PC2001-75 ~ A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2001-00047 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for certain real property situated in the City of Anaheim, County of Orange, State of Califomia, described as follows: THE EASTERLY 100 FEET OF THE NORTHERLY 232.61 FEET OF THE WEST ONE-HALF OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 28, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO LAS BOLSAS, AS PER MAP RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 18, 2001, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the meetings of May 7 and May 21, 2001; and - VVHERERS, said C~r~r~issian, after due inspect~~rr, investigat~on and study-macte by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the Residential/Agricultural Zone to the RS-7200 (Residential, Single-Family) Zone. 2. That the Anaheim General Plan designates subject property for Low Density Residential land uses, which allows a maximum of up to six dwelling units per acre (i.e., finro dwelling units on subject 0.43-acre property). 3. That the proposed reclassification of subject property is not necessary nor desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does not properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That the proposed reclassification is denied on the basis that the concurrent petitions for three lots (Variance No. 2001-04432 and Tentative Parcel Map No. 2000-211) exceed the maximum density permitted by the Low Density Residential land use designation (i.e., finro dwelling units on subject 0.43-acre property) and do not comply with the minimum lot area and width standards of the Zoning Code. 6. That there are no special circumstances applicable to this property because the property is rectangularly-shaped, has a flat topography and is similar to other surrounding properties which also face Orangewood Avenue. 7. That the petitioner could comply with the land use designation of the General Plan by eliminating most of the waivers and reducing the number of lots from three to two. 8. That the proposed lots are out of character with the other lots on this block face. CR5109PK.DOC -1- PC2001-75 ~ ~ 9. That two persons spoke in opposition to the proposal at the public hearing; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the RS-A-43,000 (Residential/Agricultural) Zone to the RS-7200 (Residential, Single-Family) Zone on a rectangularly shaped 0.43-acre property having a frontage of 100 feet on the south side of Orangewood Avenue and a maximum depth of 188 feet, being located 100 feet east of the centerline of Della Lane, and further described as 1628 West Orangewood Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Reclassification on the basis of the aforementioned findings.
