Resolution-PC 2001-86! RESOLUTION NO. PC2001-86 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2000-00379 PERTAINING TO THE LAND USE ELEMENT WHEREAS, the City Council of the City of Anaheim did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, Planning Commission directed staff to initiate an amendment to the Land Use Elernent of the General Pian ta redesignate subject properties as fofiows: Parcel 1: #rom the General Industrial land use designation to the General Commercial land use designation; and Parcel 2: from the Commerciat Professional and Low Density Residential land use designations to the General Commercial land use designation; that said Parcels 1 and 2 are identified as "Location B" in the July 2, 2001 Staff Report to the Planning Commission; and that the finro areas are described as follows: Parcel 1: An irregularly-shaped 10.5-acre area located at the northwest corner of La Palma Avenue and Brookhurst Street with frontages of 120 feet on north side of La Palma Avenue and 540 feet on the west side of Brookhurst Street, and further described as 1101 - 1111 North Brookhurst Street. Parcel 2: An irregularly-shaped 5.5-acre area located at the northeast corner of La Palma Avenue and Brookhurst Street with frontages of 375 feet on the north side of La Palma Avenue and 690 feet on the east side of Brookhurst Street, and further described as 1110 -1142 North Brook.hur.st Street and 2141 - 2175 West La Palma Avenue. WHEREAS, Parcel 1 is developed with a church (Sa-Rang Community Church) zoned ML "Limited Industrial" and an auto repair shop zoned CG "Commercial General"; that the existing General Industrial land use designation is intended to provide for and encourage the development of industrial uses and related facilities; and that the proposed General Commercial land use designation is intended to provide for and encourage the orderly development of a wide variety of commercial uses, shopping centers, and small businesses, and that said designation is typically implemented by CL (Commercial, Limited) and CO (Cornmercial, Office and Professional) zoning; and WHEREAS, Parcel2 is developed with commercial businesses and a service station with a convenience market zoned CL "Commercial, Limited"; that the existing Commercial Professional land use designation on the southerly portion is intended to provide for and encourage the development of business and professional office centers, business offices, financial institutions, etc. (which designation is typically implemented by the CO [Commercial, Office and Professional] Zone), and that the Low Density Residential land use designation on the north portion is intended to provide for and encourage the development of detached single-family homes not exceeding the maximum density range prescribed the General Plan and zoning (which designation is typically implemented by the RS-10,000 or RS-7200 [Residential, Single-Family] zones); and that the proposed General Commercial land use designation is intended to provide for orderly development of a wide variety of commercial uses, shopping centers, and small businesses and is typically implemented by the CL (Commercial, Limited) Zone; and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on July 2, 2001, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the June 4, 2001 meeting; and CR5122PK.doc -1- PC2001-86 ~ ~ WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted redesignating both Parcel 1 and Parcel 2 (Location B) to the General Commercial land use designation. 2. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Pian~ing Commission has reviewed the proposal to amend the Land Use Eiement ~f the ~enerai Pian to change the current land use designations of finro areas as follows: Parcel 1, which consists of an irregularly-shaped 10.5-acre area located at the northwest corner of La Palma Avenue and Brookhurst Street with frontages of 120 feet on north side of La Palma Avenue and 540 feet on the west side of Brookhurst Street and further described as 1101 - 1111 North Brookhurst Street, from the General Industrial Land Use designation to the General Commercial Land Use designation; and Parcel 2, which consists of an irregularly-shaped 5.5-acre area located at the northeast corner of La Palma Avenue and Brookhurst Street with frontages of 375 feet on the north side of La Palma Avenue and 690 feet on the east side of Brookhurst Street and further described as 2141 - 2175 West La Palma Avenue and 1110 - 1142 North Brookhurst Street, from the Commercial Professional land use designation (southerly 4.5 acres) and Low Density Residential land use designation (northerly 1 acre) to the General Commercial Land Use designation; and does hereby approve the Negative Declaration upon finding that it has considered the Negative ~eclara#ion together uirith any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2000-00379, pertaining to the Land Use Element, Exhibit A, to redesignate Parcel 1 and Parcel 2(Location B) to the General Commercial land use designation.
