Resolution-PC 2001-18~ RESOLUTION NO. PC2001-18 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2001-04318 BE GRANTED, IN PART WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: PARCELS 2 AND 4 OF PARCEL MAP NO. 95-118 AS SHOWN ON A MAP FILED IN BOOK 287, PAGES 17 TO 20 INCLUSIVE OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFORNIA. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on January 29, 2000 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.110.070.050.0511 to permit a church in an existing building with waiver of the following: Sections 18.06.050.020.026.0262 - Minimum number of parkinq spaces. 18. 06. 050. 020. 026. 0266 and 18.110.070.110 2. That the proposal is located in Development Area 2(Expanded Industrial Area) of the Northeast Area Specific Plan No. 94-1, on a parcel which has no frontage on a public street but has access to La Palma Avenue via an easement. 3. That the waiver, minimum number of parking spaces, is hereby denied on the basis that it was deleted following public notification. 4. That the proposed use, as approved, will not adversely affect the adjoining office and retail land uses nor restrict the growth and development of the area in which it is proposed to be located. 5. That the size and shape of the site for the proposed use, as approved, is adequate to allow full development of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 6. That the traffic generated by the proposed use, as approved, will not impose an undue burden upon the streets and highways designed and improved to carry traffic in the area because the church would operate during off-peak times. 7. That granting of this conditional use permit, under the conditions imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 8. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CR5010PK.doc -1- PC2001-18 • • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a church with accessory school activities in an existing building with waiver of minimum number of parking spaces on a irregularly-shaped 2.8-acre property located 280 feet north of La Palma Avenue with no frontage on a public street, having a maximum depth of 501 feet, being accessed by a 40 foot wide private access easement located 1,110 feet east of the centerline of Brasher Street, and further described as 5605 East La Palma Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, in part, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: That the hours of operation for the church and for the office shall be limited to the following, as stipulated to in the petitioner's letter of operation: Sunday Church Services: 8:00 a.m. to 10:00 p.m. Wednesday Church Services: 7:00 p.m. to 10 p.m. Monday through Friday Office hours: 8:00 a.m. to 6 p.m. 2. That no portable signs shall be utilized to advertise this church and its associated activities; that signage shall be limited to one (1) wall sign and identification on the existing monument sign; and that any additional signs first shall be reviewed and approved by the Commission as a"Reports and Recommendations" item. 3. That no outdoor events shall be permitted, except as approved pursuant to obtaining a special events permit from the City of Anaheim. 4. That no required parking area shall be fenced or otherwise enclosed for storage or other outdoor uses. 5. That the only accessory school activity shall be Sunday school; and that this facility shall not be used as a private day care, nursery, elementary, junior and/or senior high school. 6. That the adult congregation at any one time shall be limited to eight hundred (800) persons; and if the number of congregates increases and exceeds this number of inembers at any one time, the petitioner shall submit a parking management plan to the Traffic and Transportation Manager for review and approval, prior to the increase being reviewed and approved by the Planning Commission at a noticed public hearing. That the property shall be permanently maintained in an orderly fashion through the provision of regular landscaping maintenance, removal of trash or debris, and removal of graffiti within twenty four (24) hours from time of occurrence. 8. That an on-site trash-truck turn-around area shall be provided in compliance with Engineering Standard Detail No. 610 and as required by the Department of Public Works, Street Sweeping and Sanitation Division. Said area shall be shown on plans submitted for building permits. -2- PC2001-18 • • 9. That trash storage area(s) shall be provided and maintained in location(s) acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. Said storage area(s) shall be designed, located and screened so as not to be readily identifiable to adjacent streets or highways. The walls of the storage areas shall be protected from graffiti opportunities by the use of plant materials such as minimum one (1) gallon sized clinging vines planted on maximum three (3) foot centers, or tall shrubbery. Said information shall be specifically shown on the plans submitted for building permits. 10. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Streets and Sanitation Division for review and approval. 11. That any roof-mounted equipment shall be subject to Anaheim Municipal Code Section 18.84.062.032 pertaining to the "SC" Scenic Corridor Overlay Zone. Such information shall be specifically shown on the plans and shall be subject to Zoning Division review and approval prior to submittal for building permits. 12. That the on-site landscaping and irrigation system shall be maintained in compliance with City standards. 13. That all existing water services shall conform to current Water Utility standards. Any existing water services that are not approved by the Water Engineering Division for continued use shall be upgraded to current standards or abandoned by the developer. If existing services are no longer needed, they shall be abandoned by the developer. 14. That three (3) foot high street address numbers shall be displayed on the roof of the building in a contrasting color to the roof material. The numbers shall not be visible to the street or adjacent and nearby properties. Said information shall be specifically shown on plans submitted for building permits. 15. That the legal owner of subject property shall prepare an unsubordinated covenant providing reciprocal parking for the entire business complex. Said covenant shall be reviewed and approved by the Traffic and Transportation Manager and the Zoning Division, and shall be in a form satisfactory to the City Attorney, and shall then be recorded in the Office of the Orange County Recorder. A copy of the recorded covenant shall be submitted to the Zoning Division. 16. That the legal property owner shall provide the City of Anaheim with an electrical easement to be determined as electrical design is completed. 17. That subject property shall be developed and maintained substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2 and 3, and as conditioned herein. 18. That prior to issuance of a building permit, or prior to commencement of the activity authorized by this resolution, or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 8, 9, 10, 11, 14, 15 and 16, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 19. That prior to final building and zoning inspections, Condition No. 13, above-mentioned, shall be complied with. 20. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. -3- PC2001-18 ~ ~ BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
