PC2002-63 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2001-00063 BE GRANTED, UNCONDITIONALLY (2330 - 2340 West Lincoln Avenue) WHEREAS, the Anaheim City Planning Commission did direct staff to initiate Reclassification of real property situated in the City of Anaheim, County of Orange, State of California, described as follows: PARCEL 1: THE WEST HALF OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE SAN JUAN CAJON DE SANTA ANA, AS PER MAP RECORDED IN BOOK 51 PAGE 10 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. EXCEPT THE NORTH 66.00 FEET THEREOF, AND EXCEPT FROM THE REMAINDER OF SAID LAND, THE NORTH 150.00 FEET OF THE WEST 200.00 FEET, MEASURED ALONG THE NORHT AND WEST LINES THEREOF. PARCEL 2: THE NORTH 216 FEET, MEASURED ALONG THE WEST LINE OF THE WEST 200 FEET, MEASURED ALONG THE NORTH LINE OF THE WEST ONE-HALF OF THE NORTHEAST ONE-QUARTER OF THE NORTHWEST ONE-QUARTER OF THE NORTHEAST ONE-QUARTER OF SECTION 18. TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO SAN JUAN CAJON DE SANTA ANA, AS SAID SECTI~N IS SHOWN ON MAP RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS. IN THE OFFICE OF THE COUNTY RECORDED OF SAID COUNTY. EXCEPT THE NORTH 66.00 FEET THEREOF. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on May 6, 2002 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposal is for reclassification of certain properties consisting of 4.4 acres located on the south side of Lincoln Avenue approximately 650 feet east of the centerline of Gilbert Street from the CL (Commercial, Limited) to the RM-3,000 (Residential, Multiple-Family) or a less intense zone. 2. That the Anaheim General Plan land use designation is General Commercial, but that the Planning Commission has recommended that City Council approve General Plan Amendment No. 2001- 00399 to redesignate said properties to Low-Medium Density Residential land uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. That two people spoke at the public hearing in opposition to the proposal; that one person representing owners of 2301, 2323 and 2331 West Lincoln Avenue spoke with concerns pertaining to the traffic signal across from the former Home Depot site and suggested that the traffic signal and left turn lanes remain; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposed reclassification from the CL (Commercial, Limited) zone to the RM-3,000 (Residential, Multiple-Family) or a less intense zone on 4.4 acres having a frontage of 330 feet on the south side of Lincoln Avenue, being located 650 feet east of the centerline of Gilbert Street, and further described as 2330 - 2340 West Lincoln Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project wil4 have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the CL (Commercial, Limited) Zone and to incorporate said described property into the RM-3,000 (Residential, Multiple-Family) Zone, unconditionally. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legisfative act which may be approved or denied by the City Council at its sole discretion.
