A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION F~JR VARIANCE NO. 4389 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for
Variance for certain real property situated irn the City of Anaheim, County of Orange, State of California
described as:
THE EAST HALF OF THE NORTHEAST QUARTER OF THE NORTHEAST
QUARTER OF THE SOUTHEAST QUARTER OF SECTION 7, TOWNSHIP
4 SOUTH, RANGE 10 WEST, IN THE RANCHO LOS COYOTES, IN THE
CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS
SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 10 OF
MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY,
CALIFORNIA.
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center
in the City of Anaheim on January 19, 2000, at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipat Code, Chapter
18.03, to hear and consider evidence for and against said proposed variance and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the petitioner proposes waiver of the following to permit a private business/trade
school (Bryman College) within an existing 3-story office building:
Sections 18.06.050.021.0211 - Minimum number of parkinq spaces.
18.06.050.0212 (265 required; 179 proposed)
18.06.050.026.0263
18.06.080
and 18.44.066.050
2. That this variance (No. 4389) was inadvertently advertised as "No. 4382."
3. That this parking variance is hereby denied on the basis that approvat would cause fewer
off-street parking spaces to be provided for the proposed use than the number of such spaces necessary
to accommodate all vehicles attributable to such use under the normal and reasonably foreseeable
conditions of operation of such use.
4. That approval of this variance would increase the demand and competition for parking
spaces upon the public streets in the immediate vicinity of the proposed use.
5. That approval of this variance would be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which the property is located.
6. That approval of this variar~ce would increase the demand and competition for parking
spaces upon adjacent private property in th~e immediate vicinity of the proposed use (which property is not
expressly provided as parking for such use under an agreement in compliance with Section
18.06.010.020 of the Zoning Code).

7. That approvat of this variarace would increase traffic congestion within the off-street
parking areas or lots provided for the proposal.
8. That approval of this variance would impede vehicular ingress to or egress from adjacent
properties upon the public streets in the immediate vicinity of the proposed use.
9. That finro people spoke at the public hearing in opposition to the proposal; and that no
correspondence was received in opposition.
CALIFORNIA ENVIRONM~NTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposed waiver of minimum number of parking spaces to permit
a private business/ trade school (Bryman Gollege) within an existing 3-story office building on a
rectangularly-shaped 1.93-acre property lo~ated at the southwest corner of Crescent Avenue and
Brookhurst Street, having frontages of 251 feet on the south side of Crescent Avenue and 299 feet on the
west side of Brookhurst Street, and further described as 511 North Brookhurst Street; and does hereby
approve the Negative Declaration upon finding that the declaration reflects the independent judgment of
the lead agency and that it has considered the Negative Declaration together with any comments
received during the public review process and further finding on the basis of the initial study and any
comments received that there is no substamtial evidence that the project will have a significant effect on
the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby deny subject Petition for Varia'nce on the basis of the aforementioned findings.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
January 19, 2000. ,
