PC2002-168 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO. 69R-322 ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 1098 WHEREAS, on June 3, 1969, the Anaheim City Council did, by its Resolution No. 69R-322, grant Conditional Use Permit No. 1098 to permit the establishment of a 182-space mobile home park; and that Condition No. 18 of said resolution specifies that the property shall be developed substantially in accordance with Revision No. 2 of Exhibit No. 1(showing 182 spaces) and Exhibit Nos. 2 and 3; and WHEREAS, in 1979 a site plan was submitted showing 184 mobile home spaces, and on April 3, 1979 the City Council approved a plan for one additional space, for a total of 185 mobile home spaces; and WHEREAS, on August 27, 1986, staff approved a plan for three additional spaces for a total of 188 mobile home spaces; and WHEREAS, in 1987 a site plan was submitted showing three mobile home spaces in an area which originally had only two spaces (Revision No. 2 of Exhibit No. 1), and on February 26, 1987, staff approved a plan to realign those three existing spaces for a total of 189 spaces; and WHEREAS, the property, which contains an oil well site, is developed with a 190-unit mobil~-bome park (Rio Vista Mobil~Ho~ne Park} a~d an accesso~r Fecr-ea~iona~ b~ailding and swiFn~ning pool; that the zoning is RS-A-43,000(O)(MHP) (Residential/Agricultural - Oil Production Overlay and Mobilehome Park Overlay); and that the Anaheim General Plan Land Use Element designates the property for Low-Medium Density Residential land uses; and WHEREAS, the petitioner has requested approval of amended exhibits for an existing mobile home park to allow 10 additional spaces, but that following public notification, it was found that the park was developed with 190 mobile home spaces instead of 186 spaces as previously approved (i.e., 182 spaces originally granted in connection with this use permit, plus one space approved by City Councif, plus three spaces approved by staff); and, therefore, the request was modified to permit and retain the existing mobile home spaces and to allow 10 additional spaces under authority of Code Sections 18.21.050.210 and 18.92.020, for a total of 200 mobile home spaces; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 21, 2002, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and that when it was discovered that there were additional existing mobile home spaces which were not shown on the site plan originally approved in connection with this conditional use permit (Revision No. 2 of Exhibit Nos. 1, 2 and 3) or on the plans subsequently approved by the City Council and staff, said public hearing was re-advertised and continued to the November 18, 2002 Commission meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the use, as proposed to be amended, is properly one for which a conditional use permit is authorized by the Zoning Code. Tracking No. CUP2002-04613 CR5500DM.doc -1- PC2002-168 • • 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located because the additional mobile home spaces are wholly contained within the existing mobile home park. 3. That the size and shape of the site for the proposed use is adequate to allow full development of said use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. That the amending this use permit, under the conditions imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 6. That finro people spoke at the public hearing in opposition to the proposal; and that a letter in opposition was received. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: The Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 1, as defined in the State of California Environmental Impact Report ("EIR") Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. 69R-322, adopted in connection with Conditional Use Permit No. 1098, to permitten ~10) additional spaces_ in_an exisiing_rnoblle hocne-pack #or a total ~nra-hund~ed-(200) spaEes -- and to amend the conditions of approval, in their entirety, to read as follows: 1. That any required relocation of City of Anaheim electrical facilities shall be at the developer's expense. 2. That abandonment of the oil well pump site (which is the area where the 10 additional spaces will be located) shall conform with Section 17.12.080 (Abandonment Procedure) of Chapter 17.12 (Oil Drilling and Production Regulations) the Anaheim Municipal Code. 3. That a copy of the written approval from the Division of Oil and Gas confirming compliance with all oil well abandonment proceedings as required under California State law, shall be provided to the Zoning Division. 4. That trash storage area(s) shall be maintained in location(s) acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. Said storage area(s} shall be designed, located and screened so as not to be readily identifiable from adjacent streets and highways. The walls of the storage area(s) shall be protected from graffiti opportunities by the use of plants such as minimum one (1) gallon sized clinging vines planted on maximum three (3) foot centers or tall shrubbery. Said information shall be specifically shown on the plans submitted to the Planning Department and Streets and Sanitation Division for review and approvai. 5. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Revision No. 3 of Exhibit No. 1(dated August 27, 2002), and Exhibit Nos. 2 and 3(labeled `Recreation Building Elevations' and `Recreation Building Floor Plans'), and as conditioned herein. 6. That prior to commencement of the activity authorized by this resolution or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 2, 3 and 4, -2- PC2002-168 ! • above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 7. Prior to final building and zoning inspections by any agency, Condition No. 5 above-mentioned shall be complied with. 8. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
