PC2000-62 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2000-04202 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: BEGINNING AT THE SOUTHWEST CORNER OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 4, TOWNSHIP 4 SOUTH, RANGE 10 WEST, AS SHOWN ON SAID MAP OF TRACT 3396; THENCE SOUTH 89° 42' S7" ~AST 203.00 FEET ALONG THE SOUTHERLY LINE OF SAID NORTHWEST QUARTER; THENCE NORTH 0° 02' 23" EAST 180.00 FEET PARALLEL WITW THE WESTERLY LINE OF SAID SECTION; THENCE NORTH 89° 42' S7" 11VEST 203.00 FEET TO THE WESTERLY LINE OF SAID SECTION; THENCE SOUTH 0° 02' 23" WEST 180.00 FEET TO THE POINT OF BEGINNING. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 22, 2000 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the meeting of May 8, 2000; and WHEREAS, said Commissyon, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts:. 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.050.085 to expand an existing tire sales and installation facility to include automotive repair. 2. That the proposal is located at 1284 North Euclid Street. 3. That the proposal will not adversely affect the adjoining land uses and the growth and development of the area in which it is located. 4. That the size and shape of the site for the proposed use is adequate to allow the full development of the proposal in a manner n~t detrimental to the particular area nor to the peace, health, safety and general welfare. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That granting of this conditional use permit, under the conditions imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 7. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONM~NTAL QUALITY ACT FINDING: The Planning Director's authorized representative has determined that the proposed project falls within the definition of CR3961as.doc -1- PC2000-62 ~ ~ Categorical Exemptions, Class 1, as define~d in the State of California Environmental Impact Report (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: That all work on vehicles shall be confined entirely to the interior of the building. Absolutely no repair or other business-related activities shall be permitted outside the building or in the parking areas. 2. That there shall be no vehicle rental or sales at this property. 3. That window signage, as authorized by the Municipal Code, shall be permitted. Any proposed additional signs on the building shall be submitted to the Planning Commission for review and approval as a"Reports and Recommendations" item. 4. That this use shall be limited to the service and installation of tires, wheels, shocks, batteries, mufflers, brakes and air conditioning equipment, minor engine repair and maintenance, tune ups, wheel alignments, smog tests, and other similar services. Spray painting, upholstery work, auto body work, and major engine and transmission overhauls shall not be permitted. 5. That no banners or other advertising shall be displayed within the service bays facing the public rights-of-way unless a Special Event Permit is first obtained to authorize said display. 6. That no propane tanks shall be permitted on the premises. 7. That the property shall be permanently maintained in an orderly fashion by providing regular landscape maintenance, removal of trash or debris, and removal of graffiti within twenty four (24) hours from time of occurrence. 8. That the existing chain link fence along the east property line shall be properly maintained. 9. That there shall be no public telephones on the premises located outside the building. 10. That the hours of operation shall be limited to 8:00 a.m. to 6:00 p.m., Monday through Saturday. 11. That prior commencing operation of this business, a valid business license shall be obtained from the Business License Division of the City of Anaheim Finance Department. 12. That trash storage areas shall be refurbished as required by Public Works Department, Streets and Sanitation Division, to comply with approved plans on file with said department. 13. That no outdoor overnight storage of, display of, or work on vehicles or vehicular parts shall be permitted on the premises. 14. That no outdoor public address system or amplified system shall be permitted. 15. That three (3) foot high address numbers shall be displayed on the roof of the building in a contrasting color to the roof material. The numbers shall not be visible to any street or adjacent property. 16. That the proposal shall comply with all signing requirements of the CL (Commercial, Limited) Zone unless a variance allowing sign waivers is approved by the Planning Commission or City Council. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2, and as conditioned herein. 18. That within a period of two (2) months from the date of this resolution, or prior to commencement of the activity authorized by this resolution, or prior to issuance of a building permit, whichever occurs first, Condition Nos. 3, 12 and 15, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 19. That within a period of three (3) months from the date of this resolution, Condition Nos. 8 and 17, above-mentioned, shall be complied with. 20. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicanYs compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
