PC2000-61 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2000-00023 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for certain real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A," attached. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 22, 2000 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That this is a city-initiated proposal for reclassification of subject area to combine the proposed South Anaheim Boulevard Commercial Corridor (SABC) Overlay Zone with the existing underlying zoning on each parcel in the project area. 2. That the existing underlying zoning in the project area consists of the following residential, commercial, industrial and oper~ space zones: RS-A-43,000 "Residential/Agricultural," RS- 10,000 "Residential, Single-Family," RS-7200 "Residential, Single-Family," RS-5000 "Residential, Single- Family," RM-3000 "Residential, Multiple-Faenily," RM-2400 "Residential, Multiple-Family," RM-1200 "Residential, Multiple-Family," CO "Commercial, Office and Professional," CL "Commercial, Limited," CG "Commercial, General," CH "Commercial, Heavy," ML "Limited Industrial," MH "Heavy Industrial" and OS "Open Space"; and that the southerly portion south of the Southern California Edison easement and east of the Santa Ana (I-5) Freeway is located in the Anaheim Stadium Area and has a resolution of intent to the (SE) Sports Entertainment Overlay Zone. 3. That the Planning Commission has approved, and recommended that the City Council approve, General Plan Amendment No. 376 (considered concurrently with subject reclassification) to amend the Land Use Element of the General Plan to change the current land use designations of sub- areas in the study area from (a) the Low Density Residential, Medium Density Residential, General Commercial and General Industrial designations to the Low-Medium Density Residential designation, (b) the Low-Medium Density Residential, Medium Density Residential, Commercial Professional, Business Office/Mixed Use/Industrial and General Industrial designations to the General Commercial designation, (c) the Low Density Residential, Medium Density Residential and General Commercial designations to the Commercial Professional designation, and (d) the Medium Density Residential and General Commercial designations to the Special Park Site designation on a 430-acre area. 4. That the Planning Commission has recommended that the City Council approve Code Amendment No. 2000-00002 (considered concurrently with subject reclassification) to amend the Zoning Code by adopting zoning and development standards for a new overlay zone, the proposed South Anaheim Boulevard Corridor (SABC) Zone !Overlay. 5. That major portions of the proposed (SABC) Overlay Zone lie within the south portion of the Commercial/Industrial Redevelopment Project Area; and that the (SABC) Overlay Zone will provide supplemental land use options and development standards for the improvement of the South Anaheim Boulevard corridor. That the intent of the (SABC) Overlay Zone is to accomplish the following: provide a mechanism for the orderly development of property located in the south portion of the Commercial/Industrial Redevelopment Project Area in order to eliminate blight and blighting influences; provide a long-term preferred land use strategy and development standards for the area; encourage regional commercial uses to locate south of Ball Road; encourage "Boulevard Residential" and "Neighborhood Residential" land uses north of Ball Road while focusing neighborhood commercial development at key intersections; encourage new development which relates well to existing residential neighborhoods; and promote appropriate levels of light, air, density of development, and efficient circulation of pedestrian and vehicular traffic. 7. That the proposed reclassification of the project area is necessary and/or desirable for the orderly and proper development of the community. 8. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 9. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposed reclassification to combine the existing zoning (RS-A- 43,000 "Residential/Agricultural," RS-10,000 "Residential, Single-Family," RS-7200 "Residential, Single- Family," RS-5000 "Residential, Single-Family," RM-3000 "Residential, Multiple-Family," RM-2400 "Residential, Multiple-Family," RM-1200 "Residential, Multiple-Family," CO "Commercial, Office and Professional," CL "Cornmercial, Limited," CG "Commercial, General," CH "Commercial, Heavy," ML "Limited Industrial," MH "Heavy Industrial" and OS "Open Space") with the proposed South Anaheim Boulevard Corridor (SABC) Overlay Zone on a 430-acre area generally located along the east and west sides of Anaheim Boulevard between Broadway on the north and the Santa Ana (I-5) Freeway on the south, and between Harbor Boulevard and the Santa Ana (I-5) Freeway on the west and Olive Street and the southerly extension of the Southern Pacific railroad tracks on the east; and does hereby approve the Mitigated Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Mitigated Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described properties from the RS-A-43,000 "Residential/Agricultural," RS-10,000 "Residential, Single-Family," RS-7200 "Residential, Single-Family," RS-5000 "Residential, Single-Family," RM-$000 "Residential, Multiple-Family," RM-2400 "Residential, Multiple-Family," RM-1200 "Residential, Multiple-Family," CO "Commercial, Office and Professional," CL "Commercial, Limited," CG "Commercial, General," CH "Commercial, Heavy," ML "Limited Industrial," MH "Heavy Industrial" and OS "Open Space" Zones, and to incorporate said described property into the RS- A-43,000(SABC) "Residential/Agricultural - South Anaheim Boulevard Commercial Corridor Overlay," RS- 10,000(SABC) "Residential, Single-Family - South Anaheim Boulevard Commercial Corridor Overlay," RS-7200(SABC) "Residential, Single-Family - South Anaheim Boulevard Commercial Corridor Overlay," RS-5000(SABC) "Residential, Single-Family - South Anaheim Boulevard Commercial Corridor Overlay," RM-3000(SABC) "Residential, Multiple-Family - South Anaheim Boulevard Commercial Corridor Overlay," RM-2400(SABC) "Residential, Multiple-Family - South Anaheim Boulevard Commercial Corridor Overlay," RM-1200(SABC) "Residential, Multiple-Family - South Anaheim Boulevard Commercial Corridor Overlay," CO(SABC) "Commercial, Office and Professional - South Anaheim Boulevard Commercial Corridor Overlay," CL(SABC) "Commercial, Limited - South Anaheim Boulevard Commercial Corridor Overlay," CG(SABC) "Commercial, General - South Anaheim Boulevard Commercial Corridor Overlay," CH(SABC) "Commercial, Heavy - South Anaheim Boulevard Commercial Corridor Overlay," ML(SABC) "Limited -2- PC2000-61 ~ • Industrial - South Anaheim Boulevard Commercial Corridor Overlay," MH(SABC) "Heavy Industrial - South Anaheim Boulevard Commercial Corridor Overlay" and OS(SABC) "Open Space - South Anaheim Boulevard Commercial Corridor Overlay" Zones upon the following condition which is hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: That prior to introduction of an ordinance reclassifying the subject area to the South Anaheim Boulevard Corridor (SABC) Overlay Zone, Code Amendment No. 2000-00002 shall be approved by the Anaheim City Council and an ordinance shall be adopted to amend Title 18 "Zoning" of the Anaheim Municipal Code establishing zoning and development standards for the (SABC) Overlay Zone. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon compliance with the condition hereinabove set forth. Should such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by the City Council at its sole discretion.
