Resolution-PC 2003-22• • RESOLUTION NO. PC2003-22 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2002-00089 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification for certain real property situated in the County of Orange, State of California, described as follows: LEGAL DESCRIPTIONS (FOR `A' AND `B') ATTACHED WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on January 27, 2003 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That subject properties are currently situated in the County of Orange; that the properties are developed with residential uses; and that annexation to the City of Anaheim is pending. 2. That the Anaheim General Plan land use designation for Portions A and B is Low Density Residential; and that the Planning Commission has recommended that City Council adopt General Plan Amendment No. 2002-00408 to redesignate Area B for Low-Medium Density Residential land uses. 3. That the petitioner proposes reclassification of two adjacent areas as follows: Portion A- from the County of Orange R4 `Suburban Multifamily Residential' zone designation to the City of Anaheim 'RS-7200' (Residential, Single-Family) or less intense zone on an irregularly-shaped area consisting of approximately 6.8 acres between the south side of the Riverside (SR 91) Freeway and the north side of Houston Avenue, with a frontage of approximately 680 feet on the north side of Houston Avenue and being located approximately 620 feet west of the centerline of Gilbert Street; and Portion B- from the County of Orange R4 'Suburban Multifamily Residential' zone designation to the City of Anaheim 'RM-3000' (Residential, Multiple-Family) or less intense zone on a triangularly-shaped area consisting of approximately 2 acres located west of Gilbert Street between the south side of the Riverside (SR 91) Freeway and the north side of Houston Avenue, with a frontage of approximately 590 feet on the north side of Houston Avenue. 4. That the proposed reclassification of subject properties is necessary and/or desirable for the orderly and' proper development of the community. 5. That the proposed reclassification of subject properties does properly relate to the zones and their permi#ted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 6. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. cr1PC2003-022.doc -1- PC2003-22 • • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify certain properties as follows: Portion A from the County of Orange 'R4' (Suburban Multifamily Residential) zone designation to the City of Anaheim `RS-7200' (Residential, Single-Family) or less intense zone on an area consisting of approximately 6.8 acres between the south side of the Riverside (SR 91) Freeway and the north side of Houston Avenue, with a frontage of approximately 680 feet on the north side of Houston Avenue and being located approximately 620 feet west of the centerline of Gilbert Street Street; and Portion B from the County of Orange `R4' (Suburban Multifamily Residential) zone designation to the City of Anaheim `RM-3000' (Residential, Multiple-Family) or less intense zone on an area consisting of approximately 2 acres located west of Gilbert Street between the south side of the Riverside (SR 91) Freeway and the north side of Houston Avenue, with a frontage of approximately 590 feet on the north side of Houston Avenue; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code as follows: (a) to exclude the above-described Portion A from the County of Orange `R4' (Suburban Multifamily Residential) zone designation and to incorporate said described properties into the City of Anaheim 'RS-7200' (Residential, Single-Family) Zone, unconditionally; and (b) to exclude the above-described Portion B from the County of Orange `R4' (Suburban Multifamily Residential) zone designation and to incorporate said described properties into the City of Anaheim `RM-3000' (Residential, Multiple-Family) Zone, unconditionally. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject properties; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by the City Council at its sole discretion. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of January 27, 2003.
