PC2003-171 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2003-00415 PERTAINING TO THE LAND USE ELEMENT WHEREAS, the Anaheim City Council did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, the petitioner has requested an amendment to the Land Use Element of the General Plan to redesignate certain property consisting of 5.7 acres located on the south side of the SR- 91/Riverside Freeway at the northeast terminus of Via Cortez, and having a frontage of 161 feet on the terminus of Via Cortez and being located 837 feet north of the centerline of Santa Ana Canyon Road, from the Hillside Low-Medium Density Residential land use designation to the General Commercial land use designation; and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on December 15, 2003, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That the proposed General Commercial land use designation is consistent with the adjacent and nearby General Commercial land use designation to the west and southwest of subject property. 2. That the subject property is not a viable residential site due to development constraints such as easements, concrete flood control channels, and the size and shape of the property adjacent to the SR 91/Riverside Freeway. 3. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted redesignating subject property from the Hillside Low-Medium Density Residential land use designation to the General Commercial land use designation. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to change the current land use designation of certain property consisting of the northwesterly 3.9 acres of a 5.7-acre property located on tf~e south side of the SR-91/Riverside Freeway at the northeast terminus of Via Cortez, having a frontage of 161 feet on the northeast terminus of Via Cortez and a maximum depth of 1,370 feet and being located 837 feet north of the centerline of Santa Ana Canyon Road, from the Hillside Low-Medium Density Residential land use designation to the General Commercial land use designation; and does hereby approve the Mitigated Negative Declaration, including Mitigation Monitoring Plan No. 122 for the Caliber Motors Mercedes-Benz Sales Facility, upon finding that it has considered the Mitigated Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no evidence that the project will have a significant effect on the environment. cr\PC2003-171.doc -1- PC2003-171 # ~ NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2003-00415 pertaining to the Land Use Element, Exhibit A, to redesignate the study area from the Hillside Low-Medium Density Residential land use designation to the General Commercial land use designation.
