Resolution-PC 2003-92~ RESOLUTION NO. PC2003-92 ~ A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2003-00099 BE GRANTED WHEREAS, in January 2000, the State of California did, by the adoption of Assembiy Bill ("AB") 1555, make the annexation of `county islands' (i.e., pockets of land that are surrounded by but not within any city's boundaries) a priority of local government; and that the Bill eases the procedural requirements for certain `island' annexations in order to assist Local Agency Formation Commissions ("LAFCO") and local cities with the annexation process; and WHEREAS, the benefits of annexing county islands include improving delivery of government services, improving land use and development standards compatibility, improving local code enforcement services, and providing a clearer understanding of jurisdiction by the community; and W HEREAS, on October 29, 2002, the Anaheim City Council approved a memorandum of understanding with the County of Orange stipulating that the City would pursue a process that may lead to annexation of all unincorporated territories within Anaheim's sphere of influence over a two year period; and WHEREAS, on May 5, 2003, the Anaheim City Planning Commission did, by motion, initiate a petition for Reclassification of certain real properties situated in the County of Orange, State of California, and described in Exhibit A attached hereto and titled "Reclassification No. 2003-00099 - Map Showing the Boundaries of the Area Proposed for Reclassification."; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 16, 2003 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed reclassification of the subject area is from the County of Orange A1 (General Agricultural) District to the City of Anaheim RS-A-43,000 (Residential/Agricultural) Zone. 2. That the proposed reclassification is pre-zoning which is a preliminary step required by LAFCO prior to annexing 'county islands' into the City of Anaheim. ~ 3. That the subject properties, which comprise approximately 177 acres, are currently utilized for County of Orange water services; and that the Land Use Element of the Anaheim General Plan designates the properties for Water Uses. 4. That the proposed reclassification of subject properties is necessary and/or desirable for the orderly and proper development of the community. 5. That the proposed reclassification of subject properties does properfy relate to the zones and their permitted uses locally established in close proximity to subject properties and to the zones and their permitted uses generally established throughout the community. 6. That no one indicated their presence at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. cr\PC2003-092.doc -1- PC2003-92 ~ ~ CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to reclassify certain properties consisting of an irregularly-shaped 177-acre area located along the Santa Ana River between Lincoln Avenue on the south and a diagonal line located approximately 1,200 feet northeast of, and parallel to, Glassell Street to the northeast (and which diagonal line is also a segment of the Anaheim City Limits), and the Riverside (SR-91) Freeway to the north and the Orange City Limits to the southeast from the County of Orange A1 (General Agricultural) District to the City of Anaheim RS-A-43,000 (Residential/Agricultural) Zone; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described properties from the County of Orange A1 (General Agricultural) District and to incorporate said described properties into the City of Anaheim RS-A-43,000 (Residential/Agricultural) Zone. BE IT FURTHER RESOLVED that this Resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject properties; any such rezoning shall require an ordinance of the City Council, which shall be a legislative act, which may be approved or denied by the City Council at its sole discretion; and that such rezoning shall become effective at the same time that annexation of the above-described properties becomes effective.
