PC2001-46 u A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2001-00388 PERTAINING TO THE LAND USE ELEMENT WHEREAS, the City Council of the City of Anaheim did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, Planning Commission did receive a verified petition for an amendment to the Land Use Element of the General Plan to redesignate certain property ("study area") described as an irregularly-shaped 1.04-acre property having a frontage of 68 feet on the north side of South Street and a maximum depth of 375 feet, being located 130 feet east of the centerline of Westgate Drive, and further described as 2901 East South Street, from the Genera/ Open Space to the Low-Medium Density Residential land use designation; and WHEREAS, this property is owned by the Orange County Water District and is currently developed with a plant nursery in the RS-A-43,000 "Residential/Agricultural" zone; and that General Plan Land Use Element designates the property for Genera/ Open Space land uses. WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on April 23, 2001, at 1:30 p.m., notice of s~id p~blic hearing -having been dul-y-giuen as required by lauv and._in accordance with_ the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted redesignating subject area for Low-Medium Density Residentia/ land uses. 2. That approval of this General Plan Amendment is compatible with surrounding land uses, which include an apartment complex to the north zoned RM-1200 (Residential, Multiple-Family), RM-1200 zoning to the east and single family residences zoned RS-7200 (Residential, Single-Family) to the west. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to change the current land use designation from Genera/ Open Space to Low-Medium Density Residential on an irregularly-shaped 1.04-acre property having a frontage of 68 feet on the north side of South Street and a maximum dep#h of 375 feet; beina located 130 feet east of the centerline of Westgate Drive, and further described as 2901 East South Street; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2001-00388 pertaining to the Land Use Element, Exhibit A, to redesignate the study area from the Genera/ Open Space to the Low-Medium Density Residential land use designation.
