Resolution-PC 2002-135. • RESOLUTION NO. PC2002-135 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION FINDING AND DETERMINING THAT THE PREVIOUSLY-CERTIFIED FINAL EIR FOR THE WEST ANAHEIM COMMERCIAL CORRIDORS REDEVELOPMENT PROJECT, TOGETHER WITH THE ADDENDUM AND MITIGATION MONITORING PLAN NO. 119 ARE ADEQUATE TO SERVE AS THE REQUIRED ENVfRONMENTAL DOCUMENTATION FOR THE WESTGATE PROJECT WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on August 26, 2002 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed general plan amendment, reclassification, conditional use permit and determination of public convenience or necessity and to investigate and make findings and recommendations in connection therewith; and that said public hearing was continued to the September 9, 2002 Planning Commission meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. The Final EIR [Section 3.7: "Intended Uses of this FEIR"] expressly provides for the City to use the information contained in the Final EIR in connection with its "approval of development plans including variances and conditional use permits," "approval of disposition of property," and "approval of zone changes and General Plan amendments that may be necessary to implement development for specific sites within the [WACCRP]"; and 2. The proposed project actions constitute public and private activities or undertakings pursuant to, or in furtherance, of the WACCRP. Section 21090 of CEQA provides that "all public and private activities or undertakings pursuant to, or in furtherance of, a redevelopment plan shall be deemed to be a single project." Section 15180 of the CEQA Guidelines provides that "an EIR on a redevelopment plan shall be treated as a program EIR with no subsequent EIR's required for individual components of the redevelopment plan unless a subsequent EiR or a supplement to an EIR would be required by Section 15162 or 15163"; and 3. Following the directive of Section 15168(c)(4) of the CEQA Guidelines, a written checklist was utilized to evaluate the proposed project actions to determine whether their environmental effects were covered in the Final EIR; specifically, to determine whether any of the conditions or factors identified in CEQA Guidelines Section 15162 or 15163 required the preparation of either a subsequent EIR or supplement to the Final EIR. The Addendum contains this checklist and concludes that neither a subsequent EIR or supplement to the Final EIR are required for the proposed project actions; and 4. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition; and that two people spoke in favor ofi the subject request (1 represented West Anaheim Neighborhood Development Council (WAND], and 1 represented the City of Buena Park who spoke in favor, but relayed some concerns); and NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend that the City Council make the determination that the Addendum to Previously- Certified Final EIR for the West Anaheim Commercial Corridors Redevelopment Project, along with the Addendum and the Associated Mitigation Monitoring Plan No. 119, were prepared in compliance with the requirements of the California Environmental Quality Act ("CEQA") and the State and City of Anaheim CEQA Guidelines; that as demonstrated by the analysis included in the Final EIR and Addendum for all environmental issues, the proposed project actions will not result in new significant impacts or substantial increases in the severity of previously identified significant impacts and no supplemental or subsequent environmental review is required; and, that the City Council hereby determined that the Final EIR along with the Addendum and the Associated Mitigation Monitoring Plan No. 119 are adequate to serve as the required environmental documentation for the for the proposed project actions.
