PC2001-135 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2001-00395, EXHIBIT A, PERTAINING TO THE LAND USE ELEMENT WHEREAS, the City Council of the City of Anaheim did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, the Planning Commission directed staff to initiate an amendment to the Land Use Element of the General Plan to consider redesignating the northwesterly 3.9-acre portion of a 24.5- acre study area located between the SR-91/Riverside Freeway and Santa Ana Canyon Road, and Via Cortez and Solomon Drive from the General Commercial to the Hillside Low-Medium Density Residential land use designation; and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on September 24, 2001, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the July 30, 2001, and August 13 and 27, 2001 meetings; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That the subject 3.9-acre area, which has an existing General Commercial land use designation, is not a viable commercial site due to its lack of visibility to a major arterial highway, the long distance to a major arterial highway (Santa Ana Canyon Road), and the size and shape of the property. 2. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted redesignating subject 3.9-acre area from the General Commercia/ to the Hillside Low-Medium Density Residential land use designation. 3. That the proposed Hillside Low-Medium Density Residential land use designation is consistent with the adjoining property that is designated for Hillside Low-Medium Density Residential land uses. 4. That no one indicated their presence at the September 24, 2001, public hearing in opposition to the proposal; and that numerous letters were received regarding the proposal. 5. That three interested persons spoke at the September 24, 2001, public hearing with concerns and suggestions regarding the development proposal. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to change the current land use designation from General Commercial to Hillside Low-Medium Density Residential on 3.9 acres which comprise the northwesterly portion of a 24.5-acre property located on the east side of Solomon Drive northerly of Santa Ana Canyon Road and westerly of Via Cortez and south of the SR 9'f/Riverside Freeway, having a frontage of 1,306 feet on the west side of Solomon Drive and a maximum depth of 1,418 feet (generally parallel to the SR 91-Riverside Freeway), being located 112 feet CR5193PK.doc -1- PC2001-135 • ~ north of the centerline of Santa Ana Canyon Road and further described as 5801 East Santa Ana Canyon Road; and that the subject 3.9 acres are located between the SR 91/Riverside Freeway and Via Cortez with the east boundary consisting of a line extending northerly from the east side of Via Cortez; and does hereby approve the CEQA Mitigated Negative Declaration and Mitigation Monitoring Program/Plan No. 116 upon finding that it has considered the CEQA Mitigated Negative Declaration and Mitigation Monitoring Program/Plan No. 116 together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2001-00395, Exhibit A, pertaining to the Land Use Element to redesignate the northwesterly 3.9-acre portion of the study area from the General Commercia! land use designation to the Hillside Low-Medium Density Residential land use designation.
