Resolution-PC 2000-7~ ~ RESOLUTION NO. PC2000-7 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 4173 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: THE NORTH 185.00 FEET OF THE WEST 6 ACRES OF THE EASTERLY HALF OF THE NORTHERLY HALF OF LOT 8 OF ANAHEIM EXTENSION, AS SHOWN ON A MAP OF SURVEY BY WILLIAM HAMEL, A COPY OF WHICH IS SHOWN IN BOOK 3, PAGES 162 INCLUSIVE OF LOS ANGELES COUNTY MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFORNIA. EXCEPTING THEREFROM THE WEST 150.00 FEET THEREOF. ALSO EXCEPTING THEREFROM THE EAST 75.00 FEET THEREOF. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on January 3, 2000 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.050.085 to permit an automotive vehicle repair facility in an existing vacant building. 2. That this conditional use permit was considered in conjunction with Reclassification No. 99-00-14, which the Planning Commission approved, to rezone subject property from the CH (Commercial, Heavy) to the CL (Commercial, Limited) Zone. 3. That proposed use is hereby denied on the basis that an auto repair facility, with visible service bays to residential and motel uses and to a public right-of-way (Lincoln Avenue, a major arterial highway), will adversely affect the adjoining land uses to the south (residential) and west (Sandman Motel), and the growth and development of the area in which it is proposed to be located. 4. That the size and shape of the site for the proposed auto repair facility, as the property is currently developed, will not be adequate for a busy auto repair facility which has limited areas for parking during trash pick-up days. 5 That the proposed use of the property is constrained because providing an adequate trash truck turn-around would adversely impact required parking. 6. That granting of this conditional use permit would be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim because the overhead doors for the CR3859PK.DOC -1- PC2000-7 ~ • proposed automotive vehicle repair facility are oriented towards residential and motel land uses instead of adjacent commercial uses, and said orientation would adversely impact these residential and motel uses. 7. That the proposed use would adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 8. That the size and shape of the site proposed for the proposed use is not adequate to allow full development of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 9. That granting this Conditional Use Permit would be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 10. That the traffic generated by the proposed use would impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 11. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONM~NTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit an automotive vehicle repair facility in an existing vacant building on a 0.33-acre rectangularly-shaped property having a frontage of 90 feet on the south side of Lincoln Avenue, a maximum depth of 160 feet, being located 711 feet east of the centerline of East Street, and further described as 1256 East Lincotn Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that th~ project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit on the basis of the aforementioned findings.
