PC2000-103 A RESOLUTION OF TH~ ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR R~CLASSIFICATION NO. 2000-30 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: THE SOUTH 93 FEET OF TH~ WEST 170 FEET OF THE NORTH 264 FEET OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 23, TOWNSHIP 4 SOUTH, RANGE 11 WEST IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 7 OF MISCELLANEOUS MAPS AND RECORDS OF ORANGE COUNTY, CALIFORNIA. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 28, 2000, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideratio;n of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the RS-A-43,000 (Residential/Agricultural) to the RM-2400 (Residential, Multiple Family) Zone or a less intense zone. 2. That the proposed reclassification is not consistent with the Anaheim General Plan designation for this site because the lot size is too small for the typical density permitted in multiple family residential development in the RM-2400 Zone. 3. That the proposed reclassification of subject property does not properly relate to the zones and their permitted uses locally established 'qn close proximity to subject property, and to the zones and their permitted used generally established throughout the community. 4. That 12 letters and a petition with 31 signatures were received in opposition to the proposal; and that no one indicated their presence at the public hearing in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the RS-A-43,000 (Residential/Agricultural) to the RM-2400 (Residential, Multiple Family) Zone or a less intense zone on a rectangularly-shaped 0.27-acre property having a frontage of 93 feet on the east side of Western Avenue ~ and a depth of 125 feet, being located 165 feet south of the centerline of Ball Road, and further described as 1212 South Western Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny Petition for Reclassification on the basis of the aforementioned findings. CR4033PK.
