PC2003-21 ~ A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2002-00408 PERTAINING TO THE LAND USE ELEMENT WHEREAS, the Anaheim City Council did adopt the Anaheim General Pian by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, the Planning Commission did direct staff to initiate an amendment to the Land Use Element of the General Plan on a triangularly-shaped area consisting of approximately 2 acres located between the south side of the Riverside (SR-91) Freeway and the north side of Houston Street, west of Gilbert Street and east of three single-family residential lots fronting on Braeburn Street; that said area is shown as Portion B on the location map attached to the Staff Report to the Planning Commission dated January 27, 2003; and that the proposed amendment is to redesignate subject area from the County of Orange General Plan land use designation to the City of Anaheim Low-Medium Density Residential land use designation; and WHEREAS, the above-described area (Portion B) is currently under the jurisdiction of the County of Orange; that the area is developed with residential uses; and that annexation to the City of Anaheim is pending; and - - - -WH€R~A9, the Anaheir~ C'rty PlanniFlg ~a~imission-did-hold a p.ublic h.earing. at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on January 27, 2003, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted designating subject area for Low-Medium Density Residential land uses. 2. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to change the current land use designation from the County of Orange designation to the City of Anaheim Low-Medium Density Residentia/ designation on approximately 2 acres located between the south side of the Riverside (SR-91) Freeway and the north side of Houston Street, west of Gilbert Street and east of three single-family residential lots fronting on Braeburn Street; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2002-00408, Exhibit A, pertaining to the Land Use cr\PC2003-021.doc -1- PC2003-21 ~ • Element to designate the study area from the County of Orange land use designation to the City of Anaheim Low-Medium Density Residential land use designation.
