PC2001-85 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2000-00028 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot Nos. 1 through 17 of Tract No. 6192 show on pages 3 and 4 of book 233, fSCQ~d~d 4f1 AQ~lI 2$, 9967. WHEREAS, said property is generally described as 13 residential lots comprising 2.49 acres with a frontage of 300 feet on the south side of Crescent Avenue (and also having frontages on both sides of Colgate Street and Stockton Avenue) and being located 300 feet east of the centerline of Dale Avenue; and that said property is identified as "Location A" in the July 2, 2001 Staff Report to the Planning Commission; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on July 2, 2001 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the June 4, 2001 meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itseifi and in its behaii, a~d af~e~ uue ~~rs9~e~afior~ of a!! gv;d~^c~ ~rd r~pe~ts offsred at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the RM-1200 (Residential, Multiple-Family) Zone to the RS-5000 (Residential, Single-Family) Zone, or a less intense zone. 2. That subject prope~ty, although zoned for multiple family residential uses, is developed with 17 single family homes on average sized lots of 6,000 square feet; and that the proposed reclassification is consistent with the goals and policies of the General Plan and the Housing Element. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to the subject property and to the zones and their permitted uses generally established throughout the community. 5. That no one indicated their presence at the public hearing in opposition to the proposed reclassification; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify subject property ("Location A") from the RM-1200 (Residential, Multiple-Family) Zone to the RS-5000 (Residential, Single-Family) or a less intense zone on 17 lots comprising a rectangularly-shaped 2.49-acre area having a frontage of 344 feet on the south side of Crescent Avenue and a maximum depth of 385 feet, being located 300 feet east of the centerline of Dale Avenue, and further described as 2752 and 2754 West Crescent Avenue, 523 - 537 North Colgate Street, and 2752 - 2768 Stockton Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and CR5121 PK.doc -1- PC2001-85 ~ ~ that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification, unconditionally, to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the RM- 1200 (Residential, Multiple-Family) Zone and to incorporate said described property into the RS-5000 (Residential, Single-Family) Zone. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by the City Council at its sole discretion. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of July 2, 2001.
