PC2001-127 ~ A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2001-04407 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: THE SOUTHERLY 202.00 FEET OF THAT PORTION OF THE WEST ONE- HALF F THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 12, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11, MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTH LINE OF SAID SOUTHEAST QUARTER SOUTH 89 DEG, 40' 43" WEST 189.60 FEET FROM THE SOUTHEAST CORNER OF SAID WEST ONE-HALF; THENCE CONTINUING SOUTH 89 DEG. 40' 43" WEST ALONG SAID SOUTHERLY LINE 237.28 FEET; THENCE NORTH 0 DEG. 15' 45" WEST 586.66 FEET TO A POINT IN THE SOUTH LINE OF TRACT NO. 3007, AS SHOWN ON A MAP RECORDED IN BOOK 89, PAGES 33 AND 34, MISCELLANEOUS MAPS RECORDS OF SAID QRRN6E E~URfTY; THENGE NOF~TH 81 D~~. 40' 4-3" €AST ALO.I~IG SAI-D _ SOUTHERLY LINE 236.82 FEET TO A POINT SOUTH 89 DEG. 40' 43" WEST 190.46 FEET FROM THE EAST LINE OF SAID WEST ONE-HA~F; THENCE SOUTH 0 DEG. 18' 26" EAST 586.66 FEET TO THE POINT OF BEGINNING. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 10, 2001 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and this hearing was continued from the August 13 and August 27, 2001 Planning Commission meetings; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Sections 18.44.050.135 and 18.44.050.360 to establish land use conformity with existing Zoning Code land use requirements for an existing commercial retail center and to permit a coin-operated laundry. 2. That the proposed use as conditioned herein would not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed. 3. That the granting of the conditional use permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the citizens of the City of Anaheim. 4. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: The Planning Director's authorized representative has determined that the proposed project falls within the definition of CR5184PK.doc -1- PC2001-127 • + Categorical Exemptions, Class 1, as defined in the State of California Environmental Impact Report ("EIR") Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: Coin-Oqerated Laundry That the laundromat facility shall be operated with at least one (1) attendant on-site during all hours of operation. 2. That the hours of operation shall be limited to 6 a.m. to 10 p.m.; and that the rear doorways facing the residential area shall remain closed after dark (preventing entry from outside the building). 3. That the restroom facilities located within the laundromat shall remain locked at all times and access provided to customers only by means of a key provided by the laundromat attendant. 4. That signs shall be posted in a conspicuous place in both the parking lot and inside the laundromat notifying patrons that loitering, panhandling, and/or the consumption of alcoholic beverages upon the premises is prohibited. 5. That window signage shall be limited to the top twenty percent (20%) of the windows. 6. That additional trash receptacles shall be provided in front of the tenant space, as approved by the Zoning Division. Said receptacles shall be properly maintained at all times. 7. That prior to commencing operation of this business, a valid business license shall be obtained from the Business License Division of the City of Anaheim Finance Department. 8. That the operator of this business shall be fully responsible for retaining all laundry carts inside the building. 9. That the proposed wall sign shall be limited to sixty seven and two tens (67.2) square feet. 10. That no video, electronic or other amusement devices or games shall be permitted on the premises. Commercial Retail Center 11. That all existing and proposed public telephones shall be located inside the building. 12. That no outdoor storage, display or sales of inerchandise or fixtures shall be permitted. 13. That roaf mount~~ ba!!~ons or other inf!atsd dev~ce shall not bs qermitted. 14. That no vending machines shall be permitted on the exterior of the property which are visible to the public right-of-way. 15. That plans showing four (4) foot high street address numbers on the roof of the building in a contrasting color to the roof material shall be submitted to the Police Department, Community Services Division, for review and approval. These numbers shall not be visible to the streets or adjacent properties. 16. That no required parking area shall be fenced or otherwise enclosed for storage or other outdoor use. -2- PC2001-127 • • 17. That the number of tenant spaces shall be limited to eight (8) units. 18. That signage for subject facility shall be limited to all legal existing signage as of the date of this resolution. Any additional signs shall be subject to approval by the Planning Commission as a "Reports and Recommendations" item. 19. That the parking lot shall be repaired, slurry sealed and re-striped. 20. That the commercial center shall be painted. 21. That all wall sign cabinets shall be fitted with copy panels. 22. That the property shall be permanently maintained in an orderly fashion through the provision of regular landscaping maintenance, removal of trash or debris, and removal of graffiti with finrenty four (24) hours from the time of occurrence. 23. That all trash generated from this commercial retail center shall be properly contained in trash bin(s) contained within approved trash enclosure(s). The number of bins shall be adequate and the trash pick-up shall be as frequent as necessary to ensure the sanitary handling and timely removal of refuse from the property. The Code Enforcement Division of the Planning Department shall determine the need for additional bins or additional pick-up. All costs for increasing the number of bins or frequency of pick-up shall be paid for by the business owner. - - 2~ Tha~ any existing or praposec~ roa~mQ~tnted-eq~ipmer~~-shall b~ s~bjec~#o-the screeniag requirements of Anaheim Municipal Code Section 18.44.030.120 pertaining to the CL (Commercial, Limited) Zone. Said information shall be specifically shown on the plans submitted for Zoning and Building Division approval. 25. That a final landscaping plan shall be submitted to the Zoning Division for review and approval showing twenty four inch (24") box sized trees planted on maximum twenty (20) foot centers in the landscaped setbacks adjacent to both streets. Said plan shall also show refurbishment of the planter areas. Any decision by the Zoning Division regarding said landscaping plan may be appealed to the Planning Commission. Said landscaping shall be installed and maintained according to the approved plan. 26. That trash storage area(s) shall be refurbished to the satisfaction of the Public Works Department, Streets and Sanitation Division, to comply with approved plans on file with said Department, including, but not limited to, painting and installing trash enclosure gates in accordance with City standards and storing trash bins inside trash enclosures. 27. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2, and as conditioned herein 28. That within a period of three (3) months days from the date of this resolution, Condition Nos. 11, 15, 19, 20, 21, 23, 24, 25, 26 and 27, above-mentioned, shall be completed. 29. That prior to final building and zoning inspections, Condition Nos. 4, 6 and 9, above-mentioned, shall be complied with. -3- PC2001-127 ~ ~ 30. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicanYs compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
