RESOLUTION NO. PC2001-162
A RESOLUTION OF THE CtTY OF ANAHEIM PLANNING COMMISSION
RECOMMENDING ADOPTION OF AMENDMENT NO. 3 TO THEANAHEIM RESORT PUBLIC
REALM LANDSCAPE PROGRAM
WHEREAS, on September 20, 1994, the City Councii adopted Resolution No.
94R-239 approving The Anaheim Resort Public Realm Landscape Program to set forth the
landscape concepts proposed for the public streets (the "Public Realm") within or bordering the
Anaheim Resort, and making certain findings in conjunction therewith; and
WHEREAS, on October 8, 1996, the City Council adopted Resolution No. 96R-178
amending The Anaheim Resort Public Realm Landscape Program in order to provide for
modifications to the streetscape landscape plans for Freedman Way, Harbor Boulevard, Walnut
Street and West Street/Disneyland Drive; and
WHEREAS, on June 22, 1999, the City Council adopted Resolution No. 99R-137
amending The Anaheim Resort Public Realm Landscape Program (Pointe*Anaheim) in order to
provide for a mid-block median break on Clementine Street between Disney Way (former
Freedman Way) and Katella Avenue; and
WHEREAS, pursuant to Chapter 18.93 of the Anaheim Municipal Code, Robert H.
Shelton, Anaheim Center for Entertainment, LLC, as authorized agent for Excel Pointe Anaheim,
LLC, submitted a request dated March 12, 2001, that the Planning Commission initiate General
Plan Amendment No. 200T-00393, Rmend-ment No. 5 fo The Disr~eyf~nct-Resart Specific Plan No.
92-1, Amendment to Conditional Use Permit No. 4078 and other related actions pertaining to the
Pointe Anaheim project, as it is proposed to be modified; and that said other actions include an
amendner~t ta The Anah~9rr Reso~: Publi~ P~alm Lar~r!§~ape Program to mcdify the landscape
concept diagram for Disney Way between Harbor Boulevard and Clementine Street to reflect a
mid-block median island opening to permit vehicle ingress and egress to the modified Pointe
Anaheim project; and
WHEREAS, the Anaheim City Planning Commission, by its Resolution No.
PC2001-41, duly initiated Amendment No. 3 to The Anaheim Resort Public Realm Landscape
Program in conjunction with the other proposed Pointe Anaheim project actions (General Plan
Amendment No. 2001-00393, Amendment No. 5 to The Disneyland Resort Specific Plan No. 92-1,
Amendment to Conditional Use Permit No. 4078 and the First Amended and Restated
Development Agreement No. 99-01) at its regularly scheduled meeting on April 9, 2001; and
WHEREAS, the Planning Commission did hold a public hearing at the Anaheim
Civic Center, Council Chamber, 200 South Anaheim Boulevard, in the City of Anaheim on
November 19, 2001, at 1:30 p.m., notice of said public hearing having been duly given as required
by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence for and against said proposed amendment to the Anaheim Resort
Public Realm Landscape Program and to investigate and make findings and recommendations in
connection therewith; and
WHEREAS, the proposed amendment to the Landscape Concept Diagram for the
Anaheim Resort Public Realm (Section 1.2.9 of The Anaheim Resort Public Realm Landscape
Program) is shown in Attachment C to the Staff Report to the Planning Commission dated
November 19, 2001; and

WHEREAS, the Planning Commission has reviewed the proposal to amend The
Anaheim Resort Public Realm Landscape Program and, by its Resolution No. PC2001-159, has
found and recommended that the City Council determine that the Addendum to the Pointe Anaheim
Initial Study and Mitigated Negative Declaration dated October 29, 2001 is adequate to serve as
the required environmental documentation for the proposed amendment; and fu~ther finding that
there is no substantial evidence, with the imposition of the mitigation measures identified in
Modified Mitigation Monitoring Program No. 004, the amendment will have a significant effect on
the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission, after due inspection, investigation and study made by itself and in its behalf, and after
due consideration of all evidence and reports offered at the public hearing, does hereby
recommend that the City Council adopt Amendment No. 3 to The Anaheim Resort Public Realm
Landscape Program to modify the landscape concept diagram for Disney Way befinreen Harbor
Boulevard and Clementine Street to reflect a mid-block median opening to provide for turns into
and out of the modified Pointe Anaheim project, as set forth in Exhibit A to this Resolution,
inasmuch as Disney Way will be a main access street to the Pointe Anaheim project.
THE FOREGOING RESOLUTION was adopted at the Planning Commission
meeting of November 19, 2001.
