Resolution-PC 2002-112• RESOLUTION NO. PC2002-112 • A NUNC PRO TUNC RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING THE TITLE OF RESOLUTION NO. PC2000-50, ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 1742 WHEREAS, on October 10, 1977 the Anaheim City Planning Commission, by its Resolution No. PC77-217, granted Conditional Use Permit No. 1742, in part, to permit a drive-through restaurant at 600 South Brookhurst Street with waiver of minimum number of parking spaces (waivers of maximum number of free-standing signs, permitted location of free-standing signs and minimum distance between free-standing signs were denied); and WHEREAS, on April 24, 2000 the Planning Commission, by its Resolution No. PC2000-50, approved a proposal to construct a second service window in an existing drive-though lane at the fast food restaurant at 600 South Brookhurst Street (In-n-Out Burger) with waivers of minimum number of parking spaces and minimum drive-through lane dimensions, and including 12 conditions of approval which, in effect, supercede Condition Nos. 1 through 5 of the above-mentioned Resolution No. PC77-217 (adopted in connection with Conditional Use Permit No. 1742 and under which the existing fast food restaurant was originally constructed); and that the title of Resolution No. PC2000-50 reads as follows: A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2000-04194 BE GRANTED - V1l.HEREAS, _the intent_of the development proposal before the Planning Commission on April 24, 2000 was to amend Conditional Use Permit No. 1742 and modify the approved use of the property and the conditions of approval (rather than approving a new conditional use permit); and that inadvertently the TideMark tracking number (Tracking No. CUP2000-04194 which is intended for internal city use only) was incorrectly used in the title of Resolution No. PC2000-50 as follows: "...That Petition for Conditional Use Permit No. 2000-04194 be granted"), and that correct use of the number is: "(Tracking No. CUP2000-04194)'; and NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend, nunc pro tunc, the title of Resolution No. PC2000-50, adopted in connection with Conditional Use Permit No. 1742, to read as follows: A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO.
