Resolution-PC 2000-71~ ~ RESOLUTION NO. PC2000-71 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION TERMINATING ALL pROCEEDINGS IN CONNECTION WITH CONDITIONAL USE PERMIT NOS. 921, 1021, 1139, 1990, 3741 AND VARIANCE NOS. 2360 & 4268 WHEREAS, on April 18, 1'967, the City Council adopted Resolution No. R229 to grant Conditional Use Permit No. 921 and permit a plant nursery in conjunction with an existing shopping center at 1660 West Katella Avenue; and that this business is no longer located at this address; and WHEREAS, on April 8, 1968, the Anaheim City Planning Commission adopted Resolution No. PC68-89 to grant Conditional Use Permit No. 1021 and permit on premises sales and consumption of liquor in conjunction with a proposed restaurant; and this restaurant was never constructed; and WHEREAS, on October 6, 1969, the Anaheim City Planning Commission adopted Resolution No. PC69-204 to grant Conditional Use Permit No. 1139, In Part, and to establish an outdoor plant nursery in conjunction with a hardware store with waivers of maximum sign height and required 6- foot high masonry wall screening the outdoor storage area at 1616 West Katella Avenue; and the hardware store business for which this application was approved is no longer located at this address and the current supermarket tenant (Food 4 Less) is not utilizing the plant nursery entitlement; and WHEREAS, on May 15, 1972, the Anaheim City Planning Commission adopted Resolution No. PC72-99 to grant Variance No. 2360 and to waive permitted uses in order to allow outdoor merchandise display at 1616 West Katella Avenue, Food-4-Less; and the business for which this application was approved is no longer located at this address and the current supermarket tenant is not utilizing any outdoor merchandise display; and WHEREAS, on June 18, 1979, the Anaheim City Planning Commission adopted Resolution No. PC79-118 to grant Conditio;nal Use Permit No. 1990 and to permit on-premises sales and consumption of beer and wine in a proposed restaurant at 1646 West Katella Avenue; and the restaurant business for which this application was approved is no longer located at this address and a fast food restaurant without beer and wine sold on pr:emises is now located at this address; and WHEREAS, on December 15, 1994, the Anaheim City Zoning Administrator adopted Resolution No. ZA94-32 to grant Variance No. 4268 and to waive the minimum number of parking spaces (1,142 required; 1.133 proposed) in conjunction with a restaurant at 1682 West Katella Avenue; and this business is no longer located at this address; and WHEREAS, on February 6, 1995, the Anaheim City Planning Commission adopted Resolution No. PC95-17 to grant Conditional Use Permit No. 3741 and to permit an automotive vehicle alarm and stereo sales and installation facility at 1696 West Katella Avenue; and this business is no longer located at this address` WHEREAS, on March 27, 2000, the Anaheim City Planning Commission adopted Resolution No. PC2000-37 to grant Conditional Use Permit No. 4180, in part, and to construct a fast food drive-through restaurant with waivers of minimum distance between freestanding signs and minimum number of parking spaces (the sign waiver was denied) within an existing commercial retail center at 1626 W. Katella Avenue; and CR3976PK.DOC -1- PC2000-71 ~ ~ WHEREAS, this property is currently developed with a large retail shopping center. This property has been zoned CL (Commercial, Limited) since 1968, and is designated for General Commercial and Low Density Residential land uses by the City of Anaheim General Plan Land Use Element Map; and WHEREAS, Gerald T. Unterkoefler, authorized agent and manager for Euclid Shopping Center, LLC., has submitted a letter requesting termination of Conditional Use Permit Nos. 921,1021, 1139, 1990, 3741 and Variance Nos. 2360 ~& 4268 to comply with the conditions of approval of Conditional Use Permit No. 4180. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby terminate all proceedings in connection with Conditional Use Permit Nos. 921,1021, 1139, 1990, 3741 and Variance Nos. 2360 & 4268 on the basis of the foregoing findings.
