Resolution-PC 2003-159~ RESOLUTION NO. PC2003-159 ~ A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2003-00413 PERTAINING TO THE LAND USE ELEMENT WHEREAS, the Anaheim City Council did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, the Anaheim City Pianning Commission did direct staff to initiate an amendment to the Land Use Element of the General Plan to redesignate subject properties from the General Industrial land use designation to the Medium Density Residential land use designation on an area consisting of multiple properties totaling approximately 2.35 acres located on the west side of Vine Street between Broadway and Santa Ana Street with frontages of 125 feet on the south side of Broadway, 756 feet on the west side of Vine Street, 125 feet on the north side of Santa Ana Street and 756 feet on the east side of the Southern Pacific Railroad right-of-way and further described as 802 to 808 East Broadway, 801 East Santa Ana Street and 409 to 421 South Vine Street and also including the Santa Ana Street right-of-way between the Southern Pacific Raiiroad right-of-way and Vine Street; and WHEREAS, the Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on November 17, 2003, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal ~ode, to hear and consider evider~ce for ar~d agamst said Generat Plar~ - - Amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted redesignating subject area for Medium Density Residentia! land uses. 2. That one person spoke at the public hearing in favor of the proposal and a second person spoke in favor of condominiums and improvements; and that no correspondence was received in favor of the proposal. 3. That one person spoke at the public hearing in opposition to the proposal and a second person indicated their presence at the hearing in opposition; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to change the current land use designation from General Industrial to Medium Density Residential on a rectangularly-shaped 2.35-acre area consisting of the properties on the west side of Vine Street between Broadway and Santa Ana Street having frontages of 125 feet on the south side of Broadway, 756 feet on the west side of Vine Street, 125 feet on the north side of Santa Ana Street and 756 feet on the east side of the Southern Pacific Railroad right-of-way and further described as 802 to 808 East Broadway, 801 East Santa Ana Street and 409 to 421 South Vine Street and also including the 64.75-foot wide portion of Santa Ana Street between the Southern Pacific Railroad right-of-way and Vine Street; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any CR\PC2003-159.doc -1- PC2003-159 • ~ comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Pianning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2003-00413 pertaining to the Land Use Efement, Exhibit A, to redesignate the study area from the General Industrial land use designation to the Medium Density Residential land use designation.
