PC2002-61 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2001-00060 BE GRANTED, UNCONDITIONALLY (100 South Beach Boulevard, 120-320 South Beach Boulevard and 2970 West Lincoln Avenue) WHEREAS, the Anaheim City Planning Commission did direct staff to initiate Reclassification of real property situated in the Ciry of Anaheim, County of Orange, State of California, described as follows: PARCEL A: THE NORTH 5 ACRES OF THE WEST 10 ACRES OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 13, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCH LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. EXCEPTING THEREFROM THE WEST 55.00 FEET THEREOF. ALSO EXCEPTING THEREFROM THAT PORTION DESCRIBED IN THE DEED TO THE STATE OF CALIFORNIA RECORDED AUGUST 10, 1951 IN BOOK 2215, PAGE 106 OF OFFICIAL RECORDS OF SAID ORANGE COUNTY. ALSO EXCEPTING THEREFROM THAT PORTION DESCRIBED IN THE DEED TO THE STATE OF CALIFORNIA RECORDED AUGUST 20, 1999 AS INSTRUMENT NO. 19990610130 OF SAID OFFICAL RECORDS. PARCEL B: THE EAST 10 ACRES OF THE WEST 20 ACRES OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 13, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA EXCEPTING THEREFROM THAT PORTION LYING EASTERLY OF THE FOLLOWING DESCRIBE LINE: BEGINNING AT A POINT ON THE NORTH LINE OF SAID SECTION 13, SAID POINT OF BEGINNING BEING NORTH 89°41' 15" EAST 332.08 FEET FROM THE NORTHWEST CORNER OF SAID SECTION 13; THENCE SOUTH 0° 10' 25" EAST 1339.14 FEET TO A POINT IN THE SOUTH LINE OF THE NORTH HALF OF THE NORTHWEST QUARTER OF SAID SECTION 13, SAID POINT BEING NORTH 89° 37' 30" EAST 332.16 FEET FROM THE INTERSECTION OF SAID SOUTH LINE OF THE WEST LINE OF SAID SECTION 13. WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 6, 2002 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposal is for reclassification of certain properties described as follows: Area 1 consisting of 0.58-acre located at the southeast corner of Lincoln Avenue and Beach Boulevard, having cr5348dm.doc - 1 - PC2002-61 • • frontages of 160 on the south side of Lincoln Avenue and 160 feet on the east side of Beach Boulevard, and further described as 100 South Beach Boulevard; and Area 2 consisting of 7.3 acres located south and east of the southeast corner of Lincoln Avenue and Beach Boulevard, having approximate frontages of 80 feet on the south side of Lincoln Avenue and 1,340 feet on the east side of Beach Boulevard, being located approximately 238 feet south of the centerline of Lincoln Avenue, and further described as 120- 320 South Beach Boulevard and 2970 West Lincoln Avenue. 2. That the proposed reclassification consists of the following: Area 1 from the CH (Commercial, Heavy) zone to the CL (Commercial, Limited) zone, unconditionally; and Area 2 from the CL (Commercial, Limited), CH (Commercial, Heavy) and RS-A-43,000 (Residential/Agricultural) zones to the RM-3000 (Residential, Multiple-Family) or a less intense zone, unconditionally. 3. That the General Plan designates Area 1 for Genera/ Commercial land uses. 4. That the General Plan designates Area 2 for Genera/ Commercial land uses, but that the Planning Commission has recommended that City Council approve General Plan Amendment No. 2001- 00396 to redesignate said area to the Low-Medium Density Residential and Police Station (P) land use designations. 5. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 6. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. _ 7. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify Area 1 of subject property from the CH (Commercial, Heavy) to the CL (Commercial, Limited) zone on a rectangular shaped 0.58-acre property located at the southeast corner of Lincoln Avenue and Beach Boulevard, having frontages of 160 feet on the south side of Lincoln Avenue and 160 feet on the east side of Beach Boulevard, and further described as 100 South 8each Boulevard; and to reclassify Area 2 of subject property from the CH (Commercial, Heavy), CL (Commercial, Limited) and RS-A-43,000 (Residential/Agricultural) zones to the RM-3000 (Residential, Multiple-Family) or a less intense zone on an irregularly shaped 7.3-acre area located south and east of the southeast corner of Lincoln Avenue and Beach Boulevard, having frontages of 80 feet on the south side of Lincoln Avenue and 1,340 feet on the east side of Beach Boulevard, being located 238 feet south of the centerline of Lincoln Avenue, and further described as 120-320 South Beach Boulevard and 2970 West Lincoln Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described Area 1 from the CH (Commercial, Heavy) zone and to incorporate said property into the CL (Commercial, Limited) zone, unconditionally; and to exclude the above-described Area 2 from the CL (Commercial, Limited), CH (Commercial, Heavy) and RS-A-43,000 (Residential/Agricultural) zones and to incorporate said property into the RM-3000 (Residential, Multiple-Family) zone, unconditionally. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that should any part of this Resolution be declared invalid or unenforceable by the - 2 - PC2002-61 ~ ~ final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by the City Council at its sole discretion.
