence. There has never been a parking problem at Cornerstone Church, and the parking study submitted clearly indicated that it would not be. The surrounding properties are owned by Cateflus and there is more than ample parking there. If Cornerstone Church decided to add a Daycare Center, or a school, etc., they would return with an additional conditional use permit for Commission to consider the particular uses at that time. The old- style church located in the heart of the residential area with a steeple, is for the most part gone. The new- style church has the ability of the building to be many uses to many people, because today the church serves a lot more than just Sunday morning activities. 02/09/04 Page 2 of 5 FEBRUARY 9, 2004 PLANNING COMMISSION SUPPLEMENTAL DETAILED MINUTES ~ THE PUBLIC HEARING WAS CLOSED. Chairperson Vanderbilt-Linares referred to the list submitted and asked if the state licensed school, 1St through 12th grade, was a home school program. Mr. Schwartze responded that the conditional use permit referred to the existing facility that they would be moving from. Commissioner Buffa referred to staff and asked how the list of church activities compared to the letter provided on October 14, 2003, that stated the applicant's operations. Mr. McCafferty responded that the letter submitted in conjunction with the staff report was more abbreviated in terms of the scope of their activities. Mr. Schwartze stated that the ietter he submitted to Commission entai~ed activities relating to the existing facility, which was the main reason he indicated that if they had additional services beyond those in the letter they would address those via an additional conditional use permit. Commissioner Bostwick asked if he had any plans to sublease the unused space in the building to tenants. Reverend Rick Danna responded that eventually they were hoping ta utilize all of the space. In the future they would like to have a gymnasium and a school, and would like the opportunity to return to Commission at that time. But that if those plans did not work, they might have to lease part of the facility. Commissioner Buffa asked if staff's recommendation had been affected, considering there was satellite • campus for Life Pacific College; a home school program with children on site; and Eldorado High School having after-school activities at the location. Mr. McCafferty responded that staff's recommendation was based on what the parking study assumed; primarily church activities and purely that, no accessory pre-school or private school. Commissioner Buffa stated that the applicant had many activities that were not directly church related, and in the morning session Commission discussed whether there should be schools in business parks. She referred to her fellow Commissioners and asked, "Should we have kids in our commercial industrial area?" Mr. Schwartze stated most of the activities were off-site services where the pastor and others provided out-reach programs. For instance, the group that provided a car service for single moms is an outreach and off-site activity; not one that is performed on-site. Commissioner Buffa stated that she was most interested in the activities involving children, and asked if children were going to come to the church facility. Reverend Danna stated that church activity is very much involved with children, which they have been doing for a long time. The co-op is a home school co-op and not an on-campus school, although they bring children in on a periodic basis for parental training. They submitted the list so that Commission could see the kind of work they are doing in the community, with the Police Department and Fire Department in support of it, and the kind of things they have been doing for the last 14 years in Anaheim. They do more than on-campus activities, and that's why the list was different than what Commission received in the first letter. Commissioner O'Conne~l asked if they were aware that a school might be a problem in an industrial area. • Mr. Schwartze responded yes, and that `s the reason an additional parking study, etc., would have to be looked at carefully before the decision was made. 02/09/04 Page 3 of 5 FEBRUARY 9, 2004 PLANNING COMMISSION SUPPLEMENTAL DETA{LED MINUTES ~ Commissioner O'Connell stated concern as far as his getting invoived in a long-term lease, etc. Mr. Schwartze responded they were actuaily acquiring the building with the understanding that any additional services, beyond those listed in the cover letter, would have to receive approva! from the City. Chairperson Pro-Tempore Eastman stated that the only evening services noted under Condition No. 1 occurred on Wednesdays, but other churches offered meetings on other nights, and she would not want to see him in a position where he might be violating a CUP if, in fact, that was going to be happening during the week. Mr. Schwartze responded that within the letter they were trying to address events where there would be a large number of people involved that would possibly have some effect on the parking study - the three services, the Wednesday night service, and the normal administrative hours, but there possibly could be a meeting on a Thursday night with 10 people, and there was not going to be a service or anything beyond that given in the letter. Mr. McCafferty suggested that in Condition No. 1, Commission could indicate weeknight services after a certain specified time, i.e., week night services after 7 p.m., and that would give the flexibility to have other activities during the evening. FOLLOWING IS A SUMMARY OF THE PLANNING COMMISSION ACTION. OPPOSITION: None ~ IN SUPPORT: A letter was received from the principal of Thomas Edison Elementary School, in support of the subject request. ACTION: Approved CEQA Negative Declaration Approved Waiver of Code Requirement Granted Conditional Use Permit No. 2003-04793 (to establish a church within an existing office/research and development building) subject to the conditions of approval as stated in the staff report dated February 9, 2004. VOTE: 6-1 (Commissioner Bostwick voted no) Selma Mann, Assistant City Attorney, presented the 22-day appeal rights.
