PC2003-101 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2003-00106 (STUDY AREA 4) BE GRANTED, UNCONDITIONALLY WHEREAS, on May 5, 2003, the Anaheim City Planning Commission did direct staff to initiate petitions for Reclassification of certain areas within the Anaheim Colony Historic Disfrict, including subject property, from multiple-family residential zoning to single-family residential zoning; and that subject property consists of twelve parcels totaling approximately 2 acres situated in the City of Anaheim, County of Orange, State of California, described as follows: THOSE CERTAIN PARCELS LOCATED ON THE EAST SIDE OF CITRON STREET BETWEEN SYCAMORE STREET AND CYPRESS STREET, AND BOUNDED ON THE EAST BY THE PUBLIC ALLEY LOCATED BETWEEN, AND GENERALLY PARALLEL TO, CITRON STREET AND RESH STREET. WHEREAS, the above-described parcels, which are addressed at 302, 308, 312, 318, 324, 328, 400, 404, 410, 414, 420 and 424 North Citron Street, are illustrated on the Location Map (labeled `Study Area 4') attached to the Staff Report to the Planning Commission dated June 30, 2003, Item No. 11; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in_ihe_Cit.y_of A_naheim_on_Ju.ne 3Q~2003 at_1_:30 p.m..,_notice_of said__public hear_in.ghaving_bee^ duly ______ __ ____ given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of Study Area 4 from the RM-2400 (Residential, Multiple-family) Zone to the RS-7200 (Residential, Single-Family) or a less intense zone. land use. 2. That the Anaheim General Plan designates subject property for Low Density Residential 3. That the subject property is located within the Anaheim Colony Historic District, which District is bounded by North, East, South and West Streets; and that the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That one person spoke at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. 6. That seven people indicated their presence at the public hearing in favor of the proposaf. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposed reclassification from the RM-2400 (Residential, Multiple-Family) Zone to the RS-7200 (Residential, Single-Family) or a less intense zone on 2.0 acres located on the east side of Citron Street between Sycamore Street and Cypress Street, having a frontage cr\PC2003-101.doc -1- PC2003-101 • • of approximately 760 feet on the east side of Citron Street and a maximum depth of 132 feet, and further described as 302 through 424 North Citron Street; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property (Study Area 4) from the RM-2400 (Residential, Multiple-Famity) Zone and to incorporate said described property into the RS-7200 (Residential, Single-Family) Zone, unconditionally. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone the subject property; any such rezoning shall require an ordinance of the City Council, which shall be a legislative act, which may be approved or denied by the City Council at its sole discretion.
