PC2001-117 ~ A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO. 83-239 ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 2521 WHEREAS, on December 12, 1983, Resolution No. PC83-239 was adopted by the Anaheim City Planning Commission to grant Conditional Use Permit No. 2521 to permit expansion of a private educational institution with a maximum enroilment of 240 students in the RS-A-43,000 (Residential/Agricultural) zone and waiver of minimum number of parking space; and WHEREAS, this property is developed with the Braille Institute - Orange County Center located in the RS-A-43,000 zone; and that the General Plan land use designation is Low Density Residential; and WHEREAS, the petitioner has requested an amendment to this conditional use permit under authority of Code Section 18.21.050.270 to permit an addition to the existing private school with waiver of the following: Sections 18.06.050.026.0263 - Minimum number of parkinq sqaces. 18.06.080 (126 spaces required; and 18.21.066.010 51 spaces existing and concurred with by the Traffic and Transportation Manager) WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 27, 2001, at 1:30 p.m., notice of said public hearing having been duly giy~n ~s reoui~-ed py I~w ~nd in ~~~Qrdanc~ wi#h #h~ prpvisions of the Anaheim Municiq~l ~ode, ~ha~ter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the July 16, 2001 meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the use, as proposed to be expanded, is properly one for which a conditional use permit is authorized by the Zoning Code; that the proposal specifically consists of a 421 square foot expansion to the office area, for a total building square footage of 20,417 square feet; that the addition will be used for storage of technical equipment and office space; and that this addition will serve existing students at this private school and will not increase enrollment. 2. That the waiver, under the conditions imposed, will not cause fewer off-street parking spaces to be provided for the use, as proposed to be expanded, than the number of such spaces necessary to accommodate all vehicles attributable to the use under the normal and reasonably foreseeable conditions of operation of the use. 4. That the waiver, under the conditions imposed, will not increase the demand and competition for parking spaces upon the public streets in the immediate vicinity of the proposal. That the waiver, under the conditions imposed, will not increase the demand and competition for parking spaces upon adjacent private property in the immediate vicinity of the use, as proposed use to be expanded (which property is not expressly provided as parking for such use under an agreement in compliance with Section 18.06.010.020 of the Anaheim Municipal Code). 6. That the waiver, under the conditions imposed, will not increase traffic congestion within the off-street parking areas or lots provided for such use. 7. That the waiver, under the conditions imposed, will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the proposal. 8. That the use, as proposed to be expanded, will not adversely affect the adjoining land uses and the growth and development of the area. 9. That the size and shape of the site for the proposed use is adequate to allow full develapment of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 10. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 11. That amending this conditional use permit, under the conditions imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 12. That the proposed addition will not create a adverse visual impact on the surrounding area; and that the addition will be incorporated into the existing architecture of the institution. 13. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit an addition to an existing private school with waiver of minimum number of parking spaces on a 1.75-acre rectangularly-shaped property located at the southwest corner of Crescent Avenue and Dale Avenue, having frontages of 219 feet on the south side of Crescent Avenue and 350 feet on the west side of Dale Avenue, and further described as 527 North Dale Avenue (The Braille Institute); and does hereby find that the Negative Declaration serves as the required environmental documentation in connection with this request upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does h~reby amend Resolu#ion No. PG83-~39; adoo#ed in conn~~#iQn with Conditional Use Permi# IVQ. 2521, tQ permit an addition to an existing private school under authority of Code Section 18.21.050.270 and waiver of the following: Sections 18.06.050.026.0263 - Minimum number of parkinq spaces. 18.06.080 (126 spaces required; and 18.21.066.010 51 spaces existing and concurred with by the Traffic and Transportation Manager) -2- PC2001-117 • • BE IT FURTHER RESOLVED that the Planning Commission does hereby amend the conditions of approval, adopted in connection with Conditional Use Permit No. 2521, in their entirety, to as follows: That trash storage area(s) shall be provided and maintained in location(s) acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. Said storage area(s) shall be designed, located and screened so as not to be readily identifiable from adjacent streets or highways. The walls of the storage area(s) shall be protected from graffiti opportunities by the use of plant materials such as minimum one (1) gallon sized clinging vines planted on maximum three (3) foot centers or tall shrubbery. Said information shall be specifically shown on the p~ans submitted for building permits. 2. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Streets and Sanitation Division for review and approval. That an on-site trash truck turn-around area shall be provided in accordance with Engineering Standard Detail No. 610 and maintained to the satisfaction of the Streets and Sanitation Division. Said turn-around area shall be specifically shown on the plans submitted for building permits. 4. That a Lot Line Adjustment shall be submitted to the Public Works Department, Development Services Division, to merge all existing parcels into one (1) legal lot. The Lot Line Adjustment shall be approved by the City Engineer and then recorded in the Office of the Orange County Recorder. A copy of the recorded document shall be submitted to the Planning Department. 5. ~hat-the property-shatl be permanently rnaintained in ar~ orderty fashion through the provision or regular landscaping maintenance, removal of trash or debris, and removal of graffiti within twenty four (24) hours from time of occurrence. 6. That all existing mature landscaping shall be maintained and immediately replaced in the event that it becomes diseased or dies. 7. That the subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 3. That prior to issuance of a building permit or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 1, 2, 3 and 4, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 9. That prior to final building and zoning inspections, Condition No. 7, above-mentioned, shall be complied with. 10.
